1983-027AN ORDINANCE ANNEXING A TRACT OF LAND CONTIGUOUS AND ADJACENT TO
THE CITY OF DENTON, TEXAS, BEING ALL THAT LOT, TRACT OR PARCEL
OF LAND CONSISTING OF APPROXIMATELY 3 420 ACRES OF LAND LYING
AND BEING SITUATED IN THE COUNTY OF DENTON, STATE OF TEXAS AND
BEING PART OF THE A WHITE SURVEY, ABSTRACT NO 1406, DENTON
COUNTY, TEXAS, CLASSIFYING THE SAME AS AGRICULTURAL "A" DISTRICT
PROPERTY, AND DECLARING AN EFFECTIVE DATE
WHEREAS, the request for annexation was introduced at a
regular meeting of the City Council of the City of Denton,
Texas, on the petition of the C~ty of Denton, Texas, and
WHEREAS, an opportunity was afforded, at a public hearing
held for that purpose on January 4, 1983 in the Council Chambers
for all ~nterested persons to state their views and present
ev~denoe bearing upon the annexation provided by this ordinance,
and
WHEREAS, an opportunity was afforded, at a public hearing
held for that purpose on January 18, 1983 upon the property
hereinafter described ~n th,s annexation ordinance for all
~nterested persons to state their v~ews and present evidence
bearing upon the annexation provlded by th~s ordinance, and
WHEREAS, this ordinance has been publlshed ~n full at least
one t~me ~n the official newspaper of the C~ty of Denton, Texas,
prior to its effective date, and after the public hearings,
NOW, THEREFORE, THE COUNCIL OF THE CITY OF DENTON, TEXAS, HEREBY
ORDAINS
SECTION I
That the hereinafter described tract of land be, and the
same is hereby annexed to the City of Denton, Texas, and the
same ~s made hereby a part of sa~d C~ty and the land and the
present and future inhabitants thereof shall be entitled to all
the r~ghts and privileges of other c~t~zens of said C~ty and
shall be bound by the acts and ordlnances of sa~d City now in
effect or which may hereafter be enacted and the property
s~tuated there~n shall be sub3ect to and shall bear ~ts prorata
part of the taxes levied by the C~ty The tract of land hereby
annexed is described as follows, to-w~t
All that certain tract or parcel of land s~tuated ~n the A
White Survey, Abstract No 1406, Denton County, Texas, being a
part of a certain (called) 52 54 acre tract deeded by Katherine
Jagoe Preston, a widow to Cauble Enterprises on the 1st day of
April, 1966, and recorded ~n Volume 536, Page 425, Deed Records
of said County, and being more particularly described as follows
COMMENCING at the southeast corner of sa~d 52 54 acre tract ~n
the north right of way line of U S H~ghway 77, Business Route,
THENCE north 00°14'00'' east along the east boundary line of sa~d
52 54 acre tract a d~stance of 506 40 feet to a point in the
present clty l~m~ts of the Clty of Denton, Denton County, Texas
and the point of beginning,
THENCE north 58°39'00'' west along the said present city limits
llne a distance of 991 57 feet,
THENCE north 00°58'00'' west along the present c~ty llmlts line
parallel with and 500 feet from the center l~ne of Interstate

boundary line of sa~d A White Survey,
THENCE south 89°36'00'' east along the north boundary line of
said A White Survey a distance of 107 05 feet,
THENCE south 00°58'00'' east parallel with and 500 feet from the
west boundary line of sa~d 52 54 acre tract a d~stance of 582 83
feet,
THENCE south 58°39'00'' east parallel w~th and 500 feet from the
south boundary l~ne of said 52 54 acre tract a d~stance of
792 12 feet to a point ~n the east boundary l~ne of said 52 54
acre tract,
THENCE south 00°14'00'' west along the east boundary l~ne of sa~d
52 54 acre tract a d~stance of 69 05 feet to the point of
beginning and containing 3 420 acres of land, more or less
SECTION II
The above described property ~s hereby classified as
Agricultural "A" D~str~ct and shall so appear on the official
zonlng map of the City of Denton, Texas, which map ~s hereby
amended accordingly
SECTION III
This ordinance shall be effective lmmed~ately upon ~ts
passage

