AN ORDINANCE OF THE CITY OF DENTON, TEXAS, AMENDING THE PLANNED
DEVELOPMENT DISTRICT CREATED BY ORDINANCE 85-256, AS AMENDED, TO
PROVIDE FOR THE APPROVAL OF A DETAILED PLAN FOR A PORTION OF THE
DISTRICT, SAID PLAN CONSISTING OF 6 5 ACRES LOCATED NEAR THE
SOUTHEAST CORNER OF THE INTERSECTION OF FM 1830 AND HOBSON LANE,
PROVIDING FOR A PENALTY IN THE MAXIMUM AMOUNT OF $1000 00 FOR
VIOLATIONS THEREOF, AND PROVIDING FOR AN EFFECTIVE DATE
WHEREAS, Ordinance No 85-256 provided for the creation of a
planned development d~str~ct for 27 2 acres of land located at
the southeast corner of the ~ntersectlon of F M 1830 and Hobson
Lane, and,
WHEREAS, Ordinance No 86-197 provided for the approval of a
detatled plan for 18 5 acres of land w~thln the d~str~ct, and,
WHEREAS, Metroplex has requested approval of a detaxled plan
for an additional 6 5 acres of land wlthtn the d~str~ct for
single-family, zero lot line homes, and,
WHEREAS, on April 8, 1987, the Planning Zoning Commission
recommended that the request be approved, NOW, THEREFORE,
THE COUNCIL OF THE CITY OF DENTON HEREBY ORDAINS
SECTION I That Section II of Ordinance No 85-256, as
amended by Ordinance 86-197, ~s further amended to read as
follows
Section II
That, for the 18 543 acres of land described ~n "Exhibit
A", there ~s approved the detailed plan, labeled as
"Exhibit B", said exhibits being attached hereto and
tncorporated here~n by reference, so that hereafter the
land so described land shall be used, maintained, and
subject to the provisions of the detailed plan
SECTION II That Ordinance No 85-256, ~s amended by adding
a new Section III to read as follows
Section III
That for the 6 5 acres of land described in "Exh~btt C",
there ~s approved the detailed plan labeled as "Exhlbtt
D" sa~d exhibits being attached hereto and xncorporated
by reference, so that hereafter the land so described
shall be used, maintained, and subject to the provisions
of the detailed plan
SECTION III That a copy of this ordinance shall be attached
to Ordinance No 85-256 showing the amendments made
SECTION IV Any person who shall v~olate a provision of th~s
ordinance, or fa~ls to comply therewith or w~th any of the
requirements thereof, or of a permit or cert~£~cate ~ssued
thereunder, shall be guilty of a m~sdemeanor punishable by a f~ne
not exceeding One Thousand Dollars ($1,000 00) Each such person
shall be deemed guilty of a separate offense for each and every
day or portion thereof during which any v~olat~on of th~s ordi-
nance is comm,tted, or continued, and upon conviction of any such
v~olatlons such person shall be punished w~th~n the l~m~ts above
SECTION V That th~s ordinance shall become effective
fourteen (14) days from the date of ~ts passage, and the C~ty
Secretary ~s hereby d~rected to cause the caption of th~s
ordinance to be published twice ~n the Denton Record-Chronicle,
the official newspaper of the C~ty of Denton, Texas, w~th~n ten
(10) days of the date of ~ts passage ~ ~

The shaded area on the southern portion of the site plan Is a wooded arcs
with a variety of trees including various Oaks Elms and Cedar trees It
appears that the canopies of these trees extend 20 to 30 feet above grade
Removal of some vegetation to facd~tate construction of the streets and
proposed single family residences will be required, s~m~lar to most s~ngle
family residential developments in wooded areas As in most single family
residential developments, we would expect the treed lots to be at a premium
and that the prospective lot owners w~ll try to preserve as many trees as
possible We intend to remove only the trees required to faclhtatc our
construction
We are proposing to plant trees and prowde landscaping and other amenities
to enhance the natural beauty of the northern portion of the tract where
there are very few estabhshed trees
