1983-132AN ORDINANCE RELATING TO THE CONSUMPTION OF ALCOHOLIC BEVERAGES
IN MOTOR VEHICLES, PROVIDING PENALTIES AND DECLARING AN
EFFECTIVE DATE
THE COUNCIL OF THE CITY OF DENTON HEREBY ORDAINS
SECTION I
(a) It shall be unlawful for any person to knowingly and
intentionally transport, carry, possess, or have an open
container containing a usable quantity of an alcoholic beverage
(as defined in sectlon 1 04 (1) V T C A Alcoholic Beverage
Code) ~n or upon or about any motor vehlcle in or upon the
public h~ghways, roads, streets, alleys or sldewa±ks, w~thln the
Clty, except when such alcohollc beverage ~s in the orlg,nal
unopened contalner Provided however, that th~s Section shall
not apply to any alcoholic beverage that ~s locked in the trunk
of a motor vehicle or in some other areas of the vehicle not
normally occupied by the dr~ver or passengers if the vehicle ~s
not equipped w~th a trunk, ~n such a manner as to be
~naccess~ble from the lnter~or or to any person r~d~ng ~n such
vehicle
(b) If the actor knowlngly and intentionally possesses or
has ~n h~s or her possession an open container made for the
purpose of containing an alcoholic beverage and labeled as
containing an alcohollc beverage, ~t shall be presumed that any
content hereln ls an alcoholic beverage
(c) An offense under this secton ~s a Class C m~sdemeanor
SECTION II
Any person v~olatlng any of the provlslons of thls ordinance
shall, upon convlct~on, be f~ned a sum not exceeding Two
Hundred Dollars ($200 00), and each day and every day that the
provisions of th~s ordinance are v~olated shall constitute a

separate and d~stlnct offense Th~s penalty is in addition to
and cumulative of, any other remedies available at law and
equity
SECTION III
That th~s ordinance shall become e~fect~ve fourteen (14)
days from the ~ate of ~ts passage, and the C~ty Secretary ~s
hereby d~rected to cause the captlon of th~s ordinance to be
published twice in the Denton Record-Chronicle, the official
newspaper of the C~ty of Denton, Texas, w~thln ten (10) days of
the date of ~ts passage
