1983-127 AN ORDINANCE GRANTING A SPECIFIC USE PERMIT AND AMENDING TH~ ZONING MAP OF THE CITY OF DENTON, TEXAS, AS SAME WAS ADOPTED AS AN APPENDIX TO THE CODE OF ORDINANCES OF THE CITY OF DENTON, TEXAS, BY ORDINANCE NO 69-1, AND AS SAID MAP APPLIES TO APPROXIMATELY ONE ACRE IN SIZE BEING LOCATED ALONG THE NORTH SIDE OF SPENCER ROAD, APPROXIMATELY 404 FEET WEST OF LOOP 288, AS SHOWN ON THE TAX RECORDS OF £HE CITY OF DENTON, TEXAS, AND DECLARING AN EFFECTIVE DATE THE COUNCIL OF THA CITY OF DENTON, TEXAS, HEREBY ORDAINS SECTION I The Zoning Classification and Use designation of the following described property, to-w~t WHEREAS, WE, R~chard B Cushman et ux, Carolyn $ Cushman, are the owners of a 1 00 acre tract ~n the Mary Austin Survey, Abstract 4, City and County of Denton, Texas, being part of a certain (called) 8 00 acre tract in the M Austin Survey as described in a deed recorded in Volume 1280, Page 650, dated June 23, 1983, Deed Records of sa~d County ana being more fully described as follows COMMENCING at a point ~n the North right-of-way of Spencer Road, same being the Southwest corner of a 20 130 acre tract described In a deed from W V Tunn~cl~ff, ~rustee, to Denton County Electric Coop , Inc , on August 15, 1973, recoraed ~n Volume 682, Page 615, Deed Records of Denton County, Texas, THENCE S 86°58'40" E w~th the North r~ght-of-way of Spencer Road a d~stance of 60 17 feet to a steel p~n at the place of beglnnlng, THENCE N l°15'10'' W a distance of 436 81 feet to a steel p~n, THENCE S 86°58'40"E a d~stance of 100 00 feet to a steel pln, THENCE S l°15'10'' E a distance of 436 81 feet to a steel pin in the North boundary l~ne of Spencer Road, THENCE N 86°58'40'' W with the North line of Spencer Road a d~stance of 100 0 feet to the place of beginning and containing · n all 1 000 acre of land which is classlf~ed as a Commercial Dlstr~ct Classification Use under the Comprehensive Zonlng Ordinance of the City of Denton, Texas is hereby changed and a Speclflc Use Permit is hereby granted for the use of sa~d property for a mobile home, subject to the following special conditions and restrictions, to-wit 1 The lot must have city plat approval 2 Only one mobile home shall be on the lot 3 The specific use permit shall explre ~n three years in addlt~on to all uses authorized ~n a Commer~cal D~strlct The development of the property shall be in substantial compliance w~th the s~te plan attached hereto and made a part hereof for all purposes The Zoning Map of the City of Denton, Texas, adopted the 14th day of January, 1969, as an Appendix to the Code of Ordinances of the C~ty of Denton, Texas under Ordinance No 69-1, be, and the same ~s hereby amended to s~ow such change in D~str~ct Classification and Use PAGE ONE SECTION II That the C~ty Council of the City of Denton, Texas hereby finds that such change ~s in accordance with a comprehensive plan for the purpose of promoting the general welfare of the City of Denton, Texas, and w~th reasonable consideration, among other th~ngs for the character of the district and for its peculiar suitability or particular uses, and with a view to conservzng the value of the bu~ldlngs, protecting human llves, and encouraging the most appropriate uses of land for the maximum benefit to the City of Denton, Texas, and its citizens SECTION III That this ordinance shall be in full force and effect lmmedlately after its passage and approval, the required public hearings havlng heretofore been held by the Plannlng and Zoning Commission and the C~ty Councll of the C~ty of Denton, Texas, after g~v~ng due notice thereof PASSED AND APPROVED th~s the /5~%ay of ~/94~/Y~D~., 1983 CITx OF D~NTON, TEXAS ATTEST CHARLOTTE ALLEN, CITY SECRETARY CITY OF DENTON, TEXAS APPROVED AS TO LEGAL FORM C J TAYLOR, JR , CITY ATTORNEY CITY OF DENTON, TEXAS PAGE TWO
