ADOPTED AS AN APPENDIX TO THE CODE OF ORDINANCES OF THE CITY OF DENTON, TEXAS BY ORDINANCE NO 69-1, AS AMENDED, AND AS SAID MAP APPLIES TO 690 8 ACRES OF LAND, AS IS MORE PARTICULARLY DESCRIBED HEREIN, TO PROVIDE FOR A CHANGE IN ZONING CLASSIFICATION FROM AGRICULTURAL "A" DISTRICT CLASS- IFICATION AND USE DESIGNATION, TO PLANNED DEVELOPMENT "PD" DISTRICT CLASSIFICATION AND USE DESIGNATION, PROVIDING FOR A PENALTY IN A MAXIMUM AMOUNT OF $1,000 00 FOR VIOLATIONS THEREOF, AND PROVIDING FOR AN EFFECTIVE DATE THE COUNCIL OF THE CITY OF DENTON HEREBY ORDAINS SECTION I That the zoning classification and use designation of the real property described in Exhibit "A", attached hereto and ~ncorporated herein by reference, is hereby changed from Agricultural "A" District Classification and Use designation to Planned Development "PD" District Classification and Use designation under the comprehensive zoning ordinance of the City o£ Denton, Texas SECTION II That the following conditions, limitations, and restrictions shall apply to the district 1 Detailed Plans Required Prior to the development of each tract of land a detailed plan meeting the requirements of Article 11 of Appendix B-Zoning of the Code of Ordinances shall be submitted for C~ty Council approval, after recommendation ~s made thereon by the Planning and Zoning Commission That each detailed plan hereafter approved for each parcel or tract of land shall be attached hereto and be incorporated herein by reference and each parcel shall be developed and used in substantial compliance with the provisIons of such approved detailed plan 2 Restrictions on Detailed Plans The detailed plans required herein for each tract of land proposed to be developed, shall be consistent with the standards and restrictions specified in the Concept Plan, attached hereto as Exhibit B, and incorpo- rated herein by reference 3 Transportation Improvement Plan That prior to the submission or approval o{ any detailed plan or the approval of any plat for any land within the district, a Transportation Improvement Plan providing for the construction and installation of all ma3or street and traf£1c improvements necessary to serve the entire district, at no cost to the City, shall be approved by the City Council, after recommendation by the Planning and Zoning Commission The proposed Plan shall, at a minimum, provide for the following (a) North-South Mayor Arterial Street A divided, six lane street, meeting City speciflcatio-s, shall be constructed from O S Highway 380, at the northern edge of the district, to Interstate Highway 55-E To provide for such street, a strip of land oi a minimum width of 120 foot, shall be dedicated to the public prior to the sub- mission or approval of any detailed plan or the approval of any plat for any parcel of land within the district Two lanes of the proposed six lane street shall be constructed prior to the issuance of building permits for any parcel of land within the district A schedule shall be provided stating when the remaining four lanes of the six lane north-south major arterial street will be constructed, in relation to the develop- ment of the district, or each phase thereof, and the manner in which completion of the entire street with six lanes will be guaranteed, either by performance bonds, monies escrowed, or similar method that would reasonably insure completion thereof (b) Repavln$ of Mllls~ Blagg, and Trinity Roads The re- paving of Mills and Blagg Roads from their respective Intersections with the proposed north-south ma3or arterial street to their respective intersections with Mayhlll Road, and the repaying of Trinity Road from its intersection with Mills Road to its intersection with McKlnney Street, shall be required The repaying shall be to a width of 24 feet and a depth of 2 inches, to be performed in accordance with City specifications The requirement of repavlng shall be subject to the limita- tions that the cost of repaying shall not exceed $50,000 for each road, as determined by bids obtained by the Z-1779/PAGE 2 City or estimates made by the City Engineer If the estimated total cost of repavtng exceeds $50,000, for any road, the City may choose to parttctpate tn the repaying cost for all or part of the required repavtng for that road, or If it chooses not to participate, it may designate what portton of the repaying of such road will be performed by the expenditure of $50,000 The repaying requirements of this paragraph shall be in addition to, and not inclusive of, on-stte pertmeter street paving and improvements required for the development of any tract of land as provtded for in Appendix A of the Code of Ordtnances The Plan shall specify the time when such repaying wtll be undertaken in relation to the development of the district, or each phase thereof, as well as the manner in which such repaying will be guaranteed, either by performance bond, montes escrowed or similar method (c) Mayhlll Road Improvements Road tmprovements on Mayhlll Road and traffic signalization equipment at the inter- section of Mayhlll Road and McKtnney Street and the intersection of Mayhlll Road and Interstate Highway 35E, shall be made to the extent sufftctent to provtde for traffic to be generated from