1983-033 AN ORDINANCE ANNEXING A TRACT OF LAND CONTIGUOUS AND ADJACENT TO THE CITY OF DENTON, TEXAS, BEING ALL THAT LOT, TRACT OR PARCEL OF LAND CONSISTING OF APPROXIMATELY 456 ACRES OF LAND LYING AND BEING SITUATED IN THE COUNTY OF DENTON, STATE OF TEXAS AND BEING PART OF THE J FISHER SURVEY, ABSTRACT NO 421, B LEWIS SURVEY, ABSTRACT NO 769, M E P & P R R SURVEY, ABSTRACT NO 950, E PICKATT SURVEY, ABSTRACT NO 1018, AND THE S HEMBRIE SURVEY, ABSTRACT NO 643, DENTON COUNTY, TEXAS, CLASSIFYING THE SAME AS AGRICULTURAL "A" DISTRICT PROPERTY, AND DECLARING AN EFFECTIVE DATE WHEREAS, the request for annexation was Introduced at a regular meeting of the C~ty Council of the City of Denton, Texas, on the petition of the C~ty of Denton, Texas, and WHEREAS, an opportunity was afforded, at a public hearing held for that purpose on February 1, 1983 ~n the Council Chambers for all ~nterested persons to state their v~ews and present evidence bearing upon the annexation provided by thls ordinance, and WHEREAS, an opportunity was afforded, at a public hearing held for that purpose on February 1, 1983 upon the property hereinafter described in th~s annexation ordinance for all interested persons to state their v~ews and present evidence bearing upon the annexation provlded by this ordinance, and WHEREAS, th~s ordinance has been published in full at least one tlme ~n the official newspaper of the C~ty of Denton, Texas, prior to ~ts effective date, and after the public hearlngs, NOW, THEREFORE, THE COUNCIL OF THE CITY OF DENTON, TEXAS, HEREBY ORDAINS SECTIQN I That the hereinafter described tract of land be, and the same ~s hereby annexed to the C~ty of Denton, Texas, and the same ~s made hereby a part of sa~d C~ty and the land and the present and future ~nhab~tants thereof shall be entitled to all the rights and privileges of other c~t~zens of said Clty and shall be bound by the acts and ordlnances of said C~ty now ~n effect or which may hereafter be enacted and the property Agricul- tural "A" District and shall so appear on the official zoning map of the City of Denton, Texas, which map is hereby amended accordingly SECTION III This ordinance shall be effective requires that a plan of servzce be adopted by the governing body of a city prior to passage of an ordinance annexing an area, and WHEREAS, the C~ty of Denton zs contemplating annexation of an area which is bounded as shown on a map of the proposed annexation NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF DENTON, TEXAS Section i Pursuant to the provisions of Article 970a as amended, Texas Code Annotated, there is hereby adopted for the proposed annexation area the following plan of service I Basmc Service Plan A Police (1) Patrolling, radio responses to calls, and other routine police services, using present personnel and equipment, will be provided on the effective date of annexation, (2) Traffic signals, traffic signs, street markings, and other traffic control devices w~ll be installed as the need therefore is established by appropriate study and traffic standards B Fire (1) Fire protection by the present personnel and equip- ment of the fire f~ght~ng force, will be provided on the effective date of annexation C Water (1) Water for domestzc, commercial and zndustrzal use w~ll be provided at city rates, from ex,sting czty l~nes on the effective date of annexatzon, and thereafter from new l~nes as extended zn accordance with article 13 06 of appendix A of the code of the City of Denton, Texas D Sewer (1) Properties in the annexed areas w~ll be connected to sewer lines in accordance w~th article 13 06 of appendzx A of the code of the City of Denton, Texas E Refuse Collection (1) The same regular refuse collectzon service now pro- v~ded wzth~n the c~ty w~ll be extended to the annexed area within one month after the effective date of annexation Service Plan Annexed Areas Page two F Streets (1) Emergency maintenance of streets (repair of hazardous chuckholes, measures necessary for traffic flow, etc ) will begin on the effective date of annexation (2) Routzne maintenance on the same baszs as in the present cityj will begin ~n the annexed area on the effective date of annexation (S) Reconstruction and resurfac~ng of streets, znstalla- tion of storm drainage fac~lzt~es, constructzon of curbs and gutters, and other such major improvements, as the need therefore zs determined by the governing body, w~ll be accomplished under the established policies of the czty G Inspection Services (1) Any inspection services now provided by the c~ty (building, electrical, plumbing, gas, housing, sanitation, etc ) will beg~n ~n the annexation area on the effective date of annexatzon H Planning and Zoning (1) The Planning and Zoning jurisdiction of the c~ty will extend to the annexed area on the effective date of annexation City planning w~ll thereafter encompass the annexed area I Street L~ghting (1) Street lighting will be ~nstalled ~n the substan- tially developed areas zn accordance w~th the establzshed policies of the c~ty J Recreation (1) Residents of the annexed area may use all existing recreational facilities, parks, etc , on the effec- tive date of annexation The same standards and policies now used ~n the present city w~ll be fol- lowed ~n expanding the recreational program and facilities in the enlarged c~ty K Electric Distribution (1) The czty recommends the use of C~ty of Denton for electric power Service Plan Annexed Areas Page three L Miscellaneous (1) Street name signs where needed w~ll be installed wlthln approximately 0 months after the effective date of annexation II Capital Improvement Program (CIP) The CIP of the C~ty consists of a f~ve year plan that ~s up- dated yearly The Plan is prioritized by such polzcy Eu~de- lines as (1) Demand for services as compared to other areas based partly on density of population, maEnitude of problems compared to other areas, established technical standards and professional studies, ~nd natural or technical restraints or opportunztzes (2) Impact on the balanced Erowth polzcy of the c~ty (3) Impact on overall city economics The annexed area will be considered for CIP planning zn the upcoming CIP plan, which w~ll be no lonEer than one year from the date of annexation In th~s new CIP planning year the annexation area w~ll be Judged accordingly to the same established criteria as all other areas of the c~ty
