1983-034ALLAN GETZ/S-165 AN ORDINANCE GRANTING A SPECIFIC USE PERMIT AND AMENDING THE ZONING MAP OF THE CITY OF DENTONt TEXAS, AS SAME WAS ADOPTED AS AN APPENDIX TO THE CODE OF ORDINANCES OF THE CITY OF DENTON, TEXAS, BY ORDINANCE NO 69-1, AND AS SAID MAP APPLIES TO APPROXIMATELY 39 313 ACRES OF LAND, AND BEING LOCATED ALONG THE EAST SIDE OF MAYHILL ROAD AS SHOWN ON THE TAX RECORDS O~ THE CITY OF DENTON, TEXAS, AND DECLARING AN EFFECTIVE DATE THE COUNCIL OF THE CITY OF DENTON, TEXAS, HEREBY ORDAINS SECTION I The Zoning Classification and Use designation of the following described property, to-wit BEING all that lot, tract or parcel of land out of the Gideon Walker Survey, Abstract No 1330, Denton County, Texas, and belng a port~on of a called 61-2/3 acre "First Tract" conveyed to S D Roberts as recorded ,n Volume 256, Page 549, Deed Records of Denton County, Texas, and being more particularly descrlbed as follows BEGINNING on the west l~ne of said Walker Survey at the northwest corner of sald Roberts tract sa~d point being at the centerl~ne intersection of public roads, THENCE south 88°29' east along the centerl~ne of sa,d east-west publ,c road a d~stance of 1489 1 feet to a fence corner for the northeast corner of sa~d Roberts Tract, THENCE south 2°06' west along the center llne of a north-south publlc road a dlstance of 1154 4 feet to a po,nt for a corner in the center of said public road, THENCE north 87°57'30'' west following a fence l~ne part of the way a d~sance of 1495 5 feet to the west 1,ne of sa,d G,deon Walker Survey in the center of a public road, THENCE north 2~25'30'' east along the west line of aid Walker Survey and the center l~ne of sa~d public road a d~stance of 1140 8 feet to the plaoe of beginning, and contaln~ng in all 39 313 acres of land which is classified as an Agricultural "A" D~str~ct Class~f,- cat*on Use under the Comprehensive Zon,ng Ordinance of the C*ty of Denton, Texas ,s hereby changed and a Spec,f~c Use Permit is hereby granted for the use of sa~d property for a mob,le home park, subject to the following special conditions and restrictions, to-w~t 1 The property shall be developed in accordance with the City of Denton Mobile Home Park and Travel Trailer Ordinance 2 A preliminary and f~nal plat shall be submitted in accordance with City of Denton subdivision regula- tions, and approved prior to issuance of any bu,ld~ng perm,ts or cert,f~cates of occupancy 3 The approved slte plan and prelim,nary and f~nal plats must refleot the sixty (60) foot road dedication for Mayhlll Road PAGE ONE in addition to all uses authorized in an Agricultural "A" D~strlct The development of the property shall be ~n substantial compliance with the s~te plan attached hereto and made a part hereof for all purposes The Zoning Map of the City of Denton, Texas, adopted the 14th day of January, 1969, as an Appendix to the Code of Ordinances of the C~ty of Denton, Texas under Ordinance NO 69-1, be, and the same is hereby amended to show such change ~n Distract Classification and Use SECTION II That the City Council of the City of Denton, Texas hereby f~nds that such change Ks an accordance w~th a comprehensive plan for the purpose of promoting the general welfare of the City of Denton, Texas, and with reasonable consideration, among other things for the character of the district and for ~ts peculiar suitability or particular uses, and with a view to conserving the value of the buildlngs, protecting human lives, and encouraging the most appropriate uses of land for the maximum benefit to the City of Denton, Texas, and its citizens SECTION III That this ordinance shall be ~n full force and effect · mmed~ately after ~ts passage and approval, the required publlc hearings having heretofore been held by the Planning and Zoning Commission and the City Council of the City of Denton, Texas, after giving due notice thereof ~_~ PASSED AND APPROVED this the~_~_ day of , 1983 CHARLOT~EALLE~ CITY SF~Q~TARY/ ~ CITY OF DENTON, TEXAS APPROVED AS TO LEGAL FORM C J TAYLOR, JR , CITY ATTORNEY CITY OF DENTON, TEXAS PAGE TWO
