AN ORDINANCE ABANDONING AND VACATING CERTAIN UTILITY EASEMENTS AS
DESCRIBED HEREIN, AND DECLARING AN EFFECTIVE DATE
WHEREAS, the City Council of the City of Denton, Texas has
determined that the hereinafter described utility easements are
no longer needed for public use, and
WHEREAS, in accordance with the provisions of Texas Revised
Civil Statutes, Article 5421c-12, an appraisal of the fair market
value of said easements has been obtained, and
WHEREAS, in accordance with state law, said easements are
being abandoned and vacated in consideration of the receipt of
their fair market value by the abutting property owner thereof,
NOW, THEREFORE,
THE COUNCIL OF THE CITY OF DENTON HEREBY ORDAINS
SECTION I
That the hereinafter described easements are abandoned and
vacated as easements for public utilities
A Easement and right-of-way as described in that certain
deed from W J Pilgrim and wife Rosie Pilgrim to Brazos Electric
Power Cooperative, Inc , filed October 24, 1949, and recorded in
Volume 354, Page 392 of the Deed Records of Denton County, Texas,
and being that same easement assigned by Brazos Electric Power
Cooperative, Inc to the City of Denton, Texas, by instrument
dated October 6, 1980, recorded in Volume 1106, Page 78, of the
Deed Records of Denton County, Texas
B Easement and right-of-way as described in that certain
deed from Bert R Moore to Brazos Electric Power Cooperative,
Inc , filed March 30, 1978, and recorded in Volume 882, Page 143
of the Deed Records of Denton County, Texas, and being that same
easement assigned by Brazos Electric Power Cooperative, Inc to
the City of Denton, Texas, by instrument dated October 6, 1980,
recorded in Volume 1106, Page 78, of the Deed Records of Denton
County, Texas
C Easement and right-of-way as described in that certain
deed from Jessie L Long to Brazos Electric Power Cooperative,
Inc , filed November 22, 1949, and recorded in Volume 357, Page
59 of the Deed Records of Denton County, Texas, and being that
same easement assigned by Brazos Electric Power Cooperative, Inc
to the City of Denton, Texas, by instrument dated October 6,
1980, recorded in Volume 1106, Page 78, of the Deed Records of
Denton County, Texas
D Easement and right-of-way as described in that certain
deed from S A Thompson and wife, Annie D Thompson to Brazos
Electric Power Cooperative, Inc , filed November 21, 1949, and
recorded in Volume 354, Page 398 of the Deed Records of Denton
County, Texas, and being that same easement assigned by Brazos
Electric Power Cooperative, Inc to the City of Denton, Texas, by
instrument dated October 6, 1980, recorded in Volume 1106, Page
78, of the Deed Records of Denton County, Texas
E Easement and right-of-way as described in that certain
deed from Luther Hoke and wife, Ethel Hoke to Brazos Electric
Power Cooperative, Inc , filed December 22, 1949, and recorded in
Volume 357, Page 57 of the Deed Records of Denton County, Texas,
and being that same easement assigned by Brazos Electric Power
Cooperative, Inc to the City of Denton, Texas, by instrument
dated October 6, 1980, recorded in Volume 1106, Page 78, of the
Deed Records of Denton County, Texas
F Easement and right-of-way as described in that certain
deed from Nettie Shultz to Brazos Electric Power Cooperative,
Inc , filed November 5, 1949, and recorded in Volume 357, Page 98
of the Deed Records of Denton County, Texas, and being that same
easement assigned by Brazos Electric Power Cooperative, Inc to
the City of Denton, Texas, by instrument dated October 6, 1980,
recorded in Volume 1106, Page 78, of the Deed Records of Denton
County, Texas
G Easement and right-of-way as described in that certain
deed from J T Ables and wife, Flossie Ables to Brazos Electric
Power Cooperative, Inc , filed June 21, 1948, and recorded in
Volume 344, Page 409 of the Deed Records of Denton County, Texas,
and being that same easement assigned by Brazos Electric Power
Cooperative, Inc to the City of Denton, Texas, by instrument
dated October 6, 1980, recorded in Volume 1106, Page 78, of the
Deed Records of Denton County, Texas
H Easement and right-of-way as described in that certain
deed from Louise Bryant to Brazos Electric Power Cooperative,
Inc , filed May 7, 1946, said easement was not recorded in the
Deed Records of Denton County, Texas, and being that same ease-
ment assigned by Brazos Electric Power Cooperative, Inc to the
City of Denton, Texas, by instrument dated October 6, 1980,
recorded in Volume 1106, Page 78, of the Deed Records of Denton
County, Texas
SECTION II
That said easements are herein abandoned and vacated, and by
operation of law, the City of Denton's property interest in said
easements shall revert to the abutting property owner, whether
one or more, and the City of Denton hereby releases any and all
claims to the use of the property described in said easements
referenced herein for the purposes therein described
SECTION III
That this ordinance shall become effective immediately upon
its passage and approval P
