ORDINANCES PROVIDING FOR ELECTRIC UTILITY RATES, PROVIDING A
SEVERABILITY CLAUSE AND DECLARING AN EFFECTIVE DATE
THE COUNCIL OF THE CITY OF DENTONw TEXAS, HEREBY ORDAINS
That Section 25-21 of Chapter 25 of the Code of Ordinances
of the City of Denton, Texas, is hereby amended to read as
follows
ARTICLE II ELECTRIC SERVICE
Section 25-21 Rate Schedule
The rates to be charged by the City for electricity are
hereby established as follows
(A) RESIDENTIAL SERVICE RATE
(SCHEDULE R-l)
APPLICATION
Applicable to all electric service used for residential
purposes in a single family dwelling or an lndlvlOually metered
apartment, supplied at one point of delivery and measured
through one meter where usage ls not In excess of 700 KWH per
30-day month during the bllllng months MAY through OCTOBER If
usage in any such month exceeds 700 KWH, bllllng w~ll be
rendered that month under Rate Schedule R-2 and thereafter for a
period extending through the 12 billing months of the next year
ending with the October billing Annually, in November, the
customer may again qualify for the R-1 rate provided that
consumption has not exceeded 700 KWH per 30-day month during the
previous slx summer months
Where individual dwelling units are being served through the
same meter as of the effective date of this rate schedule and
the K~H in the billing months of MAY through OCTOBER exceed 700
KWH tlmes the number of dwelling units, the b~lllng for that

TYPE OF SERVICE
Primary voltage service (transformation equipment owned by
customer) is available to any customer with a 12-month m~n~mum
monthly demand of 750 KW or greater Any customer which meets
all criteria as a primary service customer except minimum
demand; and who is classed as a primary service customer on the
date of the passage of this ordlnance, and who contlnuously
accepts service as a primary service customer may continue
within th~s rate class Primary service rendered at one point
on the customer's premises at a nominal voltage of 13,200 volts
or 69,000 volts three-phase at the option of the utility
The primary voltage service customer shall own, operate, and
maintain all facilities necessary to receive three phase primary
voltage service and all transformation facilities required for
conversion to utilization voltage The Utility shall own,
operate and maintain all metering facilities, either at primary
or secondary voltage, at the Utll~ty's option Where the
Utility elects to meter at secondary voltage, two percent shall
be added to the demand charge, the energy charge and the energy
cost ad3ustment charge to account for transformer losses

DETERMINATION OF DEMAND
The demand shall be the KW supplied during the 15-minute
per~od of maximum use during the current month as determined by

below ninety percent, the demand for billing purposes will be
determined by multiplying the uncorrected KW billing demand by
90% and dividing by the determined power factor
SPECIAL FACILITIES
All services which require special facilities in order to
meet customer's service requirements shall be provided subject
to the special facilities rider

TYPE OF SERVICE
The City shall furnish, install, maintain and deliver
electric service to automatically controlled, mercury or sodium
vapor lighting fixtures conforming to the utlllty's standards
and sub3ect to its published rules and regulations
Where necessary for proper illumination or where existing
poles are inadequate, the City wall install or cause to be
~nstalled, one (1) pole for each ~nstalled light, at a d~stance
not to exceed eighty (80') feet from said existing lanes, at no
charge to the customer Each additional pole span shall not
exceed a span spacing of one hundred (100') feet Additional
poles required to install a light in a customer's specifically
desired location, and not having a light installed on same,
shall bear the cost

TERM OF CONTRACT
A two (2) year contract shall be agreed to and signed by each
customer desiring Dusk-to-Dawn Lighting Service authorizing
fixed monthly charges, which may be reviewed annually, and to be

that a customer desired the removal of the unit or
discontinuance of the servlce prior to completion of two (2)
years, the remainder of the contract per~od shall become due and
payable After the end of the initial two (2) year contract,
service shall continue on a month-to-month basis and may be
cancelled by either party upon thirty (30) days notice

Should the power factor so determined be below ninety (90%)
percent, the demand for billing purposes will be determined by
multiplying the uncorrected KW billing demand by ninety (90%)
percent and dlvldlng by the determined power factor
SPECIAL FACILITIES
All service which requires special facilities in order to
meet the customer's service requirements shall be provided

MINIMUM BILLING

TYPE OF SERVICE
Primary voltage service (transformation equipment owned by
customer) is available to any customer with a 12-month minimum
monthly demand of 750 KW or greater Primary service rendered
at one point on the customer's premises at a nominal voltage of
13,200 volts or 69,000 volts three-phase at the option of the
utility
The primary voltage service customer shall own, operate, and
maintain all facilities necessary to receive three phase primary
voltage service and all transformation facilities requlred for
converslon to utilization voltage The Utll~ty shall own,

