1983-061 NO AN ORDINANCE AMENDING THE ZONING MAP OF IHE CITY OF DENTON, TEXAS, AS SAME WAS ADOPTED AS AN APPENDIX TO THE CODE OF ORDINANCES OF THE CITY OF DENTON, TEXAS, BY ORDINANCE NO 69-1, AND AS SAID MAP APPLIES TO APPROXIMATELY 1 42 ACRE OF LAND BEING KNOWN AS LOTS 1, 2, 3, 4, 5, 6 AND 7, BLOCK 1, WINDSOR PLACE ADDITION, AN ADDITION TO THE CITY OF DENTON, DENTON COUNTY, TEXAS, AND MORE PARTICULARLY DESCRIBED HEREIN, AND DECLARING AN EFFECTIVE DATE THE COUNCIL OF THE CITY OF DENTON, TEXAS, HEREBY ORDAINS SECTION I The Zoning Classification and Use designation of the follow- lng described property, to-wit Ail that certain lot, tract or parcel of land s~tuated in the City of Denton, Denton County, Texas, and also being Lots 1, 2, 3, 4, S, 6 and 7, Block 1, Windsor Place Addition, an addition to the City of Denton, Texas is hereby changed from Single-Family "SF" Dlstrlct Classifica- tion Use to Planned Development "PD" District Classification and Use under the Comprehensive Zoning Ordinance of the City of Denton, Texas with the following conditions, specifications, and subject to the attached site plan 1 The development shall conform with the approved concept plan and all applicable City of Denton zoning ordinance requirements, subdivision regula- tions and development and building codes prior to issuance of building permits, The architectural style of the buildings shall be compatible and consistent with that of the abutting Benchmark Villas development to the east, A twenty-five (25'} foot setback shall be observed off W~ndsor Dlrve, 4 Sidewalks acceptable to the c~ty engineering staff shall be installed along the north frontage of the exlstng Benchmark Villas development as well as the site proposod ~n this planned development request, and S If required for drainage purposes and recommended by the city engineer, a slx (6') foot sol~d masonry wall shall be erected prior to ~ssuance of building permits and certificates of occupancy The Zoning Map of the City of Denton, Texas, adopted the 14th day of January, 1969, as an Appendix to the Code of Ordinances of the C~ty of Denton, Texas, under Ordinance No 69-1, be, and the same is hereby amended to show such change in D~strlct Classification and Use suboect to the above conditions and specifications SECTION II That the City Council of the City of Denton, Texas, hereby finds that such change is ~n accordance with a comprehensive plan for the purpose of promoting the general welfare of the City of Denton, Texas, and with reasonable consideration, among other things for the character of the dlstr~ct and for ~ts Z-1SB1/INDIGO BUILDERS, INC /PAGE 1 peculiar suitability or particular uses, and w~th a v~ew to conserving the value of the buildings, protecting human l~ves, the and encouraging the most appropriate uses of land for maximum benefit to the City of Denton, Texas, and its citizens SECTION III That th~s ordinance shall be ~n full force and effect ~mmedlately after ~ts passage and approval, the required public hearings hawng heretofore been held by the Planning and Zoning Commission and the C~ty Council of the C~ty of Denton, Texas, after gzv~ng due not~ce thereof _ , 19 PASSED AND APPROVED th~s the~ day of D TO , T XAS ATT ~ST CITY Of DENTON, TEXAS APPROVED AS TO LEGAL FOR~ C J TAYLOR, JR , CITY ATTORNEY CITY Of DENTON, Z-1581/INDIGO BUILDERS, INC /PAGE 2 s~oo JOSpU]M ~ ~
