1987-1681984L NOTS Repealed by Ordinance No 2002-057 AN ORDINANCE AMENDING ARTICLE I OF CHAPTER 10 OF THE CODE OF ORDINANCES OF THE CITY OF DENTON, TEXAS BY AMENDING SECTION 10 2 THEREOF, AND BY ADDING A NEW ARTICLE V ENTITLED "FIRE LANES-FIRE APPARATUS ACCESS ROADS", TO PROVIDE FOR AMENDMENTS TO THE UNIFORM FIRE CODE, TO PROVIDE FOR ADDITIONS THERETO, REPEALING ALL ORDINANCES IN CONFLICT HEREWITH, PROVIDING FOR A MAXIMUM PENALTY IN THE AMOUNT OF $2,000 THEREFOR, AND PROVIDING FOR AN EFFECTIVE DATE THE COUNCIL OF THE CITY OF DENTON HEREBY ORDAINS SECTION I That Subsection 10-2 (c)(ll) (Amendments) of Chapter 10 LFire Prevention) of the Code of Ordinances of the City of Denton, Texas is hereby amended to read as follows Sec 10-2 (c)(ll) The amendment of Section 10 207, Fire Apparatus and Access Roads to read as follows Fire apparatus access roads and fire lanes shall be provided and maintained in accordance with the provisions of Article V of Chapter 10 of the Code of Ordinances SECTION II That Chapter 10 of the Code of Ordinances of the City of Denton, Texas is hereby amended by the addition of Article V thereto, which said Article shall hereafter be and read as follows ARTICLE V FIRE FIRE LANES-APPARATUS ACCESS ROADS Sec 10-60 Definitions Fire lane is a fire apparatus access roadway, on private pro- perty or within public right-of-way, which provides unobstructed passage for fire department apparatus responding to or engaged in emergency fire and rescue operations Sec 10-61 Requirements (a) Every building hereafter constructed shall be accessible to fire department apparatus by way of access roadways which shall meet the specifications outlined in Sec 10-62 (b) The Fire Marshal is hereby authorized and empowered to establish and designate fire lanes as he may deem necessary for the proper ingress and egress of emergency vehicles Any fire lane designated by the Fire Marshal shall become effective as of the date he so designates Sec 10-62 (a) Specifications Each fire apparatus access roadway shall be constructed and maintained in accordance with the provisions of this section (1) The roadway shall be not less than twenty feet (20') of unobstructed width, with the road edge closest to building at least ten feet (10') from the building (2) The roadway shall be extended to within fifty feet (50') of all portions of the exterior wall of the first story of any building (3) The roadway shall provide adequate turning radius and turn arounds (4) The roadway shall be capable of supporting the Imposed load of 40,000 pound fxre apparatus with two-thirds of the weight on the rear axle (S) The roadway shall have a minimum of thirteen feet, SlX inches (13'6") of vertical clearance (6) The Roadway shall shall be constructed of concrete, asphalt, or other hard surface material approved by the Fire Marshal (b) Clearances or widths required by this section may be increased when, in the opinion of the Fire Marshal, minimum clearances or widths are not adequate to provide fire apparatus access For high-plied combustible storage, see Section 81 109, Uniform Fire Code Sec 10-63 Extent (a) The fire lane shall be extended to within fifty feet (S0') of all portions of the exterior walls of the first story of any building (b) Where the fire lane cannot be provided to within fifty feet (50') of all exterior walls of the first story of a buxld- lng, or where the building height is thirty feet (30') or more, an approved fire protection system or systems shall be provided as required and approved by the Fire Marshal and adequate access roadways extending to within fifty feet (S0') of the entire front of the building shall be provided for fire equipment access to the building as required and approved by the Fire Marshal (c) If a building is equipped with automatic sprinkler, the fire lane may be extended to be within one hundred fifty PAGE 2 feet (150') of all exterior walls of the first story of a building Sec 10-64 Turning radius Dead end fire apparatus access roads in excess of one hundred fifty feet (150'), and dead end fare lanes in excess of