1984-035NO AN ORDINANCE AMENDING CHAPTER 14 OF THE CODE OF ORDINANCES BY ADDING THERETO A NEW ARTICLE VI ENTITLED LIBRARY, PROVIDING THAT THE FAILURE TO RETURN LIBRARY BOOKS AND MATERIALS IS A MISDEMEANOR, PROVIDING FOR A FINE OF NOT TO EXCEED TWO HUNDRED DOLLARS, AND DECLARING AN EFFECTIVE DATE THE COUNCIL OF THE CITY OF DENTON HEREBY ORDAINS SECTION I Chapter 14 of the Code of Ordinances of the City of Denton is hereby amended by adding new Sections 14-65 through 14-75 as follows New Sections 14-65 through 14-75 are hereby reserved for future use SECTION II Chapter 14 of the Code of Ordinances of the City of Denton is hereby amended by adding a new Article VI, Library, reading as follows ARTICLE VI LIBRARY Section 14-76 Illegal Not to Return Borrowed Materials Every person, including the parent or guardian of a child under the age of seventeen (17) years, who shall take or borrow from the Denton Publlic Library any book, pamphlet, periodical, paper or other property and neglect, refuse or fail to return the same within fourteen (14) days after the date of mailing a notice by certified mail with return receipt requested to his or her address noted on the current library card shall be deemed guilty of a misdemeanor and on conviction thereof, shall be punished by a fine of not to exceed Two Hundred Dollars ($200 00) for each offense Section 14-77 Presumptions It shall be presumed that the person whose name appears on the library card is the person who took or borrowed the book or other library material and equipment from the library SECTION III That any person violating any of the provisions of this ordinance shall, upon conviction, be fined a sum not exceeding Two Hundred Dollars ($200 00), and each day and every day that the provisions of this ordinance are violated shall constitute a separate and distinct offense This penalty is in addition to and cumulative of, any other remedies as may be available at law and equity SECTION IV This ordinance shall become effective from its date of passage and publication as required by law >k PASSED AND APPROVED this the 1/~ L~ day of 1984 I D O STE T, MAY CIT OF NTON, TEXAS ATTEST - CHARLOTTE ALLEN, CITY SECRETARY CITY OF DENTON, TEXAS APPROVED AS TO LEGAL FORM C J TAYLOR, JR , CITY ATTORNEY CITY OF DENTON, TEXAS BY
