1983-068AN ORDINANCE GRANTING A SPECIFIC USE PERMIT AND AMENDING THE ZONING MAP OF THE CITY OF DENTON, TBXAS, AS SAME WAS ADOPTED AS AN APPENDIX TO THE CODE OF ORDINANCES OF THE CITY OF DENTON, TEXAS, BY ORDINANCE NO 69-1, AND AS SAID MAP APPLIES TO LOT 2, BLOCK 1, BARB ADDITION, R BEAUMONT SURVEY, ABSTRACT NO 31, CITY AND COUNTY OF DENTON, TEXAS, AND DECLARING AN EFFECTIVE DATE THE COUNCIL OF THE CITY OF DENTON, TEXAS, HEREBY ORDAINS SECTION I The Zonxng Classxfxcatxon and Use deslgnatxon of the follow- lng described property, to-wit Ail that certain lot, tract or parcel of land lying and being sxtuated in the City and County of Denton, State of Texas, and being known as Lot 2, Block 1 of the Barb Addition, R Beaumont Survey Abstract No 31 and also known as 519 and 529 Bolivar Street (First Church of the Nazarene) in the City of Denton, Texas which is classified as Planned Development "PD" District Classi- fication Use under the Comprehensive Zoning Ordinance of the City of Denton, Texas is hereby changed and a Specxflc Dse Permit is hereby granted for the use of sa~d property for a day care center, subject to the following conditions and restrictions to-wit 1 The maximum number of children to be accommodated shall not exceed 116 2 The development shall conform to the approved PD concept plan 5 Paved parkxng and all other applicable development code, fire code, building code and zoning ordinance requirements shall be met prior to issuance of a certificate of occupancy 4 A slx (O) foot solid wooden fence shall be erected along the west and south property lines, the fence on the east property line shall be in accordance with State of Texas regulations for day care centers 5 The zoning shall revert to two family (2-P) if the center use is not developed within three day care (5 years The development of the property shall be xn substantial compli- ance w~th the site plan attached hereto and made a part hereof for all purposes S-169/WESLEY A DAVIS/PAGE 1 The Zoning Map of the City of Denton, ~exas, adopted the 14th day of January, 1969, as an Appendix to the Code of Ordinances of the C~ty of Denton, Texas under Ordinance No 69-1, be, and the same is hereby amended to show such change ~n D~str~ct Classification and Use SECTION II That the C~ty Council of the C~t¥ of Denton, Texas hereby f~nds that such change ~s ~n accordance w~th a comprehensive plan for the purpose of promoting the general welfare of the City of Denton, Texas, and w~th reasonable consideration, among other things for the character of the d~str~ct and for ~ts peculiar suitability or particular uses, and w~th a wew to conserving the value of the buildings, protecting human l~ves, and encouraging the most appropriate uses of land for the maxmmum benefit to the C~ty of Denton, Texas, and ~ts c~t~zens SECTION III That th~s ordinance shall be ~n full force and effect ~mmed~ately after ~ts passage and approval, the required public hearings having heretofore been held by the Planning and Zoning Commission and the C~ty Council of the City of Denton, Texas, after g~wng due not~ce thereof - ~IC~-ARD 0-~ STBWAIYr, MAYOR- GITI OF DENTON~ TEXAS CITY OF DENTON, TEXAS APPROVED AS TO LEGAL FORM C J TAYLOR, JR , CITY ATTORNEY CITY 0F DENTON, TEXAS S-169/~ESLEY A DAVIS/PAGE 2