one hundred fifty feet (150') from a public street, shall be provided with approved provisions for the turnang around of fire depart- ment apparatus The turning area required is a radius of fifty- seven feet (57') The turnang area shall have an internal radius of thirty-lave feet (35') or greater All external radii shall be twenty-two feet (22') greater than the correspondang anternal radix and in no event less than fafty-seven feet (57') Sec 10-65 Bradges Wherever a bridge is required to be used as access under this article, at shall be constructed and maintained in accordance wath applicable sectaons of the Bualdlng Code and usang desagned live loading sufficient to carry the imposed loads of fire apparatus Sec 10-66 Marking (a) Fire lanes shall be marked with a slx anch (6") red stripe by paint the shade and type of whach comply with Texas Manual on Uniform Control Devaces or have been approved by the City Traffac Engineer (b) The words "FIRE LANE NO PARKING" shall be stenciled with four inch (4") letters with white paint on the red stripe (c) The interval between stenciled signs shall be greater than twenty feet (20') (d) Ail fire lane marking and letterang shall be maintained so as to be clearly legible (e) Appropriate signs may be used in lieu of red stripes when approved by the Fire Marshal Sec 10 67 Grade The gradient for a fire apparatus access roadway shall not exceed the maxamum approved by the Fire Marshal PAGE Sec 10-68 Fire Lanes (a) The operator o£ premises shall maintain, free of obstruc- tion, all fire lanes on his premises (b) No person may marks post, or otherwise identify a non-fire lane private vehicular passageway (1) as a £1re lane, or (2) in such a manner as tends to create con£uslon as to whether the passageway is a fire lane (c) No person may stops park, or leave standing any non- emergency vehicle, whether attended or unattended, in a fire lane (d) An unauthorized vehicle on a fire lane is (1) subject to removal by the operator of the premises, with the expense of removal and storage to be borne by the registered owner of the vehicle, (2) subject to citation, as well as removal, by the fire marshal or a police officer, and (3) prima facle evidence that the person in whose name the vehicle is registered is guilty of a violation of the parking provisions of Subsection (c) of this sectlon (e) For purposes of this section, an unauthorized vehicle is any vehicle other than an authorized emergency vehicle as defined in art 6701ds sec 2(d)s V T C S , as the same may be amended Sec 10-69 Maintenance (a) The Fire Marshal shall report any neglected surface condl- tlonss marking or signs to the owner or person in control o£ pro- perty upon which a fire lane exiStS and shall issue instructions for repair (b) It shall be unlawful for the owner or person in control of property upon which a fire lane has been designated or exists to fall to maintain the surface of said fire lane in good condi- tion, free of pot holes and other, non-approved obstructions (c) It shall be unlawful for the owner or person in control of property in which a fire lane has been designated or exists to PAGE 4 fall to maintain any marking of said fire lane as required by this code in a condition which is not clearly legible Sec 10-70 Fire lane site plan (a) When f~re lanes are required in accordance with the pro- visions of this Chapter, the owner, builder or developer shall submit a fire lane site plan (8 1/2" x 11") to the Fire Marshal prior to the issuance of a building permit A copy of each approved fire lane site plan shall be kept on file with the fire department (b) Construction of the building shall not begin until fire lane site plan has been submitted to and approved by the Fire Marshal Sec 10-71 Designation of fire lanes The Fire Marshal shall designate a fire lane when {1) A fire lane site plan which has been submitted is approved, or (2) The ingress or egress of an existing piece of property is not adequate for fire department apparatus Sec 10-72 Existing Fire Lanes Any fire lane that has been established prior to