1987-1581957L AN ORDINANCE AMENDING THE ZONING MAP OF THE CITY OF DENTON, TEXAS, AS SAME WAS ADOPTED AS AN APPENDIX TO THE CODE OF ORDINANCES OF THE CITY OF DENTON~ TEXASt BY ORDINANCE NO 69-1, AS AMENDED, AND AS SAID MAP APPLIES TO APPROXIMATELY 15 71 ACRES OF LAND LOCATED AT THE SOUTHEAST CORNER OF HICKORY CREEK ROAD AND MONTECITO DRIVE, AS IS MORE PARTICULARLY DESCRIBED HEREIN, TO PROVIDE FOR A CHANGE IN ZONING CLASSIFICATION FROM AGRICULTURAL "A" DISTRICT CLASSI- FICATION AND USE DESIGNATION TO SINGLE-FAMILY "SF-7" DISTRICT CLASSIFICATION AND USE DESIGNATION, PROVIDING FOR A PENALTY IN A MAXIMUM AMOUNT OF 92,000 00 FOR VIOLATIONS THEREOF, AND PROVIDING FOR AN EFFECTIVE DATE WHEREAS, Sanders H Campbell and Rayburn Tucker have applied for a change in zoning from agricultural "A" to single-family "SF-7" d~str~ct classification for approximately 15 71 acres of land located at the southeast corner of Hickory Creek Road and Monteclto Dr~ve, and WHEREAS, on August 26, 1987, the Planning and Zoning Commis- sion held a public hearzng on the applzcat~on and recommended approval thereof, and, WHEREAS, on October 6, 1987, the City Council held a public hearing on the application, NOW, THEREFORE, THE COUNCIL OF THE CITY OF DENTON HEREBY ORDAINS SECTION I That the Zonzng Classzf~cat~on and Use designa- tion applicable to all or part of the property descrzbed ~n Exhibit "A", attached hereto and ~ncorporated here~n by reference, is hereby changed from Agricultural "A" D~str~ct class~flcat~on and Use to Szngle-Famzly "SF-7" D~str~ct classlf,cat~on and Use under the Comprehensive Zoning Ordinance of the C~ty of Denton, Texas SECTION II The Zonzng Map of the City of Denton, Texas, adopted the 14th day of January, 1969, as an Appendzx to the Code of Ordznances of the C~ty of Denton, Texas under Ordinance No 69-1, as amended, is hereby amended to show such change ~n Dzstr~ct classification and Use SECTION III That the Czty Council of the C~ty of Denton, Texas, hereby f~nds that such change ~s in accordance w~th a comprehenszve plan for the purpose of promoting the general welfare of the City of Denton, Texas, and wzth reasonable consideration, among other things for the character of the dzstrlct and for ~ts peculiar suztab~lzty for partzcular uses, and w~th a v~ew to conservzng the value of the buildings, pro- tectlng human l~ves, and encouraging the most appropriate uses of land for the maximum benefit to the City of Denton, Texas, and its citizens SECTION IV Any person who shall violate a provision of this ordinance, or 'fails to comply therewith or with any of the requirements thereof, or of a permit or certificate issued there- under, shall be guilty of a misdemeanor punishable by a f~ne not exceeding Two Thousand Dollars ($2,000 00) Each such person shall be deemed guilty of a separate offense for each and every day or portion thereof during which any violation of this ordi- nance ~s committed, or continued, and upon conviction of any such violations such persons shall De punished w~th~n the limits above SECTION V That this ordinance shall become effective fourteen (14) '~ays from the date of its passage, and the City Secretary is hereby directed to cause the caption of this ordinance to be published twice in the Denton Record-Chronicle, the official newspaper of the City of Denton, Texas, within ten (10) days of the date of its passage PASSED AND APPROVED th~s the ~_~day of O~ , 1987 ATTEST APPROVED AS TO LEGAL FORM DEBRA ADAMI DRAYOVITCHt CITY ATTORNEY Z-1867/Page 2 EXHIBIT "A" FIELD NOTES to all that certain tract of land s~tua~ed ~n the B M Ro~ers Survey Abstract Number 1101, Denton County, Texas and being a part of the 4 tracts described in the Deed conveying 50% ~nterest from Rayburn Tucker~ Trustee to Sanders Campbell recorded ~n Volume 673 Page 277 of the Deed Re- cords of Denton County, Texas, the subject tract be~n~ more partlclarly described as follows~ BEGINNING for the Northwest Corner of the tract be~ng described herein at an iron rod at the Northeast Corner of Hickory Creek Road Elementary Add~- tlon (now known as Ronald ~.
