1987-1571958L NO AN ORDINANCE AMENDING THE ZONING MAP OF THE CITY OF DENTON, TEXAS, AS SAME WAS ADOPTED AS AN APPENDIX TO THE CODE OF ORDINANCES OF THE CITY OF DENTON, TEXAS, BY ORDINANCE NO 69-1, AS AMENDED, AND AS SAID MAP APPLIES TO APPROXIMATELY 1 14 ACRES OF LAND LOCATED APPROXIMATELY 160 FEET EAST OF LOOP 288 AND EXTENDING NORTHWARD FOR APPROXIMATELY 700 FEET FROM AUDRA LANE, AS IS MORE PARTI- CULARLY DESCRIBED HEREIN, TO PROVIDE FOR A CHANGE IN ZONING CLASSIFICATION FROM AGRICULTURAL "A" DISTRICT CLASSIFICATION AND USE DESIGNATION TO GENERAL RETAIL "GR" DISTRICT CLASSIFICATION AND USE DESIGNATION, PROVIDING FOR A PENALTY IN A MAXIMUM AMOUNT OF ~2,000 00 FOR VIOLATIONS THEREOF, AND PROVIDING FOR AN EFFECTIVE DATE WHEREAS, Junction 288 Partners have applied for a change in zoning from agricultural "A" to general-retail "GR" dlstrzct classzf~catlon for approximately 1 14 acres of land located approximately 160 feet east of Loop 288 and extending northward for approxzmately 700 feet from Audra Lane, and WHEREAS, on August 12, 1987, the Planning and Zoning Commis- sion held a public hearzng on the applzcatzon and recommended approval thereof, and, WHEREAS, on October 6, 1987, the City council held a public hearing on the application, NOW, THEREFORE, THE COUNCIL OF THE CITY OF DENTON HEREBY ORDAINS SECTION I That the Zonzng classlfzcatzon and Use designa- tion applicable to all or part of the property described zn Exhibit "A" attached hereto and incorporated here~n by , District reference, is hereby changed from Agricultural classlfzcat~on and Use to General Retail "GR" D~strlct classz- f~cat~on and Use under the Comprehensive Zonzng Ordznance of the City of Denton, Texas SECTION II The Zoning Map of the Czty of Denton, Texas, adopted the 14th day of January, 1969, as an Appendzx to the Code of Ordinances of the C~ty of Denton, Texas under Ordinance No 69-1, as amended, zs hereby amended to show such change Dzstrlct classzfzcatlon and Use SECTION III That the City counczl of the City of Denton, Texas, hereby ~lnds that such change is in accordance wzth a comprehensive plan for the purpose of promoting the general welfare of the C~ty of Denton, Texas, and with reasonable consideration, among other th~ngs for the character of the district and for zts peculiar suztablllty for particular uses, and with a view to conserving the value of the buildings, pro- tectlng human lives, and encouraging the most appropriate uses of land for the maximum benefit to the City of Denton, Texas, and its cltlzens SECTION IV Any person who shall violate a provision of this ordinance, or fails to comply therewith or with any of the requirements thereof, or of a permit or certificate issued there- under, shall be guilty of a misdemeanor punishable by a fine not exceeding Two Thousand Dollars ($2,000 00) Each such person shall be deemed guilty of a separate offense for each and every day or portion thereof during which any violation of this ordi- nance is commltted, or continued, and upon conviction of any such violations such persons shall be punished within the l~m~ts above SECTION V That this ordinance shall become effective fourteen (14) days from the date of its passage, and the City Secretary is hereby directed to cause the caption of this ordinance to be published twice in the Denton Record-Chronicle, the official newspaper of the City of Denton, Texas, within ten (10) days of the date of ~ts passage PASSED AND APPROVED this the _~/day of ~ , 1987 ATTEST ~IP~ WA~T~RS, CiTY-~ECRETARX APPROVED AS TO LEGAL FORM DEBRA ADAMI DRAYOVITCH~ CITY ATTORNEY Z-1862/Page 2 METROI:IL.
