1984-061NO _ L.LZ~ AN ORDINANCE AMENDING THE ZONING MAP OF THE CITY OF DENTON, TEXAS, AS SAME WAS ADOPTED AS AN APPENDIX TO THE CODE OF ORDINANCES OF THE CITY OF DENTON, TEXAS, BY ORDINANCE NO 69-1, AND AS SAID MAP APPLIES TO APPROXIMATELY 49 ACRE OF LAND OUT OF THE B B B & C R R Co SURVEY, ABSTRACT NO 185, DENTON COUNTY, TEXAS, AND MORE PARTICULARLY DESCRIBED HEREIN, AND DECLARING AN EFFECTIVE DATE THE COUNCIL OF THE CITY OF DENTON, TEXAS, HEREBY ORDAINS SECTION I The Zoning Classification and Use designation of the follow- ing described property, to-wit All that certain lot, tract or parcel of land situated in the City of Denton, County of Denton and State of Texas being part of Subdivision No 20 of a 640 acre Survey patented to John R Henry Assignee of the B B B & C R R Co , by virtue of Land Certificate No 111, Abstract No 185, and more particularly described as follows, to-wit BEGINNING at a point in the center of North Locust Street, 50 feet south of the northwest corner of said Subdivision No 20, THENCE east 30 feet to the east line of North Locust Street and the southwest corner of a lot sold by Rudolph Huber to Chris Huber, for the beginning corner of this lot, THENCE east with the south line of said Cheis Huber lot 160 feet to a stake for corner, THENCE south parallel with the center of Locust Street to the top of the north bank of the north prong of Pecan Creek THENCE in a northwesterly direction with the edge of said Creek to the east line of said North Locust Street, THENCE north with said east line about 100 feet to the place of beginni g, and being all of that portion of the land that lies north o~ said Pecan Creek that was sold by Rudolph Huber to W M Jago , fronting on North Locust Street, and extending East 160 feet is hereby changed from Office "0" District Classification Use to Planned I Development "PD" District Classification for Neighbor- hood Service Use under the Comprehensive Zoning Ordinance of the City of Denton, Texas with the following conditions and specifications 1 No other structures existing or placed on the lot may be used for neighborhood service uses The duplex and storage facility will maintain their present uses and the 800 North Locust building will be restricted to an artist's studio use with retail privileges 2 Any requirements not addressed by the site plan or PD conditions shall conform to the Zoning Ordinance and Subdivision Regulations Z-1653/ELEANOR GREEN-PAGE 1 The Zoning Map of 14th day of January, Ordinances of the City 69-1, be, and the same District Classification and specifications SECTION II the City of Denton, Texas, adopted the 1969, as an Appendix to the Code of of Denton, Texas, under Ordinance No is hereby amended to show such change in and Use subJect to the above conditions That the City Council of the City of Denton, Texas, hereby finds that such change is in accordance with a comprehensive plan for the purpose of promoting the general welfare of the City of Denton, Texas, and with reasonable consideration, among other things for the character of the district and for its peculiar suitability or particular uses, and with a view to conserving the value of the buildings, protecting human lives, and encouraging the most appropriate uses of land for the maximum benefit to the City of Denton, Texas, and its citizens SECTION III That this ordinance shall be in full force and effect immediately after its passage and approval, the required public hearings having heretofore been held by the Planning and Zoning Commission and the City Council of the City of Denton, Texas, after giving due notice thereof PASSED AND APPROVED this the A day of , 1984 CI OFD TON, ERAS ATTEST CHARLOTTE ALLEN, CITY SECRETARY CITY OF DENTON, TEXAS APPROVED AS TO LEGAL FORM C J TAYLOR, JR , CITY ATTORNEY CITY OF DENTON, TEXAS BY C Z-1653/ELEANOR GREEN-PAGE 2 - 5 I -7 +*W;-AwP Sam^"- 4r-- I _ f,
