1987-0731774L NO AN ORDINANCE DESIGNATING AND ESTABLISHING SCHOOL SAFETY SPEED ZONES ON PORTIONS OF EVERS PARKWAY AND GARDENVIEW STREET, REDUCING THE MAXIMUM PRIMA FACIE SPEED LIMIT FOR SUCH PORTIONS OF SAID STREETS FROM THIRTY {$0) TO TWENTY (g0) MILES PER HOUR DURING CERTAIN HOURS, PROVIDING A PENALTY OF A FINE NOT TO EXCEED TWO HUNDRED DOLLARS ($200 00), PROVIDING A SEVERABILITY CLAUSE, AND DECLARING AN EFFECTIVE DATE THE COUNCIL OF THE CITY OF DENTON HEREBY ORDAINS SECTION I Based upon an engineering and traffic investigation hereto- fore made as authorized by the provisions of Section 169, Article 670ld, V T C S , the prima facle speed limit of twenty (20) miles per hour for vehicles is hereby determined and declared to be prima facle reasonable and safe, and such speed limit is hereby fixed for vehicles traveling upon the following named streets and highways, or parts thereof during the hereinafter designated hours The location of said school zones and the hours during which said speed zones shall be in effect are as follows to-wit Location Extent Hours in Effect A Evers Beginning 225 feet south of 7 30 a m -9 00 a m Parkway its intersection w~th Garden- 3 00 p m -4 00 p m view Street and ending at its intersection with Robble "O" Street B Evers Beginning 100 feet east of 7 50 a m -9 00 a m Parkway ~ts intersection with Ashcroft 5 00 p m -4 00 p m Lane and ending at its inter- section with Evers Parkway C On Garden- Beginning with ~ts inter- 7 30 a m -9 00 a m View Street section with Evers Parkway 3 00 p m -4 00 p m for a d~stance of 100 feet west of its intersection with Gardenvlew Street SECTION II An individual adjudged guilty of exceeding this speed l~mlt, when signs are erected giving not~ce thereof, shall be guilty of a misdemeanor, and punished by a fine not to exceed Two Hundred Dollars ($200 00) SLCTION III That ~f any section, subsection, paragraph, sentence, clause, phrase or word In this ordinance, or application thereof to any person or c~rcumstance is held invalid by any court of competent jurisdiction, such holding shall not affect the validity of the remaining portions of this ordinance, and the City Council of the City of Denton, Texas, hereby declares ~t would have enacted such remaining port~ons despite any such invalidity SECTION IV That th~s ordinance shall become effective fourteen (14) days from the date of its passage, and the Cxty Secretary is hereby ordinance to be published directed to cause the captxon of thxs twice xn the Denton Record-Chronicle, the official newspaper of the C~ty of Denton, Texas, wxthxn ten (10) days of the date of ~ts passage e~/J~ ~ PASSED AND APPROVED this th day of , 1987 CITY OF DENTON, TEXAS ATTEST A~IFEP~ WALTERS :;~ ~ITY SECRETARY CITY OF DENTON, TEXAS APPROVED AS TO LEGAL FORM DLBRA ADAMI DRAYOVITCH, CITY ATTORNEY CITY OF DENTON, TEXAS PAGE TWO Il
