THE CITY OF DENTON, TEXAS, BEING ALL THAT LOT, TRACT OR PARCEL
OF LAlqD CONSISTING OF APPROXIMATELY 150 5 ACRES OF LAND LYING
AND BEING SITUATED IN THE COUNTY OF DENTON, STATE OF TEXAS AND
BEING PART OF THE M FORREST SURVEY, ABSTRACT NO 417, DENTON
COUNTY, TEXAS, CLASSIFYING THE SAME AS AGRICULTURAL "A" DISTRICT
PROPERTY, AND DECLARING AN EFFECTIVE DATE
WHEREAS, the request for annexation was Introduced at a
regular meeting of the City Council of the City of Denton,
Texas, On the petition of the City of Denton, Texas, and
WHEREAS, an opportunity was afforded, at a public hearlng
held for that purpose on the 6th day of September, 1983 in the
Council Chambers for all lnterested persons to state their views
and present evidence bearing upon the annexation provided by
this ordinance, and
WHEREAS, an opportunity was afforded, at a public hearing
held for that purpose on the 20th day of September, 1983 in the
Council Chambers for all interested persons to state their views
and present evidence bearing upQn the annexation provided by
this ordinance, and
WHEREAS, this ordlnance has been published in full at least
one time in the official newspaper of the City of Denton, Texas,
prior to 1ts effective date, and after the public hearings,
NOW, THEREFORE, THE COUNCIL OF THE CITY OF DENTON, TEXAS,
HEREBY ORDAINS
SECTION I
That the hereinafter described tract of land be, and the
same is hereby annexed to the City of Denton, Texas, and the
same ~s made hereby a part of sa~d City and the land and the
present and future ~nhabitants thereof shall be entitled to all
the rights and privileges of other cltlzens of said City and
shall be bound by the acts and ordinances of said City now in
effect or which may hereafter be enacted and the property
s~tuated therein shall be sub3ect to and shall bear ~ts prorata

part of the taxes levied by the City The tract of land hereby
annexed is described as follows, to-wit
All that certain tract or parcel of land lying and being situated
in the County of Denton, State of Texas, and being part of the
M Forrest Survey, Abstract No 417 and being more particularly
described as follows~
BEGINNING at a point in the present city limits as established
by Ordinance No 65-45, Tract I, said point lying in west
boundary line of the M Forrest Survey, Abstract No 417 and 250
feet north of and perpendicular to the center line of F M 426
(McKlnney Street),
THENCE easterly 250 feet north of and parallel to the centerllne
of F M 426 (McKlnney Street) the following courses and
distances, (1) south 77°24' east 498 72 feet to the beginning of
a curve to the right, (2) easterly 865 29 feet along said curve
to the right with a radius 11711 16 feet, central angle 4"1' and
a chord of south 75°10' east 501 56 feet, (3) south 70°37' east
418 0 feet (4) south 67"29' east 368 66 feet (5) south 63°54"
east 367.95 feet to a point for a corner in the west boundary
line of a tract of land as described in Volume 1200, Page 462,
Exhibit "B" of the Deed Records of Denton County, Texas,
THENCE north 0"12' west along the west boundary line of said
tract a distance of 2579 08 feet to te northwest corner of said
tract, said point lying in the south boundary line of a county
road,
THENCE north 89°17' east along the north boundary line of said
tract same being the south boundary line of said county road, a
distance of 1444 17 feet to a point for a corner,
THENCE south 0"05' west a distance of 2255 94 feet to a point
for a corner,
THENCE west a distance of 15 feet to a point for a corner,
THENCE south 0"05' west a distance of 1724 77 feet to a point
for a corner said point lying 250 feet south of and perpen-
dicular to the centerllne of F M 426 (McKlnney Street),
THENCE westerly 250 feet south of and parallel to the centerllne
of F M 426 (McKlnney Street) the following courses and
distances; {1} north 53"43' west 444 06 feet to the beginning of
a curve to the left, (2) westerly 343 78 feet, central angle of
9°39' and a chord of north 58°32'30' west 407 02 feet, (3) north
67°29. west 339.34 feet, (4) north 70°37. west 393 20 feet, (5)
north 73"10' west 490 44 feet to the beginning of a curve to the
left, (6) westerly 828 34 feet along said curve to the left with
a radius of 11211 16 feet, central angle of 4"14' and a chord of
north 75"17' west 828 15 feet (7) north 77°24' west 402 88 feet
to a point for a corner in the west boundary line of the said M
Forrest Survey,
THENCE north along the west boundary line of said survey 509 10
feet to the place of beginning and containing 150 5 acres of
land, more or less
SECTION II
The above described property is hereby classified as
Agricultural "A" District and shall so appear on the official

amended accordingly
SECTION III
This ordinance shall be effective immediately upon
passage

