1985-1171106L NO AN ORDINANCE OF THE CITY OF DENTON, TEXAS PROVIDING FOR THE CLOSING AND VACATING OF THAT PORTION OF SAN GABRIEL DRIVE FROM ITS INTERSECTION WITH ANGELINA BEND DRIVE TO ITS INTERSECTION WITH PINEY CREEK BOULEVARD, PROVIDING FOR THE CLOSING AND VACATING OF A PORTION OF PINEY CREEK BOULEVARD AS DESCRIBED HEREIN, PROVIDING FOR THE RESERVATION OF EASEMENTS, AND PROVIDING FOR AN EFFECTIVE DATE WHEREAS, the City Council of the City of Denton, Texas, after due investigation and consideration has determined that the best interest and welfare of the public will be served by vacating and closing that portion of the herein described public streets, NOW, THEREFORE, BE IT ORDAINED BY THE COUNCIL OF THE CITY OF DENTON, TEXAS SECTION I That that portion of San Gabriel Drive extending from its intersection with Angelina Bend Drive to its intersection with Piney Creek Boulevard and that portion of Piney Creek Boulevard extending from its intersection with San Gabriel Drive south, described herein as Tract I and Tract II, are hereby closed and permanently vacated as public streets and rights-of-way TRACT I All that certain tract or parcel of land situated in tzH Hopkins Survey, Abstract Number 1694, City and County of Denton, Texas, and being part of Township II, Phase 2 and recorded in Volume 11, Page 14, Plat Records of said County, and being more particularly described as follows COMMENCING at the southwest corner of Lot 56, Block A of the Oaks of Township II as recorded in Cabinet E, Page 13, Plat Records, THENCE north 01°34'05" west with the west line of said Lot 56 a distance of 130 0 feet to a corner at the Point of Beginning, THENCE northwesterly with a curve to right which has a central angle of 08°32'05" a radius of 856 95 feet and an arc distance of 127 65 feet to a corner at a point of curve on curve, THENCE northwesterly with a curve to right which has a central angle of 07°37'02" a radius of 1086 82 feet and an arc distance of 144 487 feet to a corner, THLNCE north 17°37'53" east a distance of 60 09 feet to a corner, THENCE southeasterly with a curve to left which has a central angle of 07°26'20" a radius of 1026 82 feet and an arc distance of 133 315 feet to a point of curve on curve, THENCE southeasterly with a curve to left which has a central angle of 08°33'17" a radius of 796 95 feet and an arc distance of 118 99 feet to a corner on the west line of said Lot 56, THENCE south O1°18'07" west with the west line of said Lot 56 a distance of 60 0 feet to the Point of Beginning and containing in all 0 361 acres of land TRACT II All that certain lot, tract or parcel of land situated in the R H Hopkins Survey, Abstract Number 1694, Denton County, Texas, and being part of Lot 56, Block A, of the Oaks of Township II as recorded in Cabinet E, Page 13, Plat Records of said Denton County, and being more particularly described as follows COMMENCING at a steel pin at the southwest corner of said Lot 56, THENCE north O1°34'05" west with a west line of said Lot 56 a distance of 130 0 feet to a steel pin at the Point of Beginning, THENCE north O1°18'07" west with a west line of said lot a distance of 60 0 feet to a steel pin, THENCE northeasterly with a curve to left which has a central angle of 25°47'23" a radius of 796 95 feet and an arc distance of 358 72 feet to a steel pin at the end of said curve, THENCE north 62°37'20" east a distance of 109 50 feet to a steel pin, THENCE south 27°22'38" east a distance of 60 0 feet to a steel pin, THENCE south 62°37'13" west a distance of 9 50 feet to a steel pin, THENCE south 27°22'40" east a distance of 130 0 feet to a steel pin, THENCE south 62°37'20" west a distance of 100 0 feet to a steel pin, THENCE north 27°22'40" west a distance of 130 0 feet to a steel pin, THENCE southwesterly with a curve to right which has a central angle of 25°4835" a radius of 856 95 feet and an arc distance of 386 026 feet to the Point of Beginning containing in all 0 962 acres of land SECTION II That within that portion of San Gabriel Drive hereby closed and vacated, described as Tract I above, there is expressly reserved to the City of Denton, its successors and assigns, an all purpose utility easement for the purpose of constructing, installing, reconstructing, repairing, replacing, operating and maintaining utilities, including, but not limited to lines, mains, conduits, structures and improvements, and any necessary appurtenances thereto, for electrical, telephone, telecommunications, water, sanitary and storm sewer, and drainage purposes SECTION III That the City Secretary is hereby directed to cause a certified copy of this ordinance to be filed in the Deed Records of Denton County, Texas PAGE 2 SECTION IV That this ordinance shall become effective immediately upon its passage and approval ' PASSED AND APPROVED this the 1't/r day of , 1985 ell~ C , -
