1983-076AN ORDINANCE REPEALING AND REENACTING SECTION 24-136 O~ ARTICLE V) CHAPTER 24 OF THE CODE OF ORDINANCES OF fHE CITY OF DENTON, TEXAS, RELATING TO PARKING ON PUBLIC PROPERLY FOR DISABLED PERSONS, DESIGNATING WHERE SUCH PARKING IS SO REbFRILTED, PROVIDING A PENALTY OF A FINE OF NOr LESS THAN ~IFTY DOLLARS NOR MORE fHAN TWO HUNDRED DOLLARS, PROVIDIN6 A SEVkRABILITY CLAUSE AND DECLARING AN B~FECTIVB DATE THE COUNCIL OF THE CITY OF DENTON HEREBY ORDAINS SECTION I That Section 24-136 of Chapter 24, Artxcle V of the Code of Ordinances of the City of Denton, Texas, xs hereby repealed and reenacted in its entirety, to read as follows Section 24-136 DESIGNATION OF PARKING SPACES FOR EXCLUSIVE USE OF DISABLED PERSONS UPON PUBLIC PROPERTY (a) When signs are erected giving notice thereof, no person shall, at any time, stop, stand, park, or leave standing any vehicle not displaying a specially designed symbol, tab, or other device Issued by the Texas State Department of Highways and Public Transportation affixed to the license plates of such vehicle indicating the owner thereof or a passenger there~n ~s permanently disabled or any vehicle not displaying an identification card issued by said Department indicating the operator of such vehicle or a passenger therein is temporarily disabled, at any of the following places, to-wit (1) One (1) parallel parking space adjacent to the elevator entrance to the F~rst Methodist Church on Mulberry Street, (2) One (1) parallel parking space adjacent to the elevator entrance to the Texas Building on Locust Street (3) One (1) 45 degree angle parking space on Elm Street in front of the premises located at 115 North Elm Street, (4) One (1) 45 degree angle parking space on Hickory Street in front of the premises located at 151 West H~ckory Street, (5) One (1) 45 degree angle parking space in the middle of the 100 block of North Elm Street adjacent to the curb ramp, PAGE ONE (6) One (1) 45 degree angle parking space in the middle of the 100 block of North Locust Street, (7) Two (2) parallel parking spaces in the parking lot of the Denton C~vlc Center near the handicapped access ramp, (8) Three (3) parking spaces at the Denton Senior Center, 509 North Bell street, on the north side of the building and adjacent to the access ramp, (9) Two (2) parking spaces at the Texas hmployment Commission, Sl0 I-Hwy 35~, in front of the access ramp leading to the entrance of the building (10) One (1) parking space nearest the handicapped access ramp at the Denton Public Library, (11) One (1) parking space adjacent to the hand~- capped access ramp at the southwestern entrance to the Municipal Building at 215 ~ McK~nney Street in the U S Post Office/Municipal Parking Lot, (12) One (1) parking space at Mack Park on the south s~de of McK~nney Street adjacent to the side- walk leading to the tennis courts, (13) One (1) parking space at Mack Park on the north side of McKlnney Street adjacent to the sidewalk leading to the park's concession stand, (14) Two (2) parking spaces at North Lakes Park nearest the access ramp and entrance to said park, (15) Two (2) parking spaces adjacent to the handicapped access ramp at Denla Park (b) The provisions of th~s section prohibiting the parking of unauthorized vehicles shall apply at all times to the parking space and any part of the parking space as designated herein except when ~t is necessary to stop a vehicle to avoid conflict w~th other traffic or in compliance with the direction of a police officer or official traffic control device (c) Any person adjudged qullty of parking a vehicle in wolat~on of th~s ordinance shall be qullty of a misdemeanor and punished by a f~ne of not less than Fifty Dollars ($50 00) nor more than Two Hundred Dollars ($200 00) PAG~ TWO SECT ION I I That ~f any section, subsection, paragraph, sentence, clause, phrase or word in this ordinance, or application thereof to any person or circumstance ~s held ~nval~d by any court of competent jurisdiction, such holding shall not affect the validity of the remaining portions of th~s ordinance, and the C~ty Council of the C~ty of Denton, Texas, hereby declares ~t would have enacted such remaining portions despite any such ~nval~d~ty bECTION III That th~s ordinance shall become effective fourteen (14) days from the date of ~ts passage, and the C~ty Secretary ~s hereby directed to cause the caption of th~s ordinance to be published twice ~n the Denton Record-Chronicle, the official newspaper of the C~ty of Denton, Texas, w~th~n ten (10) aays of the date of ~ts passage PASSED AND APPROVED th~s the J~ day of~ ' LITY OF P~rON, fhXAS ATTEST CITY OF DENTON, TEXAS APPROVED AS TO LEGAL FORM C J TAYLOR, JR , CITY ATTORNEY CITY OF DENTON, TEXAS PAGE THREE
