That pursuant to Article II of Chapter 25 of the Cade of Ordinances, the
rates, charges, fees, deposits and procedures for providing electrical service
by the City to its customers are hereby established as follows

A Account Connection Fee
APPLICATION
Applicable when a customer requests Plectric service on a first
time basis where no permanent service previously existed and where a new
account and number is established

APPLICATION
Applicable when a customer requests service at an address which has
existing or previous service, with an existing account m nber and history

DEFINITION OF TIME CHARGES
Regular Time Rate will be charged when customer completes
application for connection or reconnection by 3 00 PM of the business day
connection or reconnection is to take place or next business day service
connection or reconnection is allowed
Overtime Rate will be charged for all instances where customer
requests same day or weekend service connection or reconnection and does
not meet Regular Time guidelines
C House Moving Charges
APPLICATION
Applicable whenever a house or other unusual and oversized
structure is moved within the electric service area of the City The City
will review the proposed route for safe transportation regarding electric
service

Applicable when a customer check has been dishonored by the maker's
bank and returned to the City of Denton

When a customer requests a reading of City meter due to a contested
billing more than twice in the previous eleven (11) months and no error

APPLICATICN
Resale of electrical energy is limited by the following conditions
1 Lines will not be extended over/under lot lines or public
right-of-ways
2 The per unit charge ($/KWH and $/U) by the reseller shall not
exceed the rate plus energy cost adjustment charged by the City to the
original customer No additional Facility charge or other pro-rata charge
shall be rendered as part of the electric sub-metering billing
3 Measurement devices (meters) must have an accuracy of + 2 09,
and be tested upon request by the ultimate customer or the City of Denton
Utility Department The interval between tests without charge to the
customer shall not exceed two (2) years Cost of tests shall not be more
than charged by the City under its ordinance In cases where the
metering is found to be inaccurate, the ultimate customer shall be billed
or credited for up to 24 months prior usage
4 Billing dates of ultimate customers shall be within ten (10)
working days of the date used by the City for the City billing of the
original customer
5 Records shall be maintained at a City of Denton location for
inspection/verification by the City and/or the ultimate customer for not
less than the preceeding twelve (12) months
J Service Deposits
APPLICATION
Applicable when a customer requests service for the first time in
the Denton electric service area
RATE
A residential customer will make a deposit of $150 00 or an amount
equal to 1/6 of the last twelve (12) months billings at the meter
location, whichever is greater

A commercial customer will make a deposit of $300 00 or an amount
equal to 1/6 of the last 12 months billing at the meter location or 1/6
of the annual anticipated billing at the meter location if no meter
history exists, whichever is greater A commercial customer may purchase
a bond sufficient to cover the required deposit
WAIVER OF DEPOSIT
Deposit is not required for a customer who has a "good credit
standing' for utility service with the City of Denton or other electric
utility system for the twelve (12) months prior to application for
service with the City of Denton
Deposit will not be required in the event a customer has a
co-signer who meets the above criteria
RETUND OF DEPOSIT
Deposit will be held until customer has completed twelve (12)
continuous months with a good credit standing with the City of Denton
Utility At such time, or upon closing the account, a refund of entire
deposit plus any accrued interest will be made
K Special Facilities Rider
SPECIAL FACILIIIES RIDER
(1) Applicability
All service shall be offered from available facilities If a
customer service characteristic requires facilities and devices
which are not normally supplied by the City and readily available
at the location at which the customer requests service, then the
City shall provide the service subject to paragraph 2 of this
Section K
(2) The total cost of all facilities required to meet the customer's
load characteristics which are incurred by the City shall be
subject to a special contract entered into between the City and the
customer This contract shall be signed by both parries prior to
the City pLoviding service to the customer

