1986-0321332L NO 9&iz~ AN ORDINANCE OF THE CITY OF DENTON, TEXAS, ABANDONING AND VACATING A CERTAIN UTILITY EASEMENT AS DESCRIBED HEREIN, AND DECLARING AN EFFECTIVE DATE WHEREAS, the City Council of the City of Denton, Texas, has determined that the hereinafter described utility easement is no longer needed for public use, and WHEREAS, in accordance with the provisions of Texas Revised Civil Statutes, Article 5421c-12, an appraisal of the fair market value of said easement has been obtained, and WHEREAS, in accordance with state law, said easement is being abandoned and vacated in consideration of the receipt of its fair market value by the abutting property owner thereof, NOW, THEREFORE, THE COUNCIL OF THE CITY OF DENTON HEREBY ORDAINS SECTION I That the hereinafter described easement is abandoned and vacated as an easement for public utilities Being part of Lot 2, Block R of the "Replat of Blocks J, R and Q of Section 4 Avondale Addition", an addition to the City of Denton, Denton County, Texas, according to the plat recorded in Volume 12, Page 48, Plat Records, Denton County, Texas, and being more particularly described as follows BEGINNING at a point on the east line of said Lot 2, Block R, said point bears south 0°05'20" east a distance of 17 54 feet from the northeast corner of said Lot 2, Block R, THENCE north 65°51'40" west a distance of 56 62 feet to a point for corner, THENCE north 78°51'20" east a distance of 6 92 feet to a point for corner, THENCE south 65°51'40" east a distance of 49 17 feet to a point for corner, THENCE south 0°05'20" east a distance of 4 38 feet to the place of beginning and containing 211 square feet of land SECTION II That said easement is herein abandoned and vacated, and by operation of law, the City of Denton's property interest in said easement shall revert to the abutting property owner, whether one or more, and the City of Denton hereby releases any and all claims to the use of the property described in said easement referenced herein for the purposes therein described SECTION III That this Ordinance shall become effective immediately upon its passage and approval PASSED AND APPROVED this the ~ day of , 1986 \.e"'z ~ i C STEW , M CIT OF ll TON, TEXAS ATTEST CHARLOTTE ALLEN, CITY SECRETARY CITY OF DENTON, TEXAS APPROVED AS TO LEGAL FORM DEBRA ADAMI DRAYOVITCH, CITY ATTORNEY CITY OF DENTON, TEXAS BY 0 EXCALIBUR VENTURE, INC /PAGE 2 1 63 -QUITCLAIM DEED T{XAO STANDARD FORM T4P o#M#P of Texas, ;
