TEXAS~ BY ORDINANCE NO 69-1, AND AS SAID MAP APPLIES TO
APPROXIMATELY 17 359 ACRES OF LAND, AND BEING LOCATED AT THE
NORTHWEST CORNER OF BERNARD AND GREENLEE, AS SHOWN ON THE TAX
RECORDS OF THE CITY OF DENTON, TEXAS, AND DECLARING AN EFFECTIVE
DATE
THE COUNCIL OF THE CITY OF DENTON, TEXAS, HEREBY ORDAINS
SECTION I
The Zoning Classlficatlon and Use designation of the
following described property, to-wit
All that certaln tract or parcel of land s~tuated In the Eugene
Puchalskl Survey, Abstract No 996, and the A N B Tompklns
Survey, Abstract No 1246, Denton County, Texas, being a part of
a certain (called) 22 20 acre tract deeded by the General
Assembly's Board of Ministerial Relief of the Cumberland
Presbyterlan Church to the Board of Trustees of the Cumberland
Presbyterlan Children's Home, Inc on the 7th day of April,
1951, recorded ~n Volume 368, Page 494, Deed Records of said
County, and being more particularly described as follows
BEGINNING at the northeast corner of said 22 20 acre tract at
the lntersectlon of the south r~ght of way of Greenlee Street
and the west right of way of Bernard Street,
THENCE south 01°52'29'' west along the west right of way of
Bernard Street a distance of 871 01 feet to a chain link fence,
THENCE south 89°39'45'' west along a fence a d~stance of 661 49
feet to a point in the south line of sa~d 22 20 acre tract and
the southeast corner of a (called) 2 92 acre right of way tract
deeded to the State of Texas and recorded in volume 348, Page
390, Deed Records of Denton County, Texas,
THENCE north 47°26'00'' west along said right of way a distance
of 658 93 feet,
THENCE north 02~01'06'' west along said right of way a distance
of 60 0 feet to a point in the south right of way of Earl Street,
THENCE north 87°58'54'' east along the south right of way of Earl
Street a distance of 390.96 feet to a fence corner post,
THENCE north 00~09'08'' west along a fence and the east right of
way of Central Street a distance of 331 61 feet to a point ~n
the south right of way of Greenlee Street,
THENCE south 88°18'01'' east along the south right of way of
Greenlee Street a distance of 787 89 feet to the polnt of
beginning and containing 17 359 acres of land
which is classified as Single Family "SF-7" D~str~ct Classifi-
cation Use under the Comprehensive Zoning Ordinance of the City
of Denton, Texas ~s hereby changed and a Specific Use Permit ~s
hereby granted for the use of said property for expansion of the
existing children's home, sub3ect to the following special
condltlons and restrictions, to-wit
1 Uses and facilities shall be limited to those
incidental or related to the children's home and
shall conform to the approved s~te plan,

shall be enforced, and
3 The chlldren's home use shall be l~mlted to the

D~strlct The development of the property shall be an
substantial compliance with the sate plan attached hereto and
made a part hereof for all purposes
The Zoning Map of the City of Denton, Texas, adopted the
14th day of January, 1969, as an Appendix to the Code of
Ordanances of the C~ty of Denton, Texas under Ordinance No
69-1, be, and the same is hereby amended to show ~uch change ~n
D~stract Classification and Use
SECTION II
That the C~ty Council of the C~ty of Denton, Texas hereby
fands that such change ~s in accordance with a comprehensive
plan for the purpose of promotang the general welfare of the
City of Denton, Texas, and w~th reasonable consideration, among
other thlngs for the character of the d~str~ct and for ~ts
peculiar suitability or partacular uses, and w~th a v~ew to
conserving the value of the buildings, protectang human lives,
and encouraging the most appropriate uses of land for the
maximum benefit to the C~ty of Denton, Texas, and ~ts cltlzens
SECTION III
That th~s ordinance shall be an full force and effect
~mmediately after ~ts passage and approval, the required publlc
hearings having heretofore been held by the Planning and Zoning
Commass~on and the City Council of the Caty of Denton, Texas,
after g~v~ng due not~ce thereof ~ . ~

AN ORDINANCE OF THE CITY OF DENTON, TEXAS, APPROVING AN AMENDMENT
TO THE SITE PLAN FOR THE SPECIFIC USE PERMIT (SUP NO 167) GRANTED
BY ORDINANCE NO 83-36 FOR A CHILDREN'S HOME LOCATED AT THE
NORTHWEST CORNER OF BERNARD STREET AND GREENLEE STREET, PROVIDING
FOR A PENALTY IN THE AMOUNT OF $2,000 00 FOR VIOLATIONS THEREOF,
AND PROVIDING FOR AN EFFECTIVE DATE
WHEREAS, by Ordinance No 83-36, a specific use permit was
granted for 17 acres of land for the expansion of the exlsting
children's home, and
WHEREAS, by Ordinance No 86-105, a revised site plan for the
property was approved, and
WHEREAS, Morton Building, representing Cumberland Presbyterian
Children's Home, has requested a further amendment to the site plan
to allow the construction of a maintenance and storage building,
and
WHEREAS, on April 26, 1989, the Planning and Zoning Commission
recommended approval of the request, NOW, THEREFORE,
THE COUNCIL OF THE CITY OF DENTON HEREBY ORDAINS
~ That Ordinance No 86-105 is repealed
~ That Ordinance No 83-36, is amended by approving
a new site plan for the specific use permit therein approved, so
that the property shall hereafter be developed, used, and main-
tained in accordance with the site plan shown in Exhibit "A",
attached hereto and incozl0orated herein by reference
~ That a copy of this ordinance shall be attached
to Ordinance No 83-36, showing the amendment herein made
~ That any person violating any provision of this
ordinance, or of any site plan here~n approve, shall, upon
conviction, be fined a sum not exceeding $2,000 00 Each day that
a provision of this ordinance is violated shall constitute a
separate and distinct offense
~ That this ordinance shall become effective
fourteen (14) days from the date of its passage, and the City
Secretary is hereby directed to cause the caption of this ordinance
to be published twice in the Denton Record-Chronicle, the official
newspaper of the City of Denton, Texas, within ten (10) days of the
date of its passage
