1983-062AN ORDINANCE AMENDING THE ZONING MAP OF THE CITY OF DENTON, TEXAS, AS SAME WAS ADOPTED AS AN APPENDIX TO THE CODE OF ORDINANCES OF THE CITY OF DENTON, TEXAS, BY ORDINANCE NO 69-1, AND AS SAID blAP APPLIES TO APPROXIMATELY 6 264 ACRES OF LAND OUT OF THE T M DOWNING SURVEY, ABSTRACT NO 346, DENTON COUNTY, TEXAS, AND MORE PARTICULARLY DESCRIBED HEREIN, AND DECLARING AN EFFECTIVE DATE THE COUNCIL OF THE CITY OF DENTON, TEXAS, HEREBY ORDAINS SECTION I The Zoning Classification and Use designation of the follow- lng described property, to-wit Ail that certain tract or parcel of land situated in the T M Downing Survey, Abstract No 346, Denton County, Texas, being the same tract as described in a deed from Richard Parker Denton, et ux to James E Angel, et ux and David N Morris, et ux on January 13, 1971 and recorded in Volume 615, Page 80, Deed Records of said County, and being more particularly described as follows BEGINNING at a 2 inch iron pipe in Miller Road at the northeast corner of the abovementloned tract, THENCE south 0°05'S1'' west with the east boundary line of said tract 707 74 feet to a steel pin near an east-west fence, THENCE north 86°04' west along and near a fence 31Z 23 feet to a steel pin in a fence, THENCE north with the west boundary l~ne of sa~d tract 686 5 feet to a steel pin, ~HhNCE south 89°S8' east 312 7 feet to the place of beginning and containing in all 4 995 acres of land ~s hereby changed from Agricultural "A" District Classification Use to Planned Development "PD" District Classification and Use under the Comprehensive Zoning Ordinance of the City of Denton, Texas in accordance with the attached site plan The Zoning Map of the City of Denton, Texas, adopted the 14th day of January, 1969, as an Appendix to the Code of Ordinances of the City of Denton, Texas, under Ordinance No 69-1, be, and the same is hereby amended to show such change in D~strlct Classification and Use subject to the attached s~te plan SECTION II That the City Council of the C~ty of Denton, Texas, hereby finds that such change is ~n accordance with a comprehensive plan for the purpose of promoting the general welfare of the City of Denton, Texas, and with reasonable consideration, among other things for the character of the district and for ~ts peculiar suitability or particular uses, and w~th a view to conserving the value of the buildings, protecting human lives, and encouraging the most appropriate uses of land for the maximum benefit to the City of Denton, Texas, and ~ts c~t~zens Z-1582/RICHARD COMPTON/PAGE 1 S~CTION III That this ordinance shall be ~n full force and effect ~mmed~ately after ~ts passage and approval, the required public hearings hawng heretofore been held by the Planning and Zoning Commission and the City Council of the C~ty of Denton, Texas, after glvxng due not~ce thereof PASSED AND APPROVED th~s the r~/~day of ~~_~_, 1983 ATTBST CITY OF DENTON, T~XAS APPROVED AS TO L~GAL FORM C J TAYLOR, JR , CITY ATTORNEY CITY OF DBNTON, TBXAS Z-1582/RICHARD COMPTON/PAGB 2
