AN ORDINANCE GRANTING A SPhCIFIC USE PERMIT AND AMENDING THE
ZONING MAP OF THE CITY OF DENTON, rEXAS, AS SAME WAS ADOPTED AS
AN APPENDIX TO THE CODE OF ORDINANCES OF rHE CITY OF DhNTON,
TEXAS, BY ORDINANCE NO 69-1, AND AS SAID MAP APPLIES fo 704
AUDRA LANE IN THE CITY AND COUNTY OF DENTON, TEXAS, AND
DECLARING AN EFFECTIVh DATE
THE COUNCIL OF THh CITY OF DEN/ON, IEXAS, HEREBY ORDAINS
SECTION I
The Zoning Classification and Use designation of the follow-
lng described property, to-wit
Ali that certain tract or parcel of land situated in the T M
Downing Survey, Abstract 346, City and County of Denton, Texas,
being part of a {called) 19 5 acre tract described in a deed to
R P Denton, et ux from W M Flncher, et al and recorded in
Volume 346, Page 505, Deed Records and part of a {called) 5 58
acre tract described in a Deed of Trust to barl J Smith,
Trustee for North Texas Savings and Loan Association recorded in
Volume 245, Page 294, Deed of Trust Records of Denton County,
Texas, and being more fully described as follows
BEGINNING at the northwest corner of a 19 5 acre tract in the
east line of Audra Lane,
THENCH east along the north line of said 19 5 acre tract a
distance of 100 feet to a corner,
THENCE south a distance of 165 0 feet to a corner in the center
of an east-west street,
THENCE west along the center of a 50 foot wide street a distance
of 290 95 feet to a corner in the east line of Audra Lane,
THENCE north 49°10' east along the east line of Audra Lane a
distance of 252 $5 feet to the place of beginning
which is classified as Single Family "SF-7" District Classifi-
cation Use under the Comprehensive Zoning Ordinance of the City
of Denton, Texas is hereby changed and a Specific Use Permit is
hereby granted for the use of said property as a day care
center, sub3ect to the following conditions and restrictions
to-wit
1 Prior to issuance of a certificate of occupancy, a
minimum of seven (7} onslte asphalt or concrete
parking spaces shall be provided using C~ty of
Denton standards for 90° angle parking Asphalted
or concreted maneuvering area and a 24 foot drive
shall also be provided
2. A permanently maintained six {6) foot solid wood
fence shall be erected along the east and north
property lines

A maximum of thxrty-four (34) children shall be
accommodated
4 No detached szgns shall be permitted
S The zoning shall revert to szngle family
the day care center ~s not developed w~th~n three
(3) years
The development of the property shall be [n substantial
compliance with the site plan attached hereto and made a part
hereof for all purposes
The Zoning Hap of the City of Denton, Texas, adopted the
14th day o£ January, 1969, as an Appendix to the Code of
Ordinances of the City of Denton, Texas under Ordinance No
69-1, be, and the same [s hereby amended to show such change
District Classification and Use

That the C~ty Council of the City of Denton, Texas hereby
finds that such change ~s ~n accordance w~th a comprehensive
plan for the purpose of promoting the general welfare of the
C~ty of Denton, Texas, and with reasonable cons~deratzon, among
other th~ngs for the character of the d~str~ct and for ~ts
peculiar suitability or particular uses, and with a wew to
conserwng the value of the buildings, protecting human l~ves,
and encouragzng the most appropriate uses of land for the
maximum benefit to the City of Oenton, Texas, and ~ts c~t~zens
SECTION III
That this ordinance shall be ~n full force and effect
~mmedlately after ~ts passage and approval, the required public
hearings hawng heretofore been held by the Planning and Zoning
Commission and the C~ty Council of the C~ty of Denton, Texas,
after g~v~ng due not~ce thereof
