1983-029 .o AN ORDINANCE AMENDING THE ZONING MAP OF THE CITY OF DENTON, TEXAS, AS SAME WAS ADOPTED AS AN APPENDIX TO THE CODE OF ORDINANCES OF THE CITY OF DENTON~ TEXAS, BY ORDINANCE NO 69-1, AND AS SAID MAP APPLIES TO 3 359 ACRES OF LAND, MORE OR LESS, AND DECLARING AN EFFECTIVE DATE THE COUNCIL OF THE CITY OF DENTON, TEXAS, HEREBY ORDAINS SECTION I The Zonlng Classification and Use designation of the following described tracts of land, to-wlt All that certain tract or parcel of land s~tuated ~n the A White Survey, Abstract No 1406, Denton County, Texas, being a part of a certain (called) 52 54 acre tract deeded by Katherine Jagoe Preston, a widow to Cauble Enterprises on the 1st day of April, 1966, and recorded in Volume 536, Page 425, Deed Records of said County, and being more particularly described as follows COMMENCING at the southeast corner of sa~d 52 54 acre tract the north r~ght of way line of U S H~ghway 77, Business Route, THENCE north 00"14'00" east along the east boundary line of 52 54 acre tract a distance of 506 40 feet to a point ~n present city llm~s of the City of Denton, Denton County, Texas and the point of beginning, THENCE north 58°39'00" west along the sa~d present c~ty l~m~ts l~ne a distance of 991 57 feet, THENCE north 00°58'00'' west along the present clty limits l~ne a parallel with and 500 feet from the centerllne of Interstate H~ghway 35, a distance of 549 30 feet to a point ~n the north boundary line of sa~d A White Survey, THENCE south 89°36'00'' east along the north boundary line of sa~d A White Survey a distance of 107 05 feet, THENCE south 00°58'00'' east parallel w~th and 500 feet from the west boundary line of said 52 54 acre tract a d~stance of 582 83 feet, THENCE south 58°39'00'' east parallel with and 500 feet from the south boundary line of sa~d 52 54 acre tract a d~stance of 792 12 feet to a point ~n the east boundary line of said 52 54 acre tract, THENCE south 00"14'00'' west along the east boundary line of said 52 54 acre tract a d~stance of 69 05 feet to the point of beginning and containing 3 420 acres of land, more or less · s hereby changed from Agricultural "A" D~strlct Classification and Use to Commercial "C" D~str~ct Classification and Use under the Comprehensive Zoning Ordinance of the City of Denton, Texas The Zoning Map of the Clty of Denton, Texas, adopted the 14th day of January, 1969, as an Appendix to the Code of Ordinances of the C~ty of Denton, Texas under Ordlnance No 69-1, be, and the same ~s hereby amended to show such change ~n D~str~ct Classlf~cat~on and Use Z-1552 CAUBLE ENTERPRISES, INC -PAGE ONE SECTION II That the City Council of the C~ty of Denton, Texas hereby f~nds that such change ~s in accordance with a comprehensive plan for the purpose of promoting the general welfare of the C~ty of Denton, Texas, and w~th reasonable consideration, among other things for the character of the dlstr~ct and for its peculiar suitability or particular uses, and with a view to conserving the value of the buildings, protecting human lives, and encouraging the most appropriate uses of land for the maximum benefit to the C~ty of Denton, Texas, and its citizens SECTION III That th~s ordinance shall be in full force and effect immediately after ~ts passage and approval, the required public hearings having heretofore been held by the Planning and Zoning Commission and the City Council of the C~ty of Denton, Texas, after giving due notice thereof PASSED AND APPROVED th~s the /~/~%'day of ~/~, 1983 ~RI~HARD -07 STEWART, MAYOR CITY OF D~NTON, TEXAS ATTEST CITY OF DENTON, TEXAS APPROVED AS TO LEGAL FORM C J TAYLOR, JR , CITY ATTORNEY CITY OF DENTON, TEXAS Z-1552 CAUBLE ENTERPRISES, INC -PAGE TWO
