AN ORDINANCE ABANDONING AND
UTILITY BASEMENT AS DESCRIBED
DATE
VACATING A CERTAIN DRAINAGE AND
HEREIN, AND DECLARING AN EFFECTIVE
WHEREAS, the City Council of the City of Denton, Texas has
determined that the hereinafter described drainage and utility
easement is no longer needed for public use, and
WHEREAS, in accordance wxth the prowslons of Texas Revised
Cxwl Statutes, Artxcle 5421c-12, an appratsal of the fair
market value of said easement has been obtained, and
WHEREAS, in accordance with state law, said easement is
being abandoned and vacated in consideration of the receipt of
their fair market value by the abutting property owner thereof,
NOW, THEREFORE, THE COUNCIL OF TttE CITY OF DENTON HEREBY ORDAINS
SECTION I
That the hereinafter described easement ~s abandoned and
vacated as an easement for drainage and public utilities
All that certain lot, tract or parcel of land lying and being
s~tuated ~n the City and County of Denton, State of Texas, and
being part of the Mary L Austin Survey, Abstract No 4, R H
Hopkins Survey, Abstract No 1674, and J S Taft Survey,
Abstract No 12S6, and being part of a tract of land as conveyed
from Henry H D~ckerson, Jr to American Savings Association by
deed dated July ?, 1972 and recorded in Volume 650, Page 554 of
the Deed Records of Denton County, Texas, as more particularly
described as follows
COMMENCING at the intersectIon of the southwest right-of-way
line of the Missouri-Kansas-Texas Railroad with the north
right-of-way l~ne of State Highway Loop 288, sa~d point also
being the most easterly corner of sa~d tract,
THENCE north 42°0S'00'' west along the southwest right-of-way
l~ne of M~ssour~-Kansas-Texas Railroad a distance of 643 32 feet
to the place of beginning,
THENCE south 63012'07" west a distance of 370 62 feet to a point
for a corner,
a distance of 20 feet to
THENCE north 26047'53'' west
a corner,
a point for
THENCE north 63°12'07'' east a distance of 365 1S feet to a point
for a corner,
THENCE south 42005'00'' east along the southwest right-of-way
line of the Missouri-Kansas-Texas Railroad a distance of 20 73
feet to the place of beginning and containing 7,357 66 square
feet of land, more or less
SECTION II
That said easement is herein abandoned and vacated, and by
operation of law, the City of Denton's property interest in said
easement shall revert to the abutting property owner, whether
one or more, and the City of Denton hereby releases any and all
claims to the use of the property described in said easement
referenced herein for the purposes therein described
SECTION III
That this ordinance shall become effective immediately upon