the dtstrtct when fully developed, as determined by the City Engineer The Improvements proposed shall be limited to a maximum cost of $50,000 for road improvements on Mayhtll Road and $50,000 at each specified tntersectton, for the traffic signalization equipment The repavtng requirements of this paragraph shall be in addttxon to, and not tnclustve of, on-site perimeter street paving and ~mprovements required for the development of any tract of land as provided for in Appendix A of the Code of Ordinances The Plan shall lndtcate, in relation to the development of the district, or each phase thereof, when the pro- posed improvements and signalization will be performed and the manner in which completion of said improvements and signalization will be guaranteed, etther by perfor- mance bond, monies escrowed or other similar method that would insure completion thereof (d) Improvements to Major Intersecting Streets Road provements, including necessary turn lanes, addttlonal rights-of-way, and trafftc control stgnallzatlon, to the Z-1779/PAGE 5 extent determined necessary by the City Engineer to pro- vide for traffic to be generated from the district when fully developed, shall be provided for the following proposed or existing street intersections (1) U S Highway 380 and the proposed north-south ma]or arterial, (2) East McKlnney and the proposed north-south major arterial street, (3) U S Highway 380 and Loop 288, and (4) East McKlnney and Loop 288 The Plan shall indicate, in relation to the development of the district, or each phase thereof, when such improvements will be undertaken and the manner in which the specified improvements will be guaranteed, either by performance bond, monies escrowed, or other similar method that will reasonably insure completion of the improvements The Transportation Improvement Plan, when approved by the City Council, shall be attached hereto, and compliance therewith shall be binding upon each and every parcel of land within the district 4 Utility and Drainage Improvement Plan That prior to the submission or approval o£ any detailed plan or the approval of any plat for any land within the district, a Utlllty and Drainage Improvement Plan providing for the construction of all major utility and drainage improvements necessary to serve the entire dlstr~ct, at no cost to the City, shall be approved by the City Council, after recommendation by the Planning and Zoning Commission The proposed Utility and Drainage Improvement Plan shall, at a minimum, contain the following information (a) Water and Sewer Facilities The location and size of all major water and sanitary sewer mains and facil- ities that are proposed to be constructed to serve the entire district (b) Drainage Systems and Improvements A drainage study of the district performed by a licensed engineer giving the description and location of all major storm sewer improvements, drainage retention areas, or other existing or proposed drainage facilities or features that will be utilized or constructed to provide adequate drainage for the entire district when fully developed Z-1779/PAGE 4 (c) Scheduling of Improvements The time when such utility and drainage improvements will be undertaken in relation to the development of the d~stnct, or each phase thereof, shall be specified The Plan shall include the manner ~n which completion of the necessary utility and drainage improvements to serve the entire district will be guaranteed, either by performance bond, monies escrowed, or similar manner or method that would reasonably insure completion of the utility improvements The Utility and Drainage Improvement Plan, when approved by the City Council, shall be attached hereto and compliance there- with shall be binding upon each and every parcel or tract of land within the district S Park Fund Two Hundred and Fifty Thousand Dollars ($250,000 00) shall be paid to the City prior to the approval of any detailed plan for any parcel of land within the district, to provide for the acquisition, improvement or maintenance of park land or facilities to serve the district 6 Property Acquisitions All easements and rights-of-way for public improvements required to be constructed, or off-site drainage areas or facilities necessary, to serve the district shall be acquired without cost to the City If necessary ease- ments or rights-of-way for the required public improvements can- not be purchased at fair market value, a request for condemnation may be submitted, in writing, to the City The request shall be accompanied by (1) a description of the property to be acquired and the names of all owners having an interest therein, as shown by a commitment for title insurance issued by a title company, showing the City as the proposed insured, (2) at least two written appraisals of the property to be acquired, performed by persons with qualifications satisfactory to the City, copies of correspondence showing that an offer has been made to the owners of the property to purchase it at no less than the amount shown in one of the appraisals submitted, and (4) evi- dence that, after reasonable negotiations, the offer has been re3ected Upon satisfactory submission of the request for condemnation, in the form and manner