1985-0701044L NO - Ian-' AN ORDINANCE AMENDING THE ZONING MAP OF THE CITY OF DENTON, TEXAS, AS SAME WAS ADOPTED AS AN APPENDIX TO THE CODE OF ORDINANCES OF THE CITY OF DENTON, TEXAS BY ORDINANCE NO 69-1 AND AS SAID MAP APPLIES TO 37 600 ACRES OF LAND SITUATED WEST OF AND ABUTTING LOOP 288 AND NORTH OF AND ABUTTING AUDRA LANE, TO PROVIDE FOR A CHANGE IN ZONING CLASSIFICATION FROM AGRICULTURAL "A" DISTRICT CLASSIFI- CATION AND USE DESIGNATION TO PLANNED DEVELOPMENT "PD" DISTRICT CLASSIFICATION AND USE DESIGNATION, AND PROVIDING FOR AN EFFECTIVE DATE THE COUNCIL OF THE CITY OF DENTON, TEXAS, HEREBY ORDAINS SECTION I That the Zoning Classification and Use designation applicable to all or part of the property described below is hereby changed from Agricultural "A" District Classification and Use to Planned Development "PD" District Classification and Use under the Comprehensive Zoning Ordinance of the City of Denton, Texas All that certain 37 600 acre tract or parcel of land situated in the R B Longbottom Survey, Abstract Number 775, Denton County, Texas, said tract being part of a called 24 935 acre tract shown by deed to Turner F Gassaway, recorded in Volume 504, Page 229 and part of a called 16 141 acre tract shown by deed to Turner F Gassaway, recorded in Volume 504, Page 226, Deed Records, Denton County, Texas, and being more particularly described as follows BEGINNING for the northwest corner of this tract at an iron pin, said pin is the northwest corner of said 24 935 acre tract, and said pin is also the northwest corner of a called 40 00 acre tract shown by deed to J P Sitz, recorded in Volume 130, Page 519, Deed Records, Denton County, Texas, THENCE south 88°42'24" east with the north line of said 24 935 acre tract, a distance of 831 84 feet to an iron pin, found, the northwest corner of a tract shown by deed to Fred H and Sam H Peterson, recorded in Volume 929, Page 553, Deed Records, Denton County, Texas, for the most northerly northeast corner of this tract, THENCE south 00°37'24" west with a fence a distance of 100 13 feet to a fence corner post, the southwest corner of said Peterson Tract, for an inner ell corner of this tract, THENCE south 88°56'27" east with a fence, and the south line of said Peterson Tract, a distance of 335 38 feet to an iron pin in the southwest right-of-way of Loop 288, as widened, said pin is the southwest corner of a tract shown by deed to State of Texas, recorded in Volume 1039, Page 986, said pin is also the northwest corner of a tract shown by deed to State of Texas, recorded in Volume 1378, Page 987, Deed Records, Denton County, Texas, for the most easterly northeast corner of this tract, THENCE south 09°28'43" east with the said southwest right-of-way of Loop 288 as widened a distance of 735 94 feet to an iron pin for an angle point of this tract, THENCE south 00°39'16" west continuing with said right-of-way a distance of 505 69 feet to an iron pin in the center line of Audra Lane, said pin is also in the south line of said Longbottom Survey, for the southeast corner of this tract, Z-1715/PAGE 1 THENCE north 89°51'25" west with said center line, and said south line of survey a distance of 1285 84 feet to an iron pin found, for the southwest corner of this tract, THENCE north 00011'34" east with a fence part way a distance of 1353 43 feet to point of beginning SECTION II That in approving this planned development district ordinance, the City Council hereby approves the final site plan, attached hereto, for the area designated for 2-F Prior to the development of the areas designated as multifamily (MF), warehouse, retail/ office, and office/warehouse on the site plan attached hereto, a final comprehensive site plan shall be required to be submitted and approved as part of this ordinance in accordance with Article 11, Appendix B-Zoning, of the Code of Ordinances SECTION III That the development of the property shall be in substantial compliance with all comprehensive site plans approved herein or hereafter, and attached hereto and made a part herein for all purposes SECTION IV That the City Council of the City of Denton, Texas, hereby finds that such change is in accordance with a comprehensive plan for the purpose of promoting the general welfare of the City of Denton, Texas, and with reasonable consideration, among other things for the character of the district and for its peculiar suitability or particular uses, and with a view to conserving the value of the buildings, protecting human lives, and encouraging the most appropriate uses of land for the maximum benefit to the City of Denton, Texas, and its citizens SFCTION V That this ordinance shall be in full force and effect immedJately after its passage and approval, the required public hearings having heretofore been held by the Planning and Zoning Commission and the City Council of the City of Denton, Texas, after giving due notice thereof PASSED AND APPROVED this the 'day of ,
