1983-03140L NO AN ORDINANCE AMENDING CHAPTER 15, "PARKS AND RECREATION" OF TH~ CODE OF ORDINANCES OF THE CITY OF DENTON, T~XA~, 1~66, AS AMENDED, BY RENUMBERING THE SECTIONS THEREIN, DELPTING CERTAIN SECTIONS, PROHIBITING AND REGULATING CFRTAIN rONDUCT IN PARK~, PROVIDING FOR A PENALTY IN ~ ~OUNT NOT TO EXCEED ~O HUNDRFD DOLL'S ($200 00~, PROVIDING FOR A SEVERABILITY CLAUSe, AND PROVIDING FOR ~ EFFECTIVE DATE THE COUNCIL OF THE CITY OF DENTON, TFXAS HEREBY ORDAINS SECTION I That ~ectlon 15-2 "Qualifications, powers and duties defined in Charter" of Chapter 1S of the Code of Ordinances of the City of Denton, Texas, 1066, as amended, is hereby deleted ~ECTION II That Sections 15-3 through lg-7 ~ of Chapter 15 of the Code of Ordinances of the City of Denton, Texas, l~66, as amended, are hereby renumbered consecutively as Sections 15-? through 15-7 SECTION III That Section 1S-6[b], of the Code of Ordinances of the City of Denton, Texas, 1966, as amended, and herein renumbered as Section 1S-5(b}, is amended to hereafter read as follows (b) Vehicles and animals limited to certain areas It shall be unlawful for any person to operate or drive any automobile, motorcycle or other vehicle or to lead, drive or ride any animal over or through any park, except along and upon park streets, drives, parkways or boulevards SECTION IV That Section 15-6 of the Code of Ordinances of the City of Denton, Texas, lq66, as amended, and herein renumhered as Section 1S-S, is amended by adding a new Section l~-5[d] which shall hereafter read as follows rd) Parking Restrictions It shall be un]awful for any person to park any vehicle in a Dark except in places designated by the City for such purposes and it shall be unlawful for any person to park or permit to remain parked any vehicle owned by or under said person's control on park property after ten o'clock p m or before six o'clock a m unless participating in an activity which is scheduled by or with the approval of the City SECTION V That Section lg-7fc] of the Code of Ordinances of the City of Denton, Texi~, ,n65, as amended, is amended by deleting the present Section 15-7(c) and enacting a new Section l~-7(c) here~n renumhered as Section 15-6(c] which shall hereafter read as follows (c] Bring ~n or dump, deposit or leave any bottles, broken glass, ashes, paper, boxes, cans, dirt, rock, rubbish, waste, wood, ~arhage, refuse or other household or commercial trash, containers, equipment or appliances No such refuse, trash or other materials shall be placed in any waters in or contiguous to any park or left anywhere on the grounds thereof, but shall he placed ~n the proper receptacles where provided, and if not provided, all such rubbish, trash or waste shall he carried away from the park by the person responsible for ~ts presence and properly deposed of elsewhere SECTION VI That Section 15-7 of the Code of Ordinances of the City of Denton, Texas, 1966, a~ amended, and herein renumbered as Section 15-6 is hereby amended by adding thereto a new Section 15-6~e), (f), (gl, [h), (l) and ()), which shall hereafter read as follows {e) Bring in or dump, deposit or leave any noxious, hazardous or flammable materials or substances, either sol~d or liquid, on park property ff] Start or maintain a f~re in a park except ~n a fxreplace or grill at a stte dest~nated by the Parks and Recreation Department, to leave the par~ without extinguishing a fire started or maintained by that person, to burn wood found ~n the park, or to deposit hot coals in trash receptacles [g) Camp in a park other than an area designated by and w~th the written permission of the Parks and Recreation Department [h) Possess, bring into or discharge in a park any firearm, air or gas operated gun, bow, crossbow or other missile throwing device (1) Move or carry away any sod, sand, earth, tree, wood, shrub, flower or other landscapln~ in a park, or to trample, ~n~ure or destroy plant material and park fixtures or fac~ltt~es [~) Hit a golf ball in a park except in areas designated by the Parks and Recreation Department PAGE ? k No person shall take any fish or other aquatic life from park water areas by any means except a hook and line using natural or artificial bates All nets and seines are prohibited SECTION VII That Section 15-7 5 of the Code of Ordinances of the C~ty of Denton, Texas, 1966, as amended, and herein renumbered as Section 15-7, is amended to hereafter read as follows Section 15-7 CONSUMPTION OF ALCOHOLIC BEVERAGES PROHIBITED IN PARKING AREAS Wlth*n the l~mlts of any public park wlthln the City, it shall be unlawful for any person to consume any alcoholic beverage in a parking lot or area when such parking lot or area are adjacent to a recreation center or facility Recreation center or faclllty as used here~n shall mean a public building, structure or ~mproved area used for any type of recreatlonal actlvlty, and shall ~nclude but not be limited to swimming pools, basketball courts and tennls centers SECTION VIII That Section 15-8 of the Code of Ordinances of the City of Denton, Texas, 1966, as amended, is hereby deleted SECTION IX That Section 15-9 of the Code of Ordinances of the City of Denton, Texas, 1966, as amended, is here~n renumbered as Section 15-8, and amended to hereafter read as follows Section 15-8 CITY PARK CLOSED DURING CERTAIN HOURS The City parks shall De closed to the public between the hours of ten o'clock p m and slx o'clock a m on the following day, and it shall be unlawful for any person to enter or be found ~n City parks between such hours, except for events approved or scheduled by the Parks and Recreation Department or C~ty Council SECTION X That Section 15-10 of the Code of Ordinances of the City of Denton, Texas, 1966, as amended, is herein renumbered as Section 15-9 and amended to hereafter read as follows The violation of any prov~slon of this chapter shall be deemed an offense and be punishable by a fine not to exceed Two Hundred Dollars ($200 00) and each violation thereof shall be and ~s hereby deemed to be a d~st~nct and separate offense and punishable as such PAGE 3 SECTION XI That ~f any section, subsection, paragraph, sentence, clause, phrase or word ~n th~s ordinance, or application thereof to any person or clrcumstance ~s held ~nval~d by any court o~ competent jurisdiction, such holdlng shall not affect the validity of the remaining portions of thls ordinance, and the C~ty Council o~ the C~ty of Denton, Texas, hereby declares ~t would have enacted such remaining portions despite any such ~nval~dlty SECTION XII That this ordinance shall become effective fourteen (14) days from the date of ~ts passage, and the C~ty Secretary ls hereby d~rected to cause the captlon of th~s ordinance to be published twice in the Denton Record-Chronicle, the okf~c~al newspaper of the City of Denton, Texas, w~thln ten (10) days of the date of its passage PASSED AND APPROVED th~s the /~ay of ~, 1983 //RI~HARD~ STEWART, MAY~R CITY OF[DENTON, TEXAS ATTEST CHARLOTTE ALLEN, CITY SECRETARY CITY OF DENTON, TEXAS APPROVED AS TO L~.GAL FORM C J TAYLOR, JR , CITY ATTORNEY CITY OF DENTON, TEXAS / -// PAGE 4
