AN ORDINANCE ABANDONING AND VACATING CERTAIN OTILITY EASEMENTS AS
DESCRIBED HEREIN, AND DECLARING AN EFFECTIVE DATE
WHEREAS, the City Council of the City of Denton, Texas has
determined that the hereinafter described utility easement,
whether one or more, is no longer needed for public use, and
WHEREAS, in accordance with the prowslons of Texas Rewsed
C~v~l Statutes, Article 5421c-12, an appraisal of the fair market
value of said easement has been obtained, and
WHEREAS, in accordance with State law, said easement ~s being
abandoned and vacated in consideration of the receipt of the fair
market value thereof,
NOW, THEREFORE, THE COUNCIL OF THE CITY OF DENTON HEREBY ORDAINS
SECTION I That the hereinafter described easement is
abandoned and vacated as an easement for public utilities, the
easement being more particularly described as follows
Tract I Ail that certain lot, tract or parcel of land lying and
being situated in the City and County of Denton, State of Texas,
and being part of the J Collard Survey, Abstract No 297, and
also being part of a tract of land as conveyed from Southwest
Cinema to J C M~tchell and Lee Roy Mitchell by deed dated July
1, 1982 and recorded in Volume 1155, Page 885 of the Deed Records
of Denton County, Texas, and more particularly described as
follows
BEGINNING at the northwest corner of sa~d tract, sa~d point lying
in the south right-of-way line of U S Highway 77,
THENCE south 58°45' east, along the north boundary line of said
tract and the south right-of-way line of U S Highway ??, a
distance of ?05 5 feet to the northeast corner of said tract,
THENCE south 0°0?' west, along the east boundary l~ne of said
tract a distance of 55 05 feet to a point for a corner,
THENCE north 58°45' west, 30 feet south of and parallel to the
north boundary of sa~d tract a distance of ?10 31 feet to a point
for a corner in the west boundary line of said tract,
THENCE north ?°19' east, along the west boundary line of said
tract a distance of 32 82 feet to the place of beginning
S~CTION I That the hereinafter described easement is
abandoned and vacated as an easement for public utilIties, the
easement being more particularly described as follows
Tract II All that certain lot, tract or parcel of land lying and
being s~tuated in the City and County of Denton, State of Texas,
and being part of the J Collard Survey, Abstract No 297, and
also being part of a tract of land as conveyed from J F York to
J C M~tchell and Texas Clnema Corporation by deed recorded in
Volume 1S06, Page 6§3 of the Deed Records of Denton County, Texas,
and more particularly described as follows
BEGINNING at the northwest corner of sa~d tract, sa~d point lying
in the south right-of-way l~ne of U S H~ghway 77,
THENCE south S8°4S' east, along the north boundary l~ne of said
tract and the south r~ght-of-way l~ne of U S H~ghway 77, a
d~stance of 193 21 feet to the northeast corner of said tract,
THENCE south 7°17'21'' west along the east boundary l~ne of sa~d
tract, a d~stance of 32 8 feet to a point for a corner,
THENCE north S8°4S' west, 30 feet south of and parallel to the
north boundary of said tract, a d~stance of 196 82 feet to a point
for a corner ~n the west boundary line of sa~d tract,
THENCE north 13~17'37'' east, along the west boundary l~ne of sa~d
tract a d~stance of 31 S4 feet to the place of beginning
SECTION III That sa~d easement, whether one or more, is
herein abandone~ and vacated, and by operation of law, the Clty
of Denton's property ~nterest ~n said easement shall revert to
the abutting property owner, whether one or more, and the C~ty of
Denton hereby releases any and all claims to the use o£ the
property described ~n sa~d easement referenced here~n for the
purposes therein described
SECTION IV That th~s ordinance shall become effective
~mmediately upon ~ts passage and approval
