1983-054 AN ORDINANCE GRANTING A SPECIFIC USE PERMIT AND AMENDING iHE ZONING MAP OF THE CITY OF DENTON, TEXAS, AS SAME WAS ADOPTED AS AN APPENDIX TO THE CODE OF ORDINANCES OF THE CITY OF DENTON, TEXAS, BY ORDINANCE NO 69-1, AND AS SAID MAP APPLIES TO APPROXIMATELY 4 S ACRES OF LAND IN THE CITY AND COUNTY OF DENTON, TEXAS, AND DECLARING AN hFFEC£IVE DATE THE COUNCIL OF THE CITY OF DENTON, TEXAS, HEREBY ORDAINS SECTION I The Zoning Classification and Use designation of the following described property, to-wit All that certain 5 178 acre tract of land, or parcel of land s~tuated ~n the Wm Daniels Survey, Abstract No 378, City and County of Denton, Texas, sa~d tract being part of lands shown by deeds from G~bson to Welch as recorded ~n Volume $33, Page 397 and Volume 362, Page 169 of the Deed Records of Denton County, Texas, sa~d tract being further described herein by metes and bounds as follows BEGINNING for the southeast corner of tract being described here~n, at a right of way marker found at the northeast corner of tract described ~n deed to Rene Cassar as recorded ~n Volume 1081, Page 756 of the Deed Records of Denton County, Texas (locally known as part of Center Point Mobile Home Park), THENCE west 629 45 feet generally along fence to an iron p~n found at angle poxnt in fence l~ne, THENCE north 89°43'09'' west 198 58 feet to the southwest corner of aforementxoned tract as shown by deed recorded xn Volume 362, Page 169 of saxd Deed Records, THENCE north 1°57'Z4'' west 25 0 feet to the most western northwest corner of said tract, THENCE south 89°32'26'' east 198 59 feet to ~ron p~n found at fence corner, THENCE north 1°59'29" west 224 36 ~eet to an ~ron p~n found at fence corner THENCE south 89°53'43'' east 459 0 feet to a point ~n north line of aforementioned Cassard tract, THENCE 4°24'46'' east 248 2 feet parallel to the western l~ne of U $ H~ghway No 377 to a point, THENCE south 89~53'43'' east 160 0 feet to a point ~n the western l~ne of sa~d U S Highway No 377, THENCE south 4~24'46'' east 114 2 feet to the place of beginning which ~s classified as Light Industrial "LI" D~stnct Classify- cation Use under the Comprehensive Zoning Ordinance of the C~ty of Denton, Texas ~s hereby changed and a bpec~f~c Use Permit ~s S-164-W Y TUNNICLIFF-PAGE 1 hereby granted for the use of sa~d property for an extension of a mobile homo park known as Center Poxnt Mobile aome Park to accommodate twenty (20) additional lots or stands, subject to the following conditions and restrictions to-w~t 1 Plans for development and the development xtself shall conform w~th the Mobile Home Park and Travel Tra~ler Ordinance and subd~ws~on regulations of the C~ty of Denton prior to the ~ssuance of building permits and certificates of occupancy, 2 Development shall conform to approved s~te plan or plot plan, 3 A s~x foot (6') solid wooden fence shall be erected on all property l~nes that abut land uses that are not mob~lo home or travel tra~ler parks, 4 A ten foot (10') rear yard and s~de yard setback shall be observed The development of the property shall be ~n substantial compliance w~th the s~te plan attached hereto and made a part hereof for all purposes The Zoning Map of the C~ty of Denton, Texas, adopted the 14th day of January, 1969, as an Appendix to the Code of Ordinances of the C~ty of Denton, ~exas under Ordinance No 69-1, be, and the same ~s hereby amended to show such change ~n D~str~ct Classification and Use SECTION II That the C~ty Council of the C~ty of Denton, Texas hereby finds that such change is ~n accordance w~th a comprehensive plan for the purpose of promoting the general welfare of the C~ty of Denton, Texas, and w~th reasonable consideration, among other th~ngs for the character of the dlstr~ct and for its peculiar suitability or particular uses, and w~th a wew to conserwng the value of the buildings, protecting human l~ves, and encouraging the most appropriate uses of land for the maximum benefit to the C~ty of Denton, Texas, and ~ts c~t~zens SECTION III That th~s ordinance shall be ~n full force and effect ~mmed~ately after ~ts passage and approval, the required public S-164-W Y TUNNICLIFF-PAGE 2 hearings having heretofore been held by the Planning and Zoning Commission and the City Council of the City of Denton, Texas, after giving due notice thereof PASSBD AND APPROVED this the /77~ay of -"~J/~'~ , 1983 CIT~ OF D~TON, TEXAS ATTEST CHARLOTTE ALLEN[ CITY SECRETARY CITY OF DENTON, TEXAS APPROVED AS TO LEGAL FORM C J TAYLOR, JR , CITY ATTORNEY CITY OF DENTON, ~BXAS S-164-W Y TUNNICLIFi~-PAGB 1
