1983-075AN ORDINANCE REPEALIN6 AND REENACTING SECTIONS 24-134 AND 24-135 OF CHAPTER 24, ARTICLE V OF THE CODE OF ORDINANCES OF THE CITY OF DENTON, TEXAS, RELATING TO PARKING ~OR DISABLED PERSONS, PROVIDING FOR THE MARKING OF PARKING SPACES FOR DISABLED PERSONS, PROVIDING FOR THE EXCLUSIVE USE OF SUCH SPACES BY VEHICLES WITH SPECIAL LICENSE PLATE DEVICES OR IDENTIFICAFION CARDS ISSUED BY IHE TEXAS STATE DEPARTMENT OF HIGHWAYS AND PUBLIC TRANSPORTATION FOR DISABLED PERSONS, PROVIDING A PENALLY OF A FINE OF NOT LESS THAN FIFTY DOLLARS NOR MORE FHAN TWO HUNDRED DOLLARS, PROVIDING A SEVERABILITY CLAUSE, AND DECLARING AN EFFECTIVE DATE THE COUNCIL OF THE CITY OF DENfON HEREBY ORDAINS SECTION I That Section 24-134 o~ Chapter 24, Article V of the Code of Ordinances of the City of Denton, ~exas, is hereby repealed and reenacted xn its entirety to hereafter as follows Section 24-134 DESIGNATION OF PARKING SPACES FOR DISABLED PERSONS (a) A person who owns or controls property used for parking may designate one or more parking spaces for the exclusive use of vehicles transporting temporarxly or permanently disabled persons Such parking spaces shall be designated by posting immediately adjacent to and visible from each space a nonmovable s~gn that (1) has a notice of the penalty for a violation of Section 10, Article 667Sa-Se 1, Vernon's Texas Civil Statutes, (2) ~s permanently mounted on a pole at least f~ve feet in height, (3) has a profile view of a wheelchair with an occupant in white on a blue background, and (4) meets the design criteria established by the Texas State Department of Highways and Public Transportation (b) Illustrations of sign design criteria of the Texas State Department of Highways and Public lransportatlon is depicted by Figures 1 as follows [Instructions to the Editor Insert F~gure 1 attached hereto and ~ncorporated here~n by reference ] SECTION II That Section 24-135 of Chapter 24, Article V of the Code of Ordxnances of the C~ty of Denton ~s hereby repealed and reenacted ~n it entirety ato hereafter read as follows Section 24-135 PARKING OF UNAUTHORIZED VEHICLES IN SPACES DESIGNATED FOR DISABLED PERSONS PROHIBITED, PENALTY (a) It shall be unlawful for any person, f~rm, or corporation to stop, stand, park or leave stand~ng any vehicle not d~splay~ng a specially designed symbol, tab, or other device ~ssued by the Texas State Department of H~ghways and Public Transportation affixed to the l~cense plates of such vehicle ~nd~cat~ng the operator thereof or a passenger there~n ~s permanently d~sabled nor any vehicle not d~splay~ng an ~dentxf~catxon card xssued by the Department xnd~catxng the operator of such vehxcle or a passenger therexn xs temporarxly dtsabled xn any parking space desxgnated as exclusxve parkxng for d~sabled persons pursuant to Sectton 24-134 of thxs Article (b) Any person adjudged guilty of parkxng a vehicle ~n v~olat~on of thxs ordinance shall be guxlty of a m~sdemeanor and punished by a f~ne of not less than Fxfty Dollars ($50 00) nor more than Two Hundred Dollars ($200 00) SECTION III That ~f any section, subsection, paragraph, sentence, clause, phrase or word ~n th~s ordinance, or applicatIon thereof to any person or c~rcumstance ~s held ~nval~d by any court of competent jurisdiction, such hold~ng shall not affect the validity of the remaining portions of th~s ordinance, and the C~ty Council of the C~ty of Denton, Texas, hereby declares ~t would have enacted such remaining portions despite any such ~nvalld~ty SECTION IV That th~s ordinance shall become effective fourteen (14) days from the date of ~ts passage, and the C~ty Secretary ~s PAGE 2 hereby directed to cause the caption of th~s ordinance to be published twice ~n the Denton Record~Chronicle, the official
