1983-103 NO AN ORDINANCE PROVIDING FOR THE ABANDONMENT OF A UTILITY EASEMENT WITHIN THE CITY OF DENTON AND AUTHORIZING THE MAYOR TO EXECUTE A QUITCLAIM DEED CONVEYING ALL RIGHT, TITLE AND INTEREST OF THE CITY IN SAID EASEMENT TO THE OWNER OF THE TRACT OF LAND CONVEYED BY SAID EASEMENT, AND DECLARING AN EFFECTIVE DATE WHEREAS, the City Council of the City of Denton, acting pursuant to law, and upon the request and petition of the grantee herein, deems it advisable to abandon and convey the hereinafter described tract of land to grantee and is of the opinion that said utility easement is not needed for public use, and that same should be abandoned an~ qultclalmed to Russell Trapp, as hereinafter provided, and WHEREAS, the City Council of the City o~ Denton is of the opinion that the best interest and welfare of the public will be served by abandoning and conveying the same to Russell Trapp, for the consideration hereinafter more fully set forth, now, therefore, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF DENTON SECTION I That the following described tract of land in the City of Denton be and the same is hereby abandoned, vacated and closed insofar as the right, title and easement of the public are concerned All that certain 0 0634 acre tract, or parcel of land situated in the Robert Beaumont Survey, Abstract No 31, Denton County, Texas and being the 16 foot drainage and utility easement shown on Lot 6A, Oakhlll Addition, Section Two, Denton, Texas, as shown by plat recorded in Cabinet B, File 191 of the Plat Records of Denton County, Texas, and being more particularly described by metes and bounds as follows BEGINNING at the southwest corner of said Lot 6A, Block A, Oakhlll Addition Section Two, THENCE north 36°08'39'' east 172 68 feet to a point in the north line of said lot, same being the south right of way of Headlee Street, THENCE south 87°05'30'' east 19 129 feet with Headlee Street to corner, THENCE south 36°08'39'' west 172 68 feet to corner, THENCE north 87"5'30'' east 19 129 feet to the place of beginning and containing 0 0634 acres of land SECTION II That the Mayor and City Secretary are hereby authorized to execute and deliver that certain quitclaim deed attached hereto and incorporated herein conveying said utility easement described therein to Russell Trapp RUSSELL TRAPP/OAK HILL ADDITION-PAGE 1 SECTION III That portion of the public utility easement herein described being vacated, abandoned, and closed ~s made sub3ect to all existing zonlng regulatlons and deed restrictions, if any, and sub3ect to all existing easement r~ghts of others, if any, whether apparent or not SECTION IV Thls ordinance shall take effect and be in full force and effect from and after the date of ~ts passage, and it ~s so ordained PASSED AND APPROVED by the Clty~Counc~l of the C~ty of Denton, Texas, th~s the ~d~A-day of ~, 1983 'CITY OF DE~TON, TEXAS ATTEST Ch~ARLOTTE ALLEN, CITY SECRETARY CITY OF DENTON, TEXAS APPROVED AS TO LEGAL FORM C J TAYLOR, JR , CITY ATTORNEY CITY OF DENTON, TEXAS RUSSELL TRAPP/OAK HILL ADDITION-PAGE 2 THE STATE OF TEXAS, } KNOW ALL MEN BY THESE PRESENTS COUNTY OF DENTON That The City of Denton, Texas, a Munlcmpal Corporation of the County of Denton and S~ate of Texas , for and m consideration of the sum of .............................................................. ..................
