AN ORDINANCE PROVIDING FOR THE ABANDONMENT OF AN ALLEY WITHIN
THE CITY OF DENTON AND AUTHORIZING THE MAYOR TO EXECUTE A
QUITCLAIM DEED CONVEYING ALL RIGHT, TITLE AND INTEREST OF THE
CITY IN SAID ALLEY TO THE OWNER OF THE ADJACENT TRACT OF LAND,
AND DECLARING AN EFFECTIVE DATE
WEEREAS, the City Council of the C~ty of Denton, acting
pursuant to law, and upon the request and petition of the
grantee here~n, deems it advisable to abandon and convey the
hereinafter described tract of land to grantee and ls of the
op~n~on that sa~d alley is not needed for public use, and that
same should be abandoned and qultcla~med to Harpool Seed, Inc
and Richard A Harris, and
WHEREAS, the C~ty Council of the Clty of Denton ~s of the
opinion that the best ~nterest and welfare of the public will be
served by abandoning and conveying the same to Harpool Seed,
Inc and R~¢hard A Harris, for the consideration hereinafter
more fully set forth, now, therefore,
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF DENTON
SECTION I
That the followlng described tract of land in the C~ty of
Denton be and the same ~s hereby abandoned, vacated and closed
· nsofar as the r~ght, t~tle and interest of the public are
concerned
All that certain tract or parcel of land situated in the H
Slsco Survey, Abstract No 1184, City and County of Denton,
Texas, and being all of an alley ~n Block 2 of Fulton &
Spauld~ng Railroad Addition to sa~d City, plat of whlch
recorded ~n Volume O, Page 335, Deed Records of sald County, and
being more fully described as follows
BEGINNING at the southeast corner of Lot 7, Block 2 of said
Fulton & Spauld~ng Railroad Addition to the Clty of Denton and
on the west r~ght-of-way of the Texas and Pacific Railroad,
THENCE south w~th the west boundary line of sa~d railroad
right-of-way a d~stance of 20 0 feet to a corner at the
northeast corner of Lot 14, Block 2,
THENCE west wlth the south boundary l~ne of said alley a
dlstance of 300 0 feet to the northwest corner of Lot 8, Block 2
on the east r~ght-of-way of Bell Avenue,
THENCE north w~th the east r~ght-of-way of Bell Avenue a
d~stance of 20 0 feet to the southwest corner of Lot 1, Block 2
of sa~d Fulton and Spauld~ng Railroad Addition,
THENC5 east w~th the north boundary line of sa~d alley a
dlstanoe of 300 0 feet to the place of beglnn~ng
SECTION II
That the Mayor and C*ty Secretary are hereby authorized to
execute and deliver that certain quitclaim deed attached hereto
and ~ncorporated here~n conveying sa~d alley described there~n
to Harpool Seed, Inc and R~chard A Harris

That portion of the public alley herein described being
vacated, abandoned, and closed is made sub3ect to all ex,sting
zoning regulations and deed restrictions, ~f any, and sub3ect to
all existing easement rights of others, if any, whether apparent
or not
SECTION IV
This ordinance shall take effect and be in full force and
effect from and after the date of its passage, and it ~s so
ordained
