AN ORDINANCE AMENDING A PLANNED DEVELOPMENT DISTRICT PURSUANT TO
THE PROVISIONS OF APPENDIX B-ZONING OF THE CODE OF ORDINANCES OF
THE CITY OF DENTON, TEXAS AS SAID DISTRICT APPLIES TO
APPROXIMATELY 56 027 ACRES OF LAND, MORE OR LESS, OUT OF THE
MARY AUSTIN SURVEY, ABSTRACT NO 4, LOCATED ON THE SOUTH SIDE OF
COLORADO BOULEVARD APPROXIMATELY 1,500 FEET NORTHWEST OF LOOP
288, AND DECLARING AN EFFECTIVE DATE
THE COUNCIL OF THE CITY OF DENTON, TEXAS, HEREBY ORDAINS
SECTION I
That the existing planned development district zoning ordi-
nance applicable to all or part of the property described as
Tract 1 in Exhibit "A" attached hereto and made a part hereof
for all purposes, having been previously designated as a Planned
Development District under the provisions of Ordinance No
81-111, passed and approved on the 15th day of December, 1981,
in accordance with the provisions of Article 11, Appendix
B-Zoning of the Code of Ordinances of the City of Denton, Texas
is hereby amended as set forth herein
SECTION II
The conditions and restrictions applicable to the property
imposed by Ordinance No 81-111 are hereby superceded by the
following conditions
1 The location of tributary B to Pecan Creek where the
same abuts the east side of Phase I of Township II
shall not be altered except to provide for necessary
drainage It is further provided that single family
lots shall begin no closer than forty (40) feet east
of the centerline of the existing creek
2 In both Phase II and Phase III, the development of
the single family (80 X 120' typical lot size) area
shall precede or be concurrent with the development
of the single family cluster housing
3 Prior to or at the beginning of development of Phase
II, but in no case later than sixty (60) days after
the issuance of a quitclaim deed by the City of
Denton, the developer shall remove the existing
paving of San Gabriel Drive from the point where it
intersects Angelina Bend Drive to the point where it
intersects the cluster housing in the Phase II area
4 The developer shall landscape all disturbed areas of
the greenbelt as part of the development Phases II
and III
5 Piney Creek Boulevard shall be re-opened for public
use
6 Minimum 30 foot front, 7 foot side, and 10 foot rear
yard setbacks shall be required in the single family
uses as shown on the attached site plan

7 Specific site plan approval must be granted for
cluster housing areas in Phase II and Phase III prior
to final plat approval and issuance of building
permits
8 Developer shall be required to improve one half of
Colorado Boulevard to the MKT Railroad track
9 Developer shall install a 10" sewer line from her
development up Woodrow Lane to the Pecan Creek twin
intercepter lines
SECTION III
That the comprehensive site plan for the Planned Development
District approved and adopted by Ordinance No 81-111, applicable
to the herein described property, is hereby amended in accordance
with the comprehensive site plan attached hereto and the use of
said property shall be hereafter in accordance with such amended
site plan
SECTION IV
That the City Council of the City of Denton, Texas, hereby
finds that such change is in accordance with a comprehensive
plan for the purpose of promoting the general welfare of the
City of Denton, Texas, and with reasonable consideration, among
other things for the character of the district and for its
peculiar suitability or particular uses, and with a view to
conserving the value of the buildings, protecting human lives,
and encouraging the most appropriate uses of land for the
maximum benefit to the City of Denton, Texas, and its citizens
SECTION V
That this ordinance shall be in full force and effect
immediately after its passage and approval, the required public
hearings having heretofore been held by the Planning and Zoning
Commission and the City Council of the City of Denton, Texas,
after giving due notice thereof

AN ORDINANCE OF THE CITY OF DENTON, TEXAS, PROVIDING FOR THE
APPROVAL OF AN AMENDED DETAILED PLAN FOR 5 7 ACRES OF LAND LOCATED
WITHIN PD-6, ALONG THE NORTH SIDE OF WILDERNESS STREET, THE NORTH
SIDE OF TIMBERRIDGE STREET, AND THE WEST SIDE OF KENWOOD STREET,
AS MORE PARTICULARLY DESCRIBED HEREIN, PROVIDING FOR A PENALTY IN
THE MAXIMUM AMOUNT OF $2000 00 FOR VIOLATIONS THEREOF, AND
PROVIDING FOR AN EFFECTIVE DATE
WHEREAS, by Ordinance No 84-132, the City Council approved
an amended site plan for 56 acres of land, as more particularly
described therein, located within PD-6,
WHEREAS, the applicant has applied for approval of a revised
detailed plan for 5 7 acres of the planned development district to
provide for amendments to the designated cluster housing and
single-family use areas, and,
WHEREAS, the Planning and Zoning Commission has recommended
approval of the amended detailed plan, NOW, THEREFORE,
THE COUNCIL OF THE CITY OF DENTON HEREBY ORDAINS
SECTION I That in accordance with article 11 of Appendix
B - Zoning oP the Code of Ordinances, the amended detailed plan
shown in Exhibit "B", attached hereto and incorporated by reference
is approved for the 5 7 acres of land located in PD-6, said land
being described in Exhibit "A", attached hereto and incorporated
by reference, so that hereafter the property shall be constructed,
used, And maintained in accordance with the detailed plan herein
approved
SECTION II. That a copy of this ordinance shall be attached
to Ordinance No 84-132, showing the amendment herein made
SECTION III. That any person violating any provision of this
ordina~hce shall, upon conviction, be fined a sum not exceeding
$2000 00 Each day that a provision of this ordinance is violated
shall constitute a separate and distinct offense
SECTION IV. That this ordinance shall become effective
fourteen (14) days from the date of its passage, and the City
secretary is hereby directed to cause the caption of this ordinance
to be published twice in the Denton Record-Chronicle, the official
newspaper of the City of Denton, Texas, within ten (10) days of the
date of its passage
