1984-033NO 2,11-3 AN ORDINANCE AMENDING CHAPTER 20 OF THE CODE OF ORDINANCES OF THE CITY OF DENTON, TEXAS, RELATING TO AUTOMOTIVE WRECKING AND SALVAGE YARDS, BY REQUIRING SCREEN FENCING WHEN ADJOINING PREMISES ARE OCCUPIED, PROVIDING FOR A PENALTY NOT TO EXCEED TWO HUNDRED DOLLARS FOR VIOLATIONS THEREOF, AND PROVIDING FOR AN EFFECTIVE DATE THE COUNCIL OF THE CITY OF DENTON, TEXAS, HEREBY ORDAINS SECTION I That Section 20-73 of Article IV of Chapter 20 of the Code of Ordinances of the City of Denton, Texas be amended by adding a new subsection "(3)" thereto, to read as follows "(3) Where the automotive wrecking yard adjoins any property which is occupied by a dwelling or building used as living or sleeping quarters, the wrecking yard shall erect and maintain a living hedge, screen, dirt bern or a fence of such height and location as to screen the junked vehicles from any point on the common property line of the wrecking yard and the adjoining occupied premises " SECTION II That any person violating any of the provisions of this ordinance shall, upon conviction, be fined a sum not exceeding Two Hundred Dollars ($200 00), and each day and every day that the provisions of this ordinance are violated shall constitute a separate and distinct offense This penalty is in addition to and cumulative of, any other remedies as may be available at law and equity SECTION III That this ordinance shall become effective on September 1, 1984 PASSED AND APPROVED this the 20th day of March, 1984 ATTEST WiAKLUTTL , CITY OF DENTON, TEXAS APPROVED AS TO LEGAL FORM C J TAYLOR, JR , CITY ATTORNEY CITY OF DENTON, TEXAS BY Z