ARTICLE II SCHEDULE OF RATES
(A) RESIDUMAL SERVICE RATE
(SCHEDULE R-1)
APPLICATION
Applicable to all electric service used for residential purposes in
a single family dwelling or an individually metered apartment, supplied
at one point of delivery and measured through one meter where usage is
not in excess of 700 KWH per 30-day month during the billing months MAY
through OCTOBER If usage in any such month exceeds 700 KWH, billing
will be rendered that month under Rate Schedule R-2 and thereafter for a
period extending through the 12 billing months of the next year ending
with the October billing Annually, in November, the customer may again
qualify for the R-1 rate provided that consumption has not exceeded 700
KWH per 30-day month during the previous six summer months
Where individual dwelling units are being served through the same
meter as of the effective date of this rate schedule and the KWH in the
billing months of MAY through OCTOBER exceed 700 KWH times the number of
dwelling units, the billing for that month and thereafter will be
rendered under Rate Schedule R-2

customer) is available to any customer with a 12-month minimum monthly
demand of 750 KW or greater Primary service rendered at one point on
the customer's premises at a nominal voltage of 13,200 volts or 69,000
volts three-phase at the option of the City
The primary voltage service customer shall own, operate, and
maintain all facilities necessary to receive three phase primary voltage
service and all transformation facilities requir,:~l for conversion to
utilization voltage The City shall own, operate and maintain all
metering facilities, either at primary or secondary voltage, at the
City's option Where the City elects to meter at secondary voltage, two
percent shall be added to the demand charge, the energy charge and the
energy cost adjustment charge to account for transformer losses

demand or by measurement of the average power factor for the monthly
billing period If the power factor is below ninety percent, the demand

TYPE OF SERVICE
The City shall furnish, install, maintain and deliver electric
service to automatically controlled, mercury or sodium vapor lighting
fixtures conforming to the City's standards and subject to its published
rules and regulations
Where necessary for proper illumination or where existing poles are
inadequate, the City will install or cause to be installed, one (1) pole
for each installed light, at a distance not to exceed eighty (80') feet
from said existing lines, at no charge to the customer Each additional
pole span shall not. exceed a span spacing of one hundred (100') feet
Additional poles required to install a light in a customer's specifically
desired location, and not having a light installed on same, shall bear
the cost.

A two (2) year contract shall be agreed to and signed by each
customer desiring Dusk-to-Dawn Lighting Service authorizing fixed monthly
charges, which may be reviewed annually, and to be applied to the monthly
municipal utilities bill In the event that a customer desired the
removal of the unit or discontinuance of the service prior to completion
of two (2) years, the remainder of the contract period shall become due
and payable After the end of the initial two (2) year contract, service
shall continue on a month-to-month basis and may be cancelled by either
party upon thirty (30) days notice

two percent shall be added to the demand charge, the energy charge and

The City shall notify the customer by telephone at least thirty
(30) minutes prior to the time at which the load is required to be
curtailed The request shall be for all or part of the customer's load
exceeding 5,000 KVA The maximum period of interruption shall be for six
tours The interruption shall be at the request of the City during the
periods when a potential forced outage could deny power to other
customers or when available spinning reserves are threatened The
customer shall respond by stating he will or will not comply with the
City's request within fifteen (15) minutes after notification

ENERGY COST ADJUSTMENT
All monthly KWH charges shall be increased or decreased by an
amount equal to "X" cents per KWH, to be known as the energy cost
adjustment (EGA) The ECA shall be computed in the months of April and
October to be applied to the following periods of May through October and
November through April respectively The City shall in no case change
the energy cost adjustment more than twice in either of the six (6)
months periods The ECA shall be calculated by the following formula

(excluding TWA's fixed charges) is greater than or less than the
cummilative EGA revenues by $1,000,000 during the fiscal year, the City
may recompute the Energy Cost Adjustment and re-establish an ECA that
collects or returns such difference over the remaining months of the
fiscal year Such change in ECA shall be applied evenly to all remaining
months' ECA

That if airy section, subsection, paragraph, sentence, clause, phrase or
word in this ordinance, or application thereof to any person or circumstances
is held invalid by any court of competent ,jurisdiction, such holding shall not
affect the validity of the ruining portions of this ordinance, and the City
Council of the City of Denton, Texas, hereby declares it would have enacted
such remaining portions despite any such invalidity
SECTION III
That this ordinance shall become effective on December 1, 1984, provided,
however, that the provisions of Article II, "Schedules of Rates", shall be
effective, applied to and be charged on all billings made on or after December
1, 1984
