1987-1661885L No AN ORDINANCE AMENDING ARTICLE I OF CHAPTER 9 OF THE CODE OF ORDI- NANCES OF THE CITY OF DENTON, TEXAS ("ELECTRICAL CODE") TO PROVIDE FOR ADOPTION OF THE 1987 NATIONAL ELECTRICAL CODE AND ADOPTION OF AMENDMENTS TO THE NATIONAL ELECTRICAL CODE, TO PROVIDE FOR ADDI- TIONS THERETO, REPEALING ALL ORDINANCES IN CONFLICT HEREWITH, PROVIDING FOR A PENALTY IN AN AMOUNT OF $2,000 00 THEREFOR, AND PROVIDING FOR AN EFFECTIVE DATE THE COUNCIL OF THE CITY OF DENTON HEREBY ORDAINS SECTION I That Section 9-1 of Article 1 of Chapter Nlne of the Code of Ordlnances of the Clty of Denton, Texas is hereby amended to read as follows Sec 9-1 Adopt~n~ National Electrical Code~ 1987 Edition, deletions and amendments The Natlonal Electrical Code, 1987 Edition, as recommended by the Natlonal F~re Protection Association, a copy of which shall be filed w~th the office of the city secretary and available for public inspection, ~s hereby adopted and designated as the electr~- cal code of the City of Denton, Texas, the same as though said edltlon of such code were copied at length herein, subject to the deletions and amendments enumerated hereafter (1) Section 300-22 Wiring ~n Ducts, Plenums~ and Other Air- Handling Spaces, paragraph (c), Other Space Used for Environmental Air, Exception No 5, is hereby amended to read as follows Exception No 5 This section does not ~nclude the ]o~st or stud spaces ~n dwelling units (2) Section 305-6 Ground Fault Protectlon for Personnel, paragraph (a) ls hereby amended to read as follows a Ground-fault Circuit-Interrupters All 125-volt, single-phase, 15- and 20-ampere receptacle outlets which are not a part of the permanent w~r~ng of the building or structure and which are in use by employees shall have ground-fault c~rcult-lnterrupter protection for personnel Providing ground-fault c~rcu~t-lnterrupter protection shall be the responsibility of the employee using the outlet and his employer w~thout regard to whether such persons are performing electrical work or are engaged in some other trade on the premises SECTION II That Section 9-6(c) of Article 1 of Chapter Nine of the Code of Ordinances of the City of Denton is hereby amended to read as follows (c) Effective January 1, 1988 aluminum w~re and copper-clad aluminum w~re smaller than No 2 gauge shall be prohibited Aluminum w~re and copper-clad aluminum w~re No 2 gauge and larger may be used only w~th approved connectors and terminals SECTION III All ordinances or parts of ordinances ~n force when the provisions of this ordinance become effective which are ~nconslstent or ~n conflict w~th the terms or provisions contained · n th~s ordinance are hereby repealed to the extent of any such conflict SECTION IV Any person who shall v~olate a provision of this ordlnance, or falls to comply therewith or with any of the requlre- ments thereof, or of a permlt or certificate issued thereunder, shall be guilty of a mlsdemeanor punlshable by a fine not exceeding Two Thousand Dollars ($2,000 00) Each such person shall be deemed guilty of a separate offense for each and every day or port~on thereof during whlch any v~olat~on of th~s ordinance is committed, or continued, and upon conviction of any such v~ola- t~ons such person shall be punished wlthln the l~m~ts above SECTION V That th~s ordlnance shall become effective thirty (30) days from the date of its passage, and the City Secretary ~s hereby d~rected to cause the captlon of th~s ordinance to be published twice in the Denton Record-Chronicle, the official newspaper of the City of Denton, Texas, within ten (10) days of the date of ~ts passage PASSED AND APPROVED th~s the ~4~day of ~, 1987 ATTEST APPROVED AS TO LEGAL FORM DEBRA ADAMI DRAYOVITCHt CITY ATTORNEY
