1985-1471161L NO AN ORDINANCE AMENDING THE ZONING MAP OF THE CITY OF DENTON, TEXAS, AS SAME WAS ADOPTED AS AN APPENDIX TO THE CODE OF ORDINANCES OF THE CITY OF DENTON, TEXAS, BY ORDINANCE NO 69-10 AND AS SAID MAP APPLIES TO APPROXIMATELY 23 09 ACRES OF LAND SITUATED IN THE A GIBSON SURVEY, ABSTRACT NO 498, DENTON COUNTY, TEXAS AND LOCATED SOUTH OF FORRESTRIDGE ADDITION, PHASE II, AND NORTH OF RYAN ROAD, TO PROVIDE FOR A CHANGE IN ZONING CLASSIFICATION AND USE DESIGNATION FROM AGRICULTURAL "A" DISTRICT CLASSIFICATION AND USE TO SINGLE rAMILY "SF-16" CLASSIFICATION AND USE FOR SAID PROPERTY, PROVIDING FOR A MAXIMUM PENALTY Ok $1,000 00 FOR VIOLATIONS THEREOF, PROVIDING FUR A SEVERABILITY CLAUSE, AND DECLARING AN EFFECTIVE DATE THE COUNCIL OF THE CITY OF DENTON HEREBY ORDAINS SECTION I That the Zoning Classification and Use designation applicable to all or part of the property described below is hereby changed from Agricultural "A" District Classification and Use to Single Family "SF-16" District Classification and Use under the Comprehensive Zoning Ordinance of the City of Denton, Texas All that certain tract or parcel of land that is situated in the A Gibson Survey, Abstract No 498, Denton County, Texas being a portion of a certain (called) 116 054 acre tract deeded by John Maeckle to Fort Worth Savings & Loan Association on the 14th day of February, 1973 and recorded in Volume 660, Page 132 Deed Records of Denton County, Texas, and being more fully described as follows, BEGINNING at the Southwest corner of Forrestridge Addition Phase II, THENCE South 85°24'00" East a distance of 1115 30 feet to an iron pin in the west right-of-way of Forrestridge Drive, THENCE South 04°33'00" East a distance of 6 90 feet to an iron pin in the West right-oi-way of said Forrestridge Drive, THENCE East a distance of 230 20 feet to an iron pin also being the Southeast corner of the Forrestridge Addition Phase II, THENCE South 00°30'20" West a distance of 800 00 feet to an iron pin, THENCE North 89°29'40" West a distance of 220 49 ieet to an iron pin, THENCE North 00°31'09" West a distance of 61 88 feet to an iron pin, THENCE North 85°24'00" West a distance of 1122 23 feet to an iron pin, THENCE North 00°12'20" East a distance of 742 18 feet to the point- of-beginning and containing 23 1171 acres of land SECTION II The Zoning Map of the City of Denton, Texas, adopted the 14th day of January, 1969, as an Appendix to the Code of Ordinances of the City of Denton, Texas under Ordinance No b9-1, be, and the same is hereby amended to show such change in District Classification and Use L-1753/HAMMETT & NASH, INC /PAGE 1 SECTION III That the City Council of the City of Denton, Texas, hereby finds that such change is in accordance with a comprehensive plan for the purpose of promoting the general welfare of the City of Denton, Texas, and with reasonable consideration, among other things for the character of the district and for itb peculiar suitability or particular uses, and with a view to conserving the value of the buildings, protecting human lives, and encouraging the most appropriate uses of land for the maximum benefit to the City of Denton, Texas, and its citizens SECTION IV Any person who shall violate a provision of this ordinance, or fails to comply therewith or with any of the requirements thereof, or of a permit or certificate issued thereunder, shall be guilty of a misdemeanor punishable by a fine not exceeding One Thousand Dollars ($1,000 00) Each such person shall be deemed guilty of a separate offense for each and every day or portion thereof during which any violation of this ordinance is committed, or continued, and upon conviction of any such violations such person shall be punished within the limits above SECTION V That if any section, subsection, paragraph, sentence, clause, phrase or word in this ordinance, or application thereof to any person or circumstance is held invalid by any court of competent ,jurisdiction, such holding shall not affect the validity of the remaining portions of this ordinance, and the City Council of the City of Denton, Texas, hereby declares it would have enacted such remaining portions despite any such invalidity SECTION VI That this ordinance shall become effective fourteen (14) days from the date of its passage, and the City Secretary is hereby directed to cause the caption of this ordinance to be published twice in the Denton Record-Chronicle, the official newspaper of the City of Denton, Texas, within ten (10) days of the date of its passage PASSED AND APPROVED this the So__ day of 1985 E , R I' 1/0 CI Y OF D N, TEXAS ATTEST TRLOTTA ' MC 'PAS CITY OF DENTON, TEXAS APPROVED AS TO LEGAL FORM DEBRA ADAMI DRAYOVITCH, CITY ATTORNEY CITY OF DENTONN, TEXAS BY "~;V6&W U Z-1753/HAMMETT & NASH, INC /PAGE 2