operate and maintain all metering facilities, either at primary
or secondary voltage, at the Utll~ty's option Where the
Utility elects to meter at secondary voltage, two percent shall
be added to the demand charge, the energy charge and the energy
cost adjustment charge to account for transformer losses
DETERMINATION OF DEMAND
The demand shall be the KW suppl~ed during the 15-m~nute
perlod of maximum use during the current month as determined by
City's demand meter, but not less than 70% of the maximum KW
s~m~larly determined during the previous billing months of MAY
through OCTOBER ~n the 12 months ending w~th the current month,
nor LESS than 750 KW
CONDITIONS OF INTERRUPTION
The Utlllty shall not~fy the customer by telephone at least
thirty (30) m~nutes prior to the time at which the load ~s
required to be curtailed The request shall be for all or part
of the customer's load exceeding 5,000 KVA The maximum per~od
of ~nterrupt~on shall be for slx hours The ~nterrupt~on shall
be at the request of the Utility during the periods when a
potential forced outage could deny power to other customers or
when available sp~nn~ng reserves are threatened The customer
shall respond by stating he w~ll or w~ll not comply w~th the
Utll~ty's request w~th~n f~fteen (15) m~nutes after not~flcat~on
POWER FACTOR REQUIREMENTS AND ADJUSTMENTS
The Utility reserves the rlght to make tests to determine the
power factor of the user's ~nstallat~on served hereunder during
per~ods of maxlmum demand for the monthly blll~ng per~ods
Should the power factor so determined be below n~nety (90%)
percent, the demand for bxll~ng purposes w~ll be determined by

Theft of Service
APPLICATION
The mlnlmum charge of $100 00 will be made for any lncldence
of tampering with the meter ~nstallat~on, ~nterference with the
proper work*ng thereof, any theft of servlce by any person on
customer premlses, or evidence of such tampering, lnterferr~ng
or theft (energy d~vers~on) The mlnlmum charge shall be
imposed for the detect~on and conf~rmat~on of energy d~verslon
In addition, the customer shall pay the reconnect charge of
$15 00, the expense to or replacement of the Ut~llty's equlp-
ment, and the estimated cost of power and energy not recorded on

2 The per unit charge (S/KWH and S/KW) shall not be more to
the ultimate customer than is charged by the City to the
original customer No Facll~ty charge or other pro-rata charge
shall be rendered as part of the electric sub-metering billing
3 Measurement devices (meters) must have an accuracy of +
2 0% and be tested upon request by the ultimate customer-
Interval between tests without charge to the customer is one
year Cost of tests shall not be more than charged by the City
under its ordinance In cases where the metering is found to be
inaccurate, the ultimate customer shall be billed or credited
for the prior 24 months usage
4 Billing dates of ultimate customers shall be within three
(3) working days of the date used by the City for the City
b~lllng of the original customer
5 Records shall be maintained on site for lnspectlon/verlf~-
cation Dy the City and/or the ultimate customer for the
preceedlng twelve (12) months
6 Violation of any section of this ordlnance shall be
punishable by a maximum fine of $100 per day per offense
Service Deposits
APPLICATION
Applicable when a customer requests service for the first
time ~n the Denton electric service area
RATE
A customer will make a deposit of $150 00 or an amount equal
to 1/6 of the last twelve (12) months billings at the meter
location, whichever ~s less
WAIVER OF DEPOSIT
Deposlt is not requlred if the customer has a good credit
standing for utility servlce with the City of Denton or other
electrlc utility system for the twelve (12) months prior to
application for service with the City of Denton
Deposit will not be required in the event a customer has a
co-signer who meets the above criteria
REFUND OF DEPOSIT
Deposlt will be held untll customer has completed twelve (12)
continuous months w~th a good credit standing with the City of
Denton Utility At such t~me, or upon closing the account, a
refund of entire deposit plus any accrued ~nterest w~ll be made
Special Facilities R~der
1 Applicability
All service shall be offered from available fac~llties If a
customer service characteristic requires facilities and devices
which are not normally and readlly available at the location at
which the customer requests service, then the Utility shall
provide the service subject to paragraph 2 of this schedule

2 The total cost of all facilities required to meet the
customer's load characteristics which are incurred by the
Utility shall be sub3ect to a special contract entered into
between the Utility and the customer Thls contract shall be
signed by both partles prior to the Utility providing service to
the customer
PART II
That Chapter 25, Article II "Electric Service", Section 21 of
the Code of Ordinances of the City of Denton, Texas ~s hereby
repealed
PART III
That if any section, subsection, paragraph, sentence, clause,
phrase or word ~n th~s ordinance, or applicatIon thereof to any
person or c~rcumstances ~s held ~nval~d by any court of competent
jurisdiction, such holding shall not affect the validity of the
remaining portions of this ordinance, and the C~ty Council of
the C~ty of Denton, Texas, hereby declares ~t would have enacted
such remaining portions despite any such ~nval~dlty

That this ordinance shall become effective thirty (30) days
from the date of its passage, October ~,~'-1983, and the Clty
Secretary ~s hereby d~rected to cause the caption of this
ordinance to be published twice ~n the Denton Record-Chronicle,
the official newspaper of the C~ty of Denton, Texas, wlth~n ten
(10) days of the date of ~ts passage