proved for herein, the City, upon finding that condemnation is necessary, may institute condemnation of the property Prior to beginning condemnation, a contract shall be entered into between the person making the request and the Z-1779/PAGE 5 C~ty, providing for the payment of all acquisition cost by the person making the request, which shall include, but not be l~m~ted to, the amount awarded to the landowner for the taking of the property, fees of Special Commissions, £~l~ng fees and other court cost, title policy premxums, recording fees, attorney's fees, and any other cost ~ncurred in the acquisition of the property If the City chooses to h~re an attorney not employed by the City to acquire the property by condemnation, the contract shall provide that the contract cost shall be pa~d by the person making the condemnation request 7 Application of Article 11 That the dxstrxct shall hereafter be subject to the provisions of Article 11 of Appendix B-Zoning, to the extent that such prowslons do not conflict w~th the provisions of this ordinance SECTION III The Zoning Map of the City of Denton, Texas, adopted the 14th day of January, 1969, as an Appendix to the Code of 0rd~nances of the City of Denton, Texas under Ordinance No 69-1, as amended, is hereby amended to show such change in District Classification and Use subject to the above conditions and specifications SECTION IV That the City Council of the City of Denton, Texas, hereby f~nds that such change is in accordance with a comprehensive plan for the purpose of promoting the general welfare of the C~ty of Denton, Texas, and with reasonable consideration, among other things for the character of the d~str~ct and for ~ts peculiar suitability for particular uses, and with a view to conserving the value of the buildings, protecting human lives, and encouraging the most appropriate uses of land for the maxxmum benefit to the City of Denton, Texas, and its c~tlzens SECTION V Any person who shall violate a provision of this ordinance, or fails to comply therewith or w~th any of the requirements thereof, or of a permit or certificate ~ssued thereunder, shall be guilty of a misdemeanor punishable by a fine not exceeding One Thousand Dollars ($1,000 00) Each such person shall be deemed guilty of a separate offense for each and every day or portion thereof during which any wolat~on of th~s ordinance is Z-1779/PAGE 6 committed, or continued, and upon conviction of any such viola- tions such person shall be punished PROVIDING FOR A CHANGE FROM AGRICULTURAL "A" TO PLANNED DEVELOPMENT "PD" ZONING DISTRICT CLASSIFICATION AND USE DESIGNATION FOR 176 97 ACRES OF LAND, AS MORE PARTICULARLY DESCRIBED HEREIN, AND PROVIDING THAT SUCH LAND SHALL BE INCLUDED WITHIN AND BE A PART OF PD-126, PROVIDING FOR THE APPROVAL OF A NEW CONCEPT PLAN FOR THE 867 ACRES OF LAND INCLUDED WITHIN THE DISTRICT, AND PROVIDING FOR AN EFFECTIVE DATE WHEREAS, the concept plan district, and WHEREAS, by Ordinance No 87-008, the city Council approved a planned development district and concept plan for 690 8 acres of land, as described therein (Lakeview, PD-126), and WHEREAS, RMB, Inc has applied for a change from agricultural "A" to planned development zoning district classification and use designation for 176 97 acres of land, as more particularly described herein, said land to be included within and become a part of PD-126, and applicant is requesting the approval of a new for the entire 867 acres to be included in the WHEREAS, on July 27, 1988, the Planning and Zoning Commission recommended approval of the requested change in zoning and new concept plan for the expanded district, NOW, THEREFORE, THE COUNCIL OF THE CITY OF DENTON HEREBY ORDAINS ~ That Section II of ordinance No 87-008 (PD-126), providing for approval of a concept plan and imposing conditions applicable to the planned development district therein created, is repealed _ ~ That the zoning district classification and use designation of the 176 97 acres of real property described in Exhibit "A", attached hereto and incorporated herein by conditions shall be subject to the i Information for Detailed Plans Ail information that was not required to be shown on the concept plan, as otherwise required by article 11 of Appendix B - Zoning of the Code of Ordinances, shall be submitted with any detailed plan for any property within the district 2 ~ The permitted land uses for each detailed plan s~bmitted for any tract of land shall be as defined or shown in this ordinance and the approved concept plan The general site plan requirements for tracts designated for the light industrial, general retail, office, neighborhood service, and community facility uses (.nonresidential uses"), have been waived at the concept plan stage The uses provided for herein for nonresidential tracts shall be permitted in accordance with the detailed plans approved for those tracts, in accordance with article 11 of Appendix B - Zoning, as amended The detailed plans submitted for the nonresidential tracts shall be subject to the following conditions and restrictions (a) ~ Tracts designated for light industrial use shall be used for manufacturing, fabricating, and processing activities, research and development facilities, and
