F (1) (b) of Appendix B-Zoning of the Code of Ordinances is amended to read as follows (b) In the Central Business Zoning District (CB) the side yard for residential uses shall be the same as is required in the MF-l district No side yard is specified for non-residential uses except as indicated in Article 13 F (2) SECTION X Any person who shall violate a provision of this ordinance, or fails to comply therewith or with any of the requirements thereof, or of a ermit or certificate issued thereunder, shall be guilty of a misdemeanor punishable by a fine not exceeding One Thousand Dollars ($1,000 00) Each such person shall be deemed guilty of a separate offense for each and every day or portion thereof during which any violation of this ordinance is committed, or continued, and upon conviction of any such violations such person shall be punished within the limits above SECTION XI. That if any section, subsection, paragraph, sentence, clause, phrase or word in this ordinance, or application thereof to any person or circumstance is held invalid by any court of competent jurisdiction, such holding shall not affect the validity of the remaining portions of this ordinance, and the City Council of the City of Denton, Texas, hereby declares it would have enacted such remaining portions despite any such invalidity SECTION XII That this ordinance shall become effective fourteen (14) days from the date of its passage, and the City Secretary is hereby directed to cause the caption and penalty clause of this ordinance to be published twice in the Denton Record-Chronicle, the official newspaper of the City of Denton, Texas, within ten (10) days of the date of its passage, provided, however, that any property which, on the effective date of this ordinance, is zoned as an "Office ~0)", "Neighborhood Service (NS)", "General Retail Service (GR)", 'Commercial (C)", "Light Industrial (LI)" or "Heavy Industrial (HI)" zoning district classification, may be used for PAGE 4 any of the uses listed in "B Primary Residential Uses" of the schedule of uses of Article 7, Appendix B-Zoning, if such use was a permitted use for such property immediately prior to the effective date of this ordinance, in accordance with a valid building permit issued for such use, if the application, drawings, plans and specifications for such building permit are submitted to the Building Official on or before December 31, 1988 PASSED AND APPROVED this the / day of 1985 D 0 ,EWART, MAYOR \1 CIT OF D TON, TEXAS ATTEST C L h L 'N, C T OF D ON, TEXAS APPROVED AS TO LEGAL FORM DEBRA ADAMI DRAYOVITCH, CITY ATTORNEY CITY OF DENTON, TEXAS BY /I~PLZtaf.Rlz,( GlJ PAGE 5
