1985-2261176L NO AN ORDINANCE AMENDING SECTION 9-1, ARTICLE I, CHAPTER NINE OF THE CODE OF ORDINANCES OF THE CITY OF DENTON, TEXAS, RELATING TO THE 1981 EDITION OF THE NATIONAL ELECTRICAL CODE AND REENACTING SAID SECTION ADOPTING THE 1984 EDITION OF THE NATIONAL ELECTRICAL CODE WITH CERTAIN DELETIONS AND AMENDMENTS THERETO, AMENDING SECTION 9-6 OF THE DENTON CITY CODE BY ADDING A NEW PARAGRAPH (d) RELATING TO INSTALLATION OF SERVICE LATERAL CONDUCTORS, REPEALING SECTION 9-30, PARAGRAPH (1) RELATING TO APPLICATIONS FOR JOURNEYMAN'S LICENSE SUBMITTED PRIOR TO JANUARY 1, 1973, AMENDING AND REENACTING SECTION 9-30 1 RELATING TO RECIPROCAL LICENSING AND PROVIDING FEES THEREFOR, ADDING A NEW SECTION 9-34 REQUIRING A CONTRACTOR'S LICENSE AND ESTABLISHING A FEE THERE- FOR, ADDING A NEW SECTION 9-36 REQUIRING BUSINESS VEHICLES OF ELECTRICAL CONTRACTORS TO BEAR IDENTIFICATION NUMBERS AND LETTERS, AMENDING AND REENACTING SECTION 9-46 TO REQUIRE A CON- TRACTOR'S LICENSE BEFORE WORK PERMITS ARE ISSUED, PROVIDING FOR THE REPEAL OF CONFLICTING ORDINANCES AND MAKING THIS ORDINANCE CUMULATIVE OF PRIOR ORDINANCES OR PARTS THhREOF NOT IN CONFLICT HEREWITH, PROVIDING A SEVERABILITY CLAUSE, PROVIDING FOR PENALTIES FOR VIOLATION HEREOF, AND DECLARING AN EFFECTIVE DATE THE COUNCIL OF THE CITY OF DENTON HEREBY ORDAINS SECTION I That Section 9-1 of Article I, Chapter 9 of the Code of Ordinances of the City of Denton, Texas, relating to the National Electrical Code, 1981 Edition, is hereby amended and reenacted to hereafter read as follows Section 9-1 ADOPTING NATIONAL ELECTRICAL CODE, 1984 EDITION, DELETIONS AND AMENDMENTS The National Electrical Code, 1984 Edition, as recommended by the National Fire Protection Association, a copy of which shall be filed with the Office of the City Secretary and be available for public inspection, is hereby adopted and designated as the Electrical Code of the City of Denton, Texas, the same as though said Edition of such code were copied at length herein, subject to the deletions and amendments enumerated hereafter Section 300-22 (Wiring in Ducts, Plenums, and Other Air- Handling Spaces), Paragraph (c) (Other Space Used for Environmental Air), Exception No 5 is hereby deleted and amended to read as follows "Exception No 5 This section does not include the joist or stud spaces in dwelling units " Section 305-4 (Ground-Fault Protection for Personnel), Paragraph (a) is hereby deleted and amended to read as tollows "(a) Ground-Fault Circuit-Interrupters All 125- volt, single-phase, 15 and 20-ampere receptacle outlets which are not a part of the permanent wiring of the building or structure and which are in use by employees shall have ground-fault PAGE 1 circuit-interrupter protection for personnel Providing ground-fault circuit-interrupter protection shall be the responsibility of the employee using the outlet and his employer without regard to whether such persons are performing electrical work or are engaged in some other trade on the premises SECTION II That section 9-6 of Article I, Chapter 9 of the code of ordinances of the City of Denton, Texas, is hereby amended by adding a new paragraph (d) to read as follows "(d) Service lateral conductors shall not be installed in conduits smaller than two inches when serving permanent one and two family dwellings and multi-family dwellings " SECTION III That Section 9-30, Paragraph (i) of Article III, Chapter 9 of the Code of Ordinances of the City of Denton, Texas, relating to applications for a journeyman's license submitted prior to January 1, 1973, is hereby repealed SECTION IV That section 9-30 1 of Article III, Chapter 9 of the Code of Ordinances of the City of Denton, Texas, relating to reciprocal licensing, is hereby amended and reenacted to read as follows "Section 9-30 1 Recognition of licenses or certificates of registration from other cities An electrician holding a currently valid license or certificate of registration in another city may apply for and receive a similar license or certificate of registration in the City of Denton without taking an examination, provided the following conditions are met 1 The applicant shall submit evidence satisfactory to a majority of the electrical code board that he has been the holder of a similar license in a city from which he is reciprocating for a period of at least twelve (12) months and that his license or certificate of registration was issued under conditions not less restrictive than required by the Denton Electrical Code for issuance of an electrical license, and that an electrician who has made a passing grade on the City of Denton