1984-041NO AN ORDINANCE PROVIDING FOR THE ABANDONMENT OF A UTILITY EASEMENT WITHIN THE CITY OF DENTON AND AUTHORIZING THE MAYOR TO EXECUTE A QUITCLAIM DEED CONVEYING ALL RIGHT, TITLE AND INTEREST OF THE CITY IN SAID EASEMENT TO THE OWNER OF THE TRACT OF LAND CONVEYED BY SAID EASEMENT, AND DECLARING AN EFFECTIVE DATE WHEREAS, the City Council of the City of Denton, acting pursuant to law, and upon the request and petition of the grantee herein, deems it advisable to abandon and convey the hereinafter described tract of land to grantee and is of the opinion that said utility easement is not needed for public use, and that same should be abandoned and quitclaimed to Mark Hughes and wife, Regina Hughes, as hereinafter provided, and WHEREAS, the City Council of the City of Denton is of the opinion that the best interest and welfare of the public will be served by abandoning and conveying the same to Mark Hughes and wife, Regina Hughes, for the consideration hereinafter more fully set forth, now, therefore, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF DENTON SECTION I That the following described tract of land in the City of Denton be and the same is hereby abandoned, vacated and closed insofar as the right, title and easement of the public are concerned All that certain lot, tract or parcel of land lying and being situated in the City and County of Denton, State of Texas, and being part of the T Peacock Survey, Abstract No 1589, and being part of Lot 3, Block D, of the Montecito Del Sur Addition, an addition to the City/County of Denton, and also being part of a tract of land as conveyed from Vista Mortgage and Realty to Mark Hughes and wife, Regina Hughes by deed dated July 15, 1983 and recorded in Volume 1236, Page 165 of the Deed Records of Denton County, Texas, and more particularly described as follows Tract 1 Being that portion of a 16 foot utility easement ocate adjacent to a 25 foot drainage easement as shown on plat recorded in Volume 9, Page 34 and 35 of the Plat Records of Denton County, Texas Tract 2 Being 5 foot strip of land lying and being adjacent to ti-F o theast boundary line of said Lot 3 SECTION II That the Mayor and City Secretary are hereby authorized to execute and deliver that certain quitclaim deed attached hereto and incorporated herein conveying said utility easement described therein to Mark Hughes and wife, Regina Hughes SECTION III That portion of the public utility easement herein described being vacated, abandoned, and closed is made subject to all existing zoning regulations and deed restrictions, if any, and subject to all existing easement rights of others, if any, whether apparent or not SECTION IV This ordinance shall take effect and be in full force and effect from and after the date of its passage, and it is so ordained PASSED AND APPROVED by the City Council of the City of Denton, Texas, this the day of Mamh, 1984 4Z CIY OF NTON, TEXAS ATTEST ME LOT T'E ALLEN, U1TY-SZ•;CIFETA'RY CITY OF DENTON, TEXAS APPROVED AS TO LEGAL FORM C J TAYLOR, JR , CITY ATTORNEY CITY OF DENTON, TEXAS BY CV \ g~9 0 CRV INSIDE L~ I No D R T L N Y n = BIM gUP I Iii. i I UI ' pE \<\ON I 1 I 004(it \g5 P 0 B SAN A OT 7*-, Nq~ ® A S 6 xA0 00 , ~0\ 0 D ~ \0 S "C90A~ Ly~'~ I o 718 90 V, I ♦E • , I n 1 Wall fitil m w .500 n \ 1 , .
