AN ORDINANCE ADOPTING AN APPLIANCE REBATE PROGRAM AND DECLARING AN
EFFECTIVE DATE
WHBRBAS, the City Council of the C~ty of Denton recognizes
that the generation and distribution of electric power ~s a public
purpose, for which ~ts conservation is duly recognized, and
WHERBAS, the City of Denton, by and through ~ts City Council
desires to reduce energy demand and consumption by the customers
of City of Denton Utilities, and
WHERBAS, the City Council f~nds that through the use o£ energy
efficient equipment by the utility customers of the City of Denton
such energy demand and consumption would be reduced and the
efficiency of the electric utility system would be enhanced, NOW,
THEREFORE,
THE COUNCIL OF THE CITY OF DENTON HEREBY ORDAINS
SECTION I That ~t is the desire of the C~ty Council to
establish a program to provide l~m~ted cash ~ncent~ves to Denton
Utility customers who purchase certain energy efficient equipment
that reduce energy demand and consumption
SECTION II That the Appliance Rebate Program, attached
hereto and made" a part hereof ~s hereby adopted to ~mplement the
object~ves described above for as long as funding ~s available for
such a program
SECTION III That the City Council hereby authorizes and
directs the City Manager to take such action as ~s necessary to
achieve such goal of reducing energy demand and consumption by
~mplementlng the Appliance Rebate Program
SECTION IV That th~s ordinance shall become effective
~mmed~ately upon its passage and ~_ffal ~

1987 APPLIANCE REBATE PROGRAM
METHODS USED IN DETERMINING EQUIPMENT
EFFICIENCY AND ELIGIBILITY
Program Summary
The City of Denton Utility Department xs offering cash payments
to customers who purchase and install certain high efficiency air
condxtloners or heat pumps in new or existing residential or
commercial facilities
The program's ob]ect~ve is to reduce energy demand and consump-
tion, thereby saving customers dollars on their utility bills and
achieve the goal of reducing the peak load of the C~ty of Denton's
electric generatxon
Program Guidelines
1 Ail lnstallatxons must be for accounts served by the City of
Denton Utility Department, and must meet all applicable
national, local, and manufacturers' codes and specifications
2 To qualify for a rebate, equipment must be new when ~nstalled
5 Ail equipment must be purchased No leased or lease/purchase
equipment w~ll qualify for a cash rebate
Installations must be made by participating contractors and/or
dealers
S No rebate wxll be paid on a part~al replacement of an air
conditioner The compressor, condenser and the evaporator
co~l must be replaced to qualify for a rebate
6 Payments for a residential central cooling system, which
includes apartments and mobile homes, will be limited to a
capacity based on a minimum of $00 condltxoned square feet per
ton
The conditioned area ~n square feet is required on each resi-
dential central system request for payment
? Payments shall be l~mlted to a maximum combined capacity of 60
tons (720,000 BTUH) per meter for all new or replaced installa-
tions The maximum unit size is 11 25 tons, but combinations
of units up to 60 tons are eligible
8 The rebate w~ll be paid to the purchaser of the qualifying
equipment upon verification of compliance wxth program
guidelines
9 Requests [or payment must be received by the Director o£
Electric Utilities within 60 days of installation
10 Equipment and installation are subject to inspection by the
City's Building Inspection Department before final approval
for payment is issued
11 The Appliance Rebate Program guidelines and payments are
subject to change without notice
12 The Appliance Rebate Program may be discontinued without prior
notice at any time by the City of Denton
I GENERAL PROCEDURES
A Application
To determine who qualifies for a rebate, an application for
rebate must be completed and sent to the Director of
Electric Utilities within 60 days of installation of the
equipment Participating dealers have rebate cards and
will complete these cards for the purchaser It is the
purchaser's responsibility to see that the dealer completes
the card and submits it to the Director of Electric
Utilities
B Inspections
Random "spot-checks" of equipment and installations will be
made by the City's Building Inspection Department The
Department will contact applicants and schedule appoint-
ments for site visits
C Payments to Participants
Cash payments will be made to the purchaser of the qualify-
lng equipment Participating retail equipment dealers will
receive a cash payment of $20 per unit for the sale of
window units, central air conditioning systems, or heat
pumps to o£fset their cost for properly filling out the
applications for purchasers Program participants are
responsible for submitting the correct information The
Utility Department will not issue any additional payment
unless the payment was incorrect due to a mistake in
processing by a City employee
1 The Twenty Dollar ($20 00) payments to dealers will be
made only if they supply the qualifying equipment to the
customer or builder who is paying for the installation
o£ the equipment Dealers and purchasers may be den~ed

