AN ORDINANCE REPEALING SECTION 25-6 1 OF THE CODE OF ORDINANCES OF
THE CITY OF DENTON, TEXAS, REENACTING A NEW SECTION 25-6 1 TO PRO-
VIDE FOR THE AVERAGE BILLING OF UTILITY SERVICES, AND PROVIDING FOR
AN EFFECTIVE DATE
THE COUNCIL OF THE CITY OF DENTON HEREBY ORDAINS
SECTION I
That Section 25-6 1 ("Average Billings for Services") of Chapter
25 of the Code of Ordinances is hereby repealed
SECTION II
That a new Section 25-6 1 of Chapter 25 of the Code of Ordi-
nances is hereby enacted to read as follows
Section 25-6 1 Average billings for services
Any residential utility customer of the City may be billed for
electrical, water, sewer, and sanitation services based upon an
average bill for the customer's previous twelve (12) months of
service with the City at the service address where average billing
is requested in accordance with the following provisions
(a) The customer shall make written application to the City
on a form furnished by the City requesting average bill-
ing in accordance with the provisions of this section
(b) Upon receipt and approval of the application, the City
will compute the average bill as described below The
customer shall be billed this average bill for the first
eleven (11) billings after approval of the application
On the twelfth billing, the City will credit the
customer's account for the accumulated amount of the
average bill in excess of the actual twelve (12) months'
consumption, and charges, or bill the amount for actual
consumption and charges in excess of the average billing
provided for herein The customer shall have until the
due date for the twelth (12) bill to pay any additional
billings
(1) Water and Electric The City will compute the cus-
tomer's total consumption of water and electricity
for the previous twelve (12) months These annual
consumptions will be divided by eleven (11) to pro-
duce estimated usages per month for the next twelve
(12) months The water and electric portions of the
average bill will be calculated using these
estimated usages and the rate schedules that are
applicable to the customer at the time the average
bill is computed
(2) Sewer The City will compute the customer's average
monthly water consumption for the previous three
winter months of December, January, and February
that occurred within the most recent twelve (12)
months This average monthly rate of consumption
shall not exceed twenty-five thousand (25,000)

gallons The monthly average of these three winter
months will be multiplied by twelve (12) and divided
by eleven (11) to produce an estimated effluent per
month for the next twelve (12) months The sewer
portion of the average bill for the next twelve
months will be calculated using this estimated
effluent flow and the rate schedule applicable to
the customer at the time the average bill is
computed
(c) The City may provide average billing for utility ser-
vice(s) based upon the customer's credit rating, the
customer's credit history with the City for utility
services, or upon request of the Utility Account Review
Committee as a condition of the City's contract with
the customer for payment of an overdue account or
accounts, or any other financial reason Upon receipt
and approval of credit rating, the customer's written
and signed application shall constitute an agreement
between the customer and the City to comply with the
terms of this section and the average billing policies
of the City
(d) Any late payment (payment received after the bill due
date) of any averagge billing which occurs more than
twice in a twelve (12) month period shall be cause for
discontinuation of average billing Failure to pay
after the second payment due date will also be cause to
discontinue average billing Should the customer be
removed from the average billing program for failure to
pay the bill in a timely manner (late payment) such
customer may not requalify for such program until after
the expiration of three (3) months After a second
removal from the program, a customer may not requalify
for such program until after the expiration of one year
SECTION III
That this ordinance shall become effective immediately upon its
passage and approval
