1984-1240863L NO AN ORDINANCE AMENDING THE ZONING MAP OF THE CITY OF DENTON, TEXAS, AS SAME WAS ADOPTED AS AN APPENDIX TO THE CODE OF ORDINANCES OF THE CITY OF DENTON, TEXAS, BY ORDINANCE NO 69-1, AND AS SAID MAP APPLIES TO 130 6898 ACRES OF LAND LOCATED AT THE SOUTHEAST CORNER OF JIM CHRISTAL ROAD AND MASCH BRANCH ROAD, AND IS MORE PARTICULARLY DESCRIBED HEREIN, TO PROVIDE FOR A CHANGE IN ZONING CLASSIFICATION FROM AGRICULTURAL "A" DISTRICT CLASSIFICATION AND USE DESIGNATION TO PLANNED DEVELOPMENT "PD" CLASSIFICATION AND USE DESIGNATION, AND PROVIDING FOR AN EFFECTIVE DATE THE COUNCIL OF THE CITY OF DENTON, TEXAS, HEREBY ORDAINS SECTION I That the zoning classification and use designation of the following described property, to-wit All that certain tract or parcel of land situated in the John Scott Survey, Abstract No 1222, Denton County, Texas, being a part of a (called) 129 44 acre tract described in a deed from W F Hamilton and Estelle Brown to B A Weaver, et ux, on the 8th day of December, 1951, recorded in Volume 376, Page 169, Deed Records of said County, and being more fully described as follows BEGINNING at the northwest corner of said 129 44 acre tract which is the northwest corner of the John Scott Survey and the southwest corner of the W Bryan Survey, Abstract 148, on the east boundary line of Masch Branch Road, THENCE north 89°58'45" east in and near Jim Chrystal Road (East- West) and with the north boundary line of the J Scott Survey a distance of 1889 19 feet to an iron pin at the northeast corner of said 129 44 acre tract, THENCE south pass at 22 4 feet a fence corner and continuing along and near said fence a distance of 3958 00 feet to a fence corner at the southeast corner of said 129 44 acre tract on the south boundary line of the J Scott Survey, THENCE north 89°52'35" west with said survey line along and near a fence a distance of 764 20 feet to an iron pin at the south southwest corner of said tract, THENCE north along and near a fence a distance of 1333 00 feet to an iron pin at an inner ell corner of said tract, THENCE south 89°47'45" west a distance of 448 15 feet to an iron pin at the southeast of a (called) 6 09 acre tract described in a deed from B A Weaver, et ux to the City of Denton on the 5th day of October, 1977, recorded in Volume 857, Page 523, Deed Records of Denton County, Texas, THENCE north 09°27'26" east a distance of 405 75 feet to an iron pin at the northeast corner of said City of Denton Tract, THENCE south 89°47'45" west a distance of 743 52 feet to an iron pin at the northwest corner of said City of Denton Tract on the Z-1685/ED WOLSKI/PAGE 1 west boundary line of said 129 44 acre tract in Masch Branch Road and on the west boundary line of the J Scott Survey, THENCE north with the west boundary line of said tract and of said survey in Masch Branch Road a distance of 2226 67 feet to the point of beginning and containing 130 6898 acres of land is hereby changed from Agricultural "A" District Classification and Use designation to Planned Development "PD" Classification and Use to permit Light Industrial "LI" land use designation under the comprehensive zoning ordinance of the City of Denton, Texas SECTION II That in approving this planned development district ordinance, the City Council hereby approves a preliminary site plan showing the general proposed land uses within the district Prior to the issuance of any building permit for development within the district or part thereof, a comprehensive site plan shall be required to be submitted and approved as part of this ordinance in accordance with Article 11, Appendix B-Zoning, of the Code of Ordinances SECTION III That prior to issuance of any certificate of occupancy for the use of any building within the planned development district, the following conditions shall be met 1 Specific site plan approval will be required before building permits are issued 2 This site is restricted to light industrial use only- no residential land use permitted 3 All structures will be limited to two stories in height SECTION IV That the development of the property shall be in substantial compliance with the site plan attached hereto and made a part hereof for all purposes The Zoning Map of the City of Denton, Texas, adopted the 14th day of January, 1969, as an Appendix to the Code of Ordinances of the City of Denton, Texas under Ordinance No 69-1, be, and the same is hereby amended to show such change in District Classification and Use subject to the above conditions and specifications SECTION V That the City Council of the City of Denton, Texas, hereby finds that such change is in accordance with a comprehensive plan for the purpose of promoting the general welfare of the City of Denton, Texas, and with reasonable consideration, among other things for the character of the district and for its peculiar suitability or particular uses, and with a view to conserving the value of the buildings, protecting human lives, and encouraging the most appropriate uses of land for the maximum benefit to the City of Denton, Texas, and its citizens Z-1685/ED WOLSKI/PAGE 2 SECTION VI That this ordinance shall be in full force and effect immediately after its passage and approval, the required public hearings having heretofore been held by the Planning and Zoning Commission and the City Council of the City of Denton,