payment for failure to follow program guidelines such
as failing to supply correct square footage for Energy
Efficiency Ratio (EER) figures, installing equipment
which is not new, replacing part of a split system, and
failure to fill out rebate cards properly
2 Payments will be made to customers who purchase and
install new qualifying equipment If a tenant pur-
chases and installs qualifying equipment, the payment
~s made to the tenant If the owner of rental pro-
perty purchases and installs qualifying equipment, the
payment is made to the owner If the purchaser of a
mobile or custom home selects and pays for a qualifying
unit, the purchaser will receive the rebate
II CENTRAL ELECTRIC AIR CONDITIONERS AND HEAT PUMPS
A A new condensing unit with an inside evaporator coil will
qualify, if matched as specified in the current issue of
the ARI Directory of Certified Air Conditioners and Air
Source Heat Pumps and the unit meets the minimum ratings
as specified in the 1987 Appliance Rebate Program If the
unit is not in the current ARI Directory, the manu-
facturers' latest data approved for publication will be
accepted
If the unit ~s not in the current ARI Directory or data
approved for publication, the average of the high and low
SEBR/EER coil only, not including blower coil, will be
accepted as listed in the current ARI Directory
B Computer simulations may be used if ratings are not listed
in the current ARI D~rectory, provided the following
criteria are met
1 Systems using mix-matched coils must meet ail estab-
lished program guidelines to qualify for a rebate
2 The computer simulations must be s~gned, certified, and
dated by a registered professional engineer and an
officer of the company making the submittal
3 The engineer who certifies a simulation must attest to
the accuracy of the input data, the validity of the
calculation procedure used, and that the results are in
accordance w~th D 0 E approved methodology
4 A complete set of the ~nput data and an ~ndlcatlon of
the source of the data must accompany the simulated
ratings

5 The simulated ratings must be based on the condensing
unit's tested combination as listed in the current ARI
Directory or latest data approved for publication and
~dentlfled by the correct model numbers of both the
condensing unit and coil as listed in the current ARI
6 Simulated ratings must not exceed 105% of the SEER
rating of the tested system used as a-~
An open file of computer s~mulatlons will be maintained
at the office of the Director of Electric Utilities
Supplying erroneous ratings or data can lead to dis-
qualification of those involved from further program
participation
C Program Capacity and Payment Formula
1 The maximum allowable BTU per hour capacity eligible
for a rebate is determined by dividing the square
footage of the conditioned area by 500 and multiplying
by 12,000
Example The Program capacity for a 1,500 square foot
house is

The City will pay a rebate on a unit that meets program
efficiency standards and is sized at 56,000 BTUH or
less
2 Actual payment w~ll be determined by d~vldlng the BTUH
of the installed unit (up to, and ~ncludlng the Program
Capacity) by 12,000 and multiplying by the ~ncentlve,
which is determined by the efficiency rating of the
unit

page 6 and are ~ncorporated here~n as if fully set
forth at length

D Thermal Storage Incentive Payments
Thermal storage incentive payments shall be made to
qualifying customers based on the following method
A design shall be submitted to the Director of Electric
Utilities for approval The thermal storage equipment
shall be checked for input electric demand (KW) and output
capacity (BTU) The system shall be limited for incentive
payment to a maximum of 12,000 BTU per S00 square feet of
the conditioned area of the facility to be served
Upon completion, the input/output of the thermal storage
units will be measured by the City of Denton The customer
may observe and verify all ~nformatlon and calculations
for the actual size of the facility Auxiliary equipment
used to circulate fluid or air handlers which would
operate under normal peak periods will not be included ~n
calculating the KW load for incentive payments

ORDINANCE NO 87-135 PROVIDING FOR CHANGES IN THE APPLIANCE REBATE
PROGP~%Mt AND DECLARING ANEFFECTIVE DATE
WHEREAS, the city Council of the city of Denton recognizes that
the generation and distribution of electric power is a public pur-
pose for which its conservation is duly recognized, and
WHEREAS, the city of Denton, by and through 1ts City Council
desires to reduce energy demand and consumption by the customers of
city of Denton utilities, and
WHEREAS, the city Council finds that through the use of energy
efficient equipment by the utility customers of the City of Denton
such energy demand and consumption would be reduced and the effi-
ciency of the electric utility system would be enhanced, and
WHEREAS, the city Council has prevlously adopted an Appliance
Rebate Program to facilitate use of energy efficient equipment by
the utility customers of the City of Denton and wishes to amend the
Program to reflect increased minimum efficlency standards as set by
the Department of Energy, NOW THEREFORE,
THE COUNCIL OF THE CITY OF DENTON HEREBY ORDAINS
~ That the Appliance Rebate Program established pur-
suant to ordinance No 87-135 is to be continued
~ That Ordinance No 87-135 is amended to replace
prior program guidelines with the revised guidelines which are
attached hereto as Exhibit A and made a part hereof
~ That the city Council authorizes and directs the
city Manager to take such action as ~s necessary to achieve the
goal of reducing energy demand and consumption by implementing the
revised program g~idelines as provided herein for the Appliance
Rebate Program
~ That this ordinance shall become effective on
October 1, i and apply to appliance installation commenced after