PLAN OF SERVICE FOR ANNEXED AREA~ CITY OF DENTON~ TEXAS
WHEREAS, Article 970a as amended requires that a plan of service
be adopted by the governing body of a c~ty prior to passage of an ordinance
annexing an area, and
WHEREAS, the City of Denton is contemplating annexation of an
area whxch is bounded as shown on a map of the proposed annexation
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY
OF DENTON~ TEXAS
Section 1 Pursuant to the provisions of Article 970a as
amended, Texas Code Annotated, there ~s hereby adopted for the proposed
annexation area the following plan of service
I Baszc Service Plan
A Police
(1) Patrolling, radio responses to calls, and other
routine police services, using present personnel
and equzpment, w~ll be provided on the effective
date of annexation,
(2) Traffic signals, traffic s~gns, street markings,
and other traffic control devices w~ll be znstalled
as the need therefore zs established by appropriate
study and traffic standards
B Fire
(1) Fire protection by the present personnel and equzp-
ment of the fire f~ght~ng force, w~ll be provided
on the effective date of annexation
C Water
(1) Water for domestic, commercial and ~ndustr~al use
will be provided at c~ty rates, from ex~stlng city
l~nes on the effective date of annexation, and
thereafter from new l~nes as extended zn accordance
w~th article 13 06 of appendix A of the code of the
C~ty of Denton, Texas
D Sewer
(1) Properties ~n the annexed areas will be connected
to sewer l~nes in accordance w~th article 13 06 of
appendix A of the code of the City of Denton, Texas
E Refuse Collection
(1) The same regular refuse collectzon service now pro-
vlded wlthln the c~ty will be extended to the
annexed area w~th~n one month after the effective
date of annexatzon

F Streets
(1) Emergency maintenance of streets (repair of hazardous
chuckholes, measures necessary for traffic flow, etc )
will begin on the effective date of annexation
(2) Routine maintenance on the same basis as ~n the
present city, w~ll begin in the annexed area on
the effective date of annexation
(S) Reconstruction and resurfaclng of streets, installa-
tion of storm drainage facilities, construction of
curbs and gutters, and other such major improvements,
as the need therefore is determined by the governing
body, will be accomplished under the established
policies of the city
G Inspection Services
(1) Any inspection services now provided by the city
(building, electrical, plumbing, gas, housing,
sanitation, etc ) will begin in the annexation area
on the effective date of annexation
H Planning and Zoning ·
(1) The Planning and Zoning 3ur~sd~ctlon of the city
will extend to the annexed area on the effective
date of annexation C~ty planning will thereafter
encompass the annexed area
I Street L~ghting
(1) Street lighting w~ll be installed in the substan-
tially developed areas ~n accordance w~th the
established policies of the c~ty
J Recreation
(1) Residents of the annexed area may use all existing
recreational facilities, parks~ etc , on the effec-
tive date of annexation The same standards and
policies now used In the present city will be fol-
lowed · n expanding the recreational program and
facilities in the enlarged city
K Electric Distribution
(1) The city recommends the use of City of Denton for
electric power

(1) Street name signs where needed will be installed
within approximately 6 months after the effective
date of annexation
II Capital Improvement Program (CIP)
The CIP of the City consists of a five year plan that is up-
dated yearly The Plan is prioritized by such policy guide-
lines as
(1) Demand for services as compared to other areas
based partly on density of population, magnitude
of problems compared to other areas, established
technical standards and professzonal studies, and
natural or technical restraints or opportunities
(2) Impact on the balanced Erowth policy of the city
(3) Impact on overall czty economics
The annexed area w~ll be considered for CIP planning zn the
upcomlnE CIP plan, which w~ll be no longer than one year from
the date of annexation In this new CIP planning year the
annexation area will be judEed accordingly to the same
established criteria as all other areas of the czty
