AN ORDINANCE AMENDING THE ZONING MAP OF THE CITY OF DENTON, TEXAS, AS
SAME WAS ADOPTED AS AN APPENDIX TO THE CODE OF ORDINANCES OF THE CITY
OF DENTON, TEXAS, BY ORDINANCE NO 69-1, AND AS SAID MAP APPLIES TO
APPROXIMATELY 20 297 ACRES OF LAND SITUATED IN THE M E P & P R R
COMPANY SURVEY, ABSTRACT NO 927, DENTON COUNTY, TEXAS AND LOCATED AT
THE NORTHEAST CORNER OF LOOP 288 AND SPENCER ROAD, TO PROVIDE FOR A
CHANGE IN ZONING CLASSIFICATION AND USE DESIGNATION FROM AGRICULTURAL
"A" DISTRICT CLASSIFICATION AND USE TO COMMERCIAL "C" CLASSIFICATION
AND USE FOR SAID PROPERTY, PROVIDING FOR A MAXIMUM PENALTY OF $1,000
FOR VIOLATIONS THEREOF, PROVIDING FOR A SEVERABILITY CLAUSE, AND
DECLARING AN EFFECTIVE DATE
THE COUNCIL OF THE CITY OF DENTON, TEXAS HEREBY ORDAINS
SECTION I
That the Zoning Classification and Use designation applicable to
all or part of the property described below is hereby changed from
Agricultural "A" District Classification and Use to Commercial "C"
District Classification and Use under the Comprehensive Zoning
Ordinance of the City of Denton, Texas
Being all that certain lot, tract or parcel of land situated in the
M E P & P.R R Company Survey, Abstract Number 927, in the City and
County of Denton, Texas, being a part of that certain tract of land
conveyed by deed from Golden Triangle Properties, Inc , to Bob A
Lohrke, and wife, Margaret Lohrke, dated October 8, 1963 and recorded
in the Deed Records of Denton County, Texas, and being more
particularly described as follows
BEGINNING at an iron rod found for corner in a fence line, being the
east line of Loop Road` 288, a public roadway, being also in the west
line of said M E P & P R R Survey, the southwest corner of said
Survey bears south 02000' west, 1073 feet, said point being also the
most northerly southwest corner of that certain (called) 47 836 acre
tract of land conveyed by deed from Bob A Lohrke, and wife, Margaret
Lohrke, to Sherwin Broatman, Trustee, dated July 27, 1971, and
recorded in the Deed Records of Denton County, Texas,
THENCE north 89001127" east, 768.20 feet to an iron rod found for
corner in a fence line,
THENCE south 02000100" west, 1073 14 feet with a fence line to an iron
rod found for corner dt a fence intersection in the north line of
spencer Road, a public roadway,
THENCE south 89056120" west, 823 61 feet with said north line of said
road and with a fence line to an iron rod found for corner at a fence
corner,
THENCE north 00046126" east, 480 61 feet with a fence line to a fence
post found for corner at a fence intersection,
THENCE north 80042117" west, 79 55 feet with a fence line to a fence
post for corner in the east line of Loop Road 288, a public roadway,
THENCE with a fence line, along the arc of a curve to the left having
a central angle of 12022120", a radius of 2739 41 feet, an arc length
of 591 54 feet, whose chord beards north 16013140" east, 590 39 feet
with said east line of said roadway to the place of beginning and
containing 20 297 acres of land

SECTION II
The Zoning Map of the City of Denton, Texas, adopted the 14th day
of January, 1969, as an Appendix to the Code of Ordinances of the City
of Denton. Texas under Ordinance No 69-1, be, and the same is hereby
amended to show such change in District Classification and Use
SECTION III
That the City Council of the City of Denton, Texas, hereby finds
that such change is in accordance with a comprehensive plan for the
purpose of promoting the general welfare of the City of Denton, Texas,
and with reasonable consideration, among other things for the char-
acter of the district and for its peculiar suitability or particular
uses, and with a view to conserving the value of the buildings, pro-
tecting human lives, and encouraging the most appropriate uses of land
for the maximum benefit to the City of Denton, Texas, and its citizens
SECTION IV
Any person who shall violate a provision of this ordinance, or
fails to comply therewith or with any of the requirements thereof, or
of a permit or certificate issued thereunder, shall be guilty of a
misdemeanor punishable by a fine not exceeding One Thousand Dollars
($1,000.00) Each such person shall be deemed guilty of a separate
offense for each and every day or portion thereof during which any
violation of this ordinance is committed, or continued, and upon
conviction of any such violations such person shall be punished within
the limits above
SECTION V
That if any section, subsection, paragraph, sentence, clause,
phrase or word in this ordinance, or application thereof to any person
or circumstance is held invalid by any court of competent jurisdiction,
such holding shall not affect the validity of the remaining portions
of this ordinance, and the City Council of the City of Denton, Texas,
hereby declares it would have enacted such remaining portions despite
any such invalidity
SECTION VI
That this ordinance shall become effective fourteen (14) days from
the date of its passage, and the City Secretary is hereby directed to
cause the caption of this ordinance to be published twice in the
Denton Record-Chronicle, the official newspaper of the City of Denton,
Texas, within ten (10) days of the date of its passage