electrical examination and who is the holder of a valid City of Denton electrical license would be permitted to apply for and receive a similar license or certificate of registration in such other city under reciprocal conditions 2 The applicant shall pay, in advance, the same fees required of those taking examinations for a particular license set forth in Section 9-31 of this Chapter and comply with all other requirements of the Denton Electrical Code An electrician licensed in the City of Denton seeking a license in another city with which the City of Denton has reciprocity, shall pay a fee of ten dollars PAGE 2 ($10 00) for the issuance of a reciprocal letter to such other city SECTION V That Article III of Chapter 9 of the Code of Ordinances of the City of Denton, Texas, is hereby amended by adding a new Section 9-34, heretofore reserved, to read as follows Section 9-34 Contractor's license In addition to the requirements contained in Section 9-35 of this chapter, any partnership, association, firm, company, corporation or individual desiring to engage in the business of installing, repairing, changing or altering any electrical wiring or apparatus shall first obtain a contractor's license from the building official of the City of Denton A contractor's license fee of eighty dollars ($80 00) shall be paid at the time of issuance of such license Contractor's licenses expire on December 31 of each year, and a renewal fee of eighty dollars ($80 00) must be paid before the contractor can obtain additional permits A contractor's license shall not be issued to anyone who is not the holder of a valid City of Denton master electrician's license unless he has in his employ a properly licensed master electrician A contractor's license shall become invalid when there is no longer a master electrician employed by the partnership, association, firm, company, corporation, or individual SECTION VI That Article III of Chapter 9 of the Code of Orainances of the City of Denton, Texas, is hereby amended by adding a new Section 9-36, heretofore reserved, to read as follows "Section 9-36 Vehicle Identification All electrical contractors' business vehicles shall be identified by 2 1/2 inch letters and numbers prominently displayed on both sides of vehicles Numbers and letters shall be assigned by the city building inspection division " SECTION VII That Section 9-46 of Article IV, Chapter 9 of the Code of Ordinances of the City of Denton, Texas, is hereby amended and reenacted to read as follows Section 9-46 Permit Required it shall be unlawful for any person to install, change, alter or repair any electric wiring or apparatus in the city (except the routine replacement of fuses and lamps ano the alleviation of short circuits) unless such person has obtained a permit in writing from the chief building official to perform such work Electrical permits shall be issued only to holders of a valid City of Denton electrical contractor's license SECTION VIII That this ordnance shall repeal every prior ordinance and provision of the Code of Ordinances of the City of Denton in PAGE 3 conflict herewith and, as to all other ordinances or provisions of said Code not in direct conflict herewith, this ordinance shall be and is hereby made cumulative SECTION IX That if any section, subsection, paragraph, sentence, clause, phrase or word in this ordinance, or application thereof to any person or circumstance is held invalid by any court of competent jurisdiction, such holding shall not affect the validity of the remaining portions of this ordinance, and the City Council of the City of Denton, Texas, hereby declares it would have enacted such remaining portions despite any such invalidity SECTION Any person who shall violate a provision of this ordinance, or fails to comply therewith or with any of the requirements thereof, or of a permit or certificate issued thereunder, shall be guilty of a misdemeanor punishable by a fine not exceeding Two Hundred Dollars ($200 00) Each such person shall be deemed guilty of a separate offense for each and every day or portion thereof during which any violation of this ordinance is committed, or continued, and upon conviction of any such violations such person shall be punished within the limits above SECTION XI That this ordinance shall become effective fourteen (14) days from the date of its passage, and the City Secretary is hereby directed to cause the caption of this ordinance to be published twice in the Denton Record-Chronicle, the official newspaper of the City of Denton, Texas, within ten (10) days of the date of passage hereof ~y~.~ PASSED AND
