AN ORDINANCE AMENDING THE ZONING MAP OF THE CITY OF DENTON, TEXAS,
AS SAME WAS ADOPTED AS AN APPENDIX TO THE CODE OF ORDINANCES OF
THE CITY OF DENTON, TEXAS, BY ORDINANCE NO 69-1, AS AMENDED, AND
AS SAID MAP APPLIES TO APPROXIMATELY 1 142 ACRES OF LAND EXTENDING
ALONG THE EASTERN FRONTAGE OF LOOP 288 FROM U S HIGHWAY 380,
SOUTH FOR A DISTANCE OF APPROXIMATELY 1,300 FEET, AS IS MORE
PARTICULARLY DESCRIBED HEREIN, TO PROVIDE FOR A CHANGE IN ZONING
CLASSIFICATION FROM COMMERCIAL "C" DISTRICT CLASSIFICATION AND
USE DESIGNATION TO AGRICULTURAL "A" DISTRICT CLASSIFICATION AND
USE DESIGNATION, PROVIDING FOR A PENALTY IN A MAXIMUM AMOUNT OF
$2,000 00 FOR VIOLATIONS THEREOF, AND PROVIDING FOR AN EFFECTIVE
DATE
WHEREAS, Junction 288 Partners have applied for a change
zoning from Commercial "C" to Agricultural "A" district classl-
flcatlon for approximately 1 142 acres of land extending along
the eastern frontage of Loop 288 from U S H~ghway 380, south
for a distance of approximately 1,300 feet, and
WHEREAS, on August 12, 1987, the Planning and Zoning Commis-
sion held a public hearing on the application and recommended
approval thereof, and,
WHEREAS, on October 6, 1987, the City Council held a public
hearing on the appllcat~on, NOW, THEREFORE,
THE COUNCIL OF THE CITY OF DENTON HEREBY ORDAINS
SECTION I That the Zoning Classification and Use designa-
tion appl~ca61e to the property described ~n Exhibit "A",
attached hereto and incorporated here~n by reference, ~s hereby
changed from Commercial "C" Dlstrlct classification and Use to
Agricultural "A" D~str~ct Classification and Use under the
Comprehensive Zoning Ordlnance of the C~ty of Denton, Texas
SECTION II The Zoning Map of the C~ty of Denton, Texas,
adopted the 14th day of January, 1969, as an Appendix to the code
of Ordinances of the C~ty of Denton, Texas under Ordinance No
69-1, as amended, ~s hereby amended to show such change ~n
D~str~ct classification and Use
SECTION III That the C~ty Council of the C~ty of Denton,
Texas,' hereby ~nds that such change ~s ~n accordance w~th a
comprehensive plan for the purpose of promoting the general
welfare of the C~ty of Denton, Texas, and w~th reasonable
consideration, among other th~ngs for the character of the
d~str~ct and for ~ts peculiar sultab~l~ty for particular uses,
and with a view to conserving the value of the buildings, pro-
tect~ng human lives, and encouraging the most appropriate uses of
land for the maximum benefit to the City of Denton, Texas, and
its citizens
SECTION IV Any person who shall violate a provision of th~s
ordinance, or falls to comply therewith or with any of the
requirements thereof, or of a permit or certificate issued there-
under, shall be guilty of a m~sdemeanor punishable by a fine not
exceeding Two Thousand Dollars ($2,000 00) Each such person
shall be deemed guilty of a separate offense for each and every
day or portion thereof during which any violatIon of th~s ordi-
nance · s committed, or continued, and upon conviction of any such
violations such persons shall be punished within the limits above
SECTION V That th~s ordinance shall become effective
fourteen (14) days from the date of its passage, and the City
Secretary is hereby directed to cause the caption of this
ordinance to be published twice ~n the Denton Record-Chronicle,
the official newspaper of the City of Denton, Texas, within ten
(10) days of the date of ~ts passage