passage of this ordinance, and designated by the Fire Marshal, or that has been established by a separate ordinance shall be a fire lane for all intents and purposes and shall be maintained as required by this code SECTION III Any person who shall violate a provision of this ordinance, or fails to comply therewith or with any of the requirements thereof, or of a permit or certificate issued thereunder, shall be guilty of a misdemeanor punishable by a fine not exceeding Two Thousand Dollars ($2,000 00) Each such person shall be deemed guilty of a separate offense for each and every day or portion thereof during which any violation of this ordinance is committed, or continued, and upon conviction of any such violations such person shall be punished within the limits above SECTION IV That this ordinance shall become effective fourteen (14) days from the date of its passage, and the City Secretary is hereby directed follows 1 Building Fire Safety Follow-Up (Re inspection) Inspection Fees provided in Section 106 Interior Sauare Footage Fee 1 to 3,000 $15 00 3,001 to 6,000 $25 00 6,001 to 12,000 $35 00 12,001 to 18,000 $45 00 18,001 to 24,000 $55 00 24,001 to 100,000 $65 00 over 100,000 $100 00 If a second follow-up (re-inspection) is required because the violation has not been corrected, the following fees shall be charged Page 18 1 to 3,000 $30 00 3,001 to 6,000 $50 00 6,001 to 12,000 $70 00 12,001 to 18,000 $90 00 18,001 to 24,000 $110 00 24,001 to 100,000 $130 00 over 100,000 $200 00 2 The fee for an operational pcnmt reqmred under Section 105 of the F~re Code shall be $200 00 per permit 3 The fee for a construction penmt reqmred under Section 105 of the F~re Code shall be $100 00 4 The fee for a gas well permit and mspect~on for gas well development, ~nclud~ng but not hm~ted to dnlhng a gas well, above ground gas storage tanks, p~p~ng ~nspectmns, completmn of gas well, revenue of a gas well and abandonment of a gas well is $200 per penmt or $200 per ~nspect~on 5 Per Section 901 6 1 of the F~re Code, a fee of $25 00 shall be assessed for each annual ~nspect~on of automatic extmgmsh~ng systems (Hood Suppression Systems) automatic fire suppression systems, and automatm fire alarm systems 6 Per Sectmn 105 6 10 of the Fire Code, a fee for a temporary sales or d~splay booth ~n covered malls shall be $25 00 7 Per Section 105 7 12 of the F~re Code, a fee of $25 00 shall be assessed for a temporary tent penmt SECTION 3 That F~re Lane Ordmance No 87-168 ~s hereby repealed SECTION 4 Any person who wolates a prows~on of this orthnance shall be guilty of a m~sdemeanor pumshable by a fine not exceeding Two Thousand Dollars ($2,000 00) Each such person shall be deemed guilty of a separate offense for each and every day or portion thereof dunng whmh any wolat~on of th~s ordinance ~s committed, or continued, and upon convmt~on of any such molatlons such person shall be pumshed w~thln the hm~ts above SECTION 5 If any sectmn, subsection paragraph, sentence, phrase or word in th~s ordinance, or apphcat~on there of to any person or c~rcumstance is held ~nvahd by any court of competent jtmsdmt~on, such holding shall not affect the vahd~ty of the remmnmg portions of th~s ordinance, and C~ty Council of the C~ty of Denton, Texas hereby declares ~t would have enacted stlch remmmng portions despite any such ~nval~dlty SECTION 6 That the repeal of any ordinance or any portmn thereof by the preceding, sections shall not affect or ~mpmr any act done or right vested or accrued or any Page 19 proceeding, stat or prosecution had or commenced ~n any cause before such repeal shall take effect, but every such act done, or right vested or accrued, or proceedings, suit or prosecution had or commenced shall remain ~n full force and effect to all intents or purposes as if such ordinance or part thereof so repealed shall remain m force SECTION 7 That tins ordinance shall become effective fourteen (14) days from the date of this passage, and the C~ty Secretary is hereby directed to cause the caption of this ordinance to be published twice in the Denton Record