PLAN OF SERVICE FOR ANNEXED AREA~ CITY OF ~ENTON~ TEXAS
WHEREAS, Article 970a as amended requzres that a plan of service
be adopted by the governmng body of a c~ty prior to passage of an ordinance
annexing an area, and
WHEREAS, the City of Denton ~s contemplating annexation of an
area which ~s bounded as shown on a map of the proposed annexation
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY
OF DENTON, TEXAS
Section 1 Pursuant to the provisions of Article 970a as
amended, Texas Code Annotated, there ~s hereby adopted for the proposed
annexation area the followzng plan of servzce
I Basic Service Plan
A Police
(1) Patrolling, radio responses to calls, and other
routine police services, using present personnel
and equzpment, w~ll be provided on the effective
date of annexation,
(2) Traffic s~gnals, traffic s~gns, street markings,
and other traffic control devkces w~ll be ~nstalled
as the need therefore zs established by appropriate
study and traffkc standards
B F~re
(1) Fire protection by the present personnel and equip-
ment of the fire fighting force, will be provided
on the effective date of annexation
C Water
(!) Water for domestic, commercial and ~ndustrlal use
w~±l be provided at c~ty rates, from ex~st~ng c~ty
l~nes on the effective date of annexation, and
thereafter from new llnes as extended in accordance
w~th article 13 06 of appendix A of the code of the
C~t) of Denton, Texas
D Sewer
(1) Properties ~n The annexed areas w~ll be connected
5o sewer l~es ~n accordance with article 13 06 of
appendix A of the code of the Catv of Denton, Texas
E Refuse Collection
(1) The same regular refuse collection ser~ce non pro-
vzded w~th~n the c~t~ w~ll be extended to the
annexed area w~th~n one month al%er the effective
date of annexation

F Streets
(1) Emergency maintenance of streets (repair of hazardous
chuckholes, measures necessary for traffic flow, etc )
will beg~n on the effective date of annexation
(2) Routine maintenance on the same basis as in the
present c~ty, will beg~n zn the annexed area on
the effective date of annexation
(3) Reconstruction and resurfaczng of streets, znstalla-
~lon o£ storm drainage facilzties, construction of
curbs and gutters, and other such major ~mprovements,
as the need therefore is determined by the governing
body, w~ll be accomplished under the established
policies of the c~ty
G Inspection Services
(1) Any ~nspectlon services now provided by the c~ty
(building, electr!cal, plumbing, gas, housing,
sanitation, etc ) w~ll beg~n in the ~nnexat~on area
on the effective date of annexation
H Planning and Zoning
(1) The Planning and Zoning jurisdiction of the c~ty
w~ll ex~end to the annexed area on ~he effective
da~e of annexation C~ty planning w~ll thereafter
encompass the annexed area
I Street L~ghting
(1) Street l~Eht~ng w~ll be installed ~n the substan-
tially developed areas ~n accordance w~th the
established policies of the czty
J Recreation
(1) Residents of the annexed area may use all ex~st~ng
recreational facilities, parks, etc , on the effec-
tive date of annexation The same standards and
policies now used ~n the present c~ty will be fol-
lowed zn expanding the recreational program and
facilities ~n the enlarged c~ty
K Electric D~strzbutton
(1) The c~ty recommends the use of Cmty of Denton for
electrmc power

L Miscellaneous
(1) Street name signs where needed will be installed
within approximately 6 months after the effective
date of annexation
II Capital Improvement Program (CIP)
The CIP of the City consists of a five year plan that is up-
dated yearly The Plan zs prlorzt~zed by such policy gu~de-
lines as
(1) Demand for services as compared to other areas
based partly on density of population, magnitude
of problems compared to other areas, established
technical standards and professional studies, and
natural or technical restraints or opportunities
(2) Impact on the balanced growth policy of the city
(3) Impact on overall clty economics
The annexed area will be considered for CIP planning in the
upcoming CIP plan, which will be no longer than one year from
the date of annexation In this new CIP planning year the
annexation area will be sudged accordingly to the same
established criteria as all other areas of the city
