1983-023AN ORDINANCE AMENDING THE ZONING MAP OF THE CITY OF DENTON, TEXAS, AS SAME WAS ADOPTED AS AN APPENDIX TO THE CODE OF ORDINANCES OF THE CITY OF DENTON, TEXAS, BY ORDINANCE NO 69-1, AND AS SAID MAP APPLIES TO APPROXIMATELY 0 330 ACRE OF LAND OUT OF THE TEASLEY MALL SUBDIVISION, AS SHOWN BY PLAT RECORDED IN VOLUME 14, PAGE 42 OF THE PLAT RECORDS, DENTON COUNTY, TEXAS, AND MORE PARTICULARLY DESCRIBED HEREIN, AND DECLARING AN EFFECTIVE DATE THE COUNCIL OF THE CITY OF DENTON, TEXAS, HEREBY ORDAINS SECTION I The Zoning Classification and Use designation of the followlng descrlbed property, to-wit All that certain tract or parcel of land being part of Lot 4, Block B, Teasley Mall Subdlvlslon, City of Denton, Denton County, Texas, as shown by plat recorded in Volume 14, Page 42 of the Plat Records of Denton County, Texas, sa~d tract being further descrlbed herein by metes and bounds as follows BEGINNING for the southeast corner of the tract being described herein, at an iron pln set at the southeast corner of said Lot 4, Block B, Teasley Mall Subdivision, on the north line of Londonderry Lane, THENCE north 88°40'43'' west 150 0 feet along the sa~d north line of Londonderry Lane to an ~ron pin set in the ground, THENCE north 0°17'09'' east 90 54 feet to an iron pln set in the north line of said Lot 4, Block B, THENCE south 89'23'30'' east 150 0 feet to the northeast corner of said Lot 4, Block B, THENCE south 0°17'09'' west 92 41 feet to the place of beginning ~s hereby changed from Multi-Family "MF-i" District Classlf~- cat~on Use to Planned Development-Neighborhood Services "NS" Dlstrict Classification and Use under the Comprehensive Zoning Ordinance of the City of Denton, Texas subject to the following conditions and restrlct~ons and Site Plan attached hereto to-wit 1 The use of the property shall De for a laundromat/ dry cleaners only 2 The property shall be developed in accordance with the approved site plan 3 Ail applicable City of Denton subdivision regulations, development codes, building codes and zoning ordinance requirements shall be complied with prior to issuance of building permits and a certificate of occupancy 4 The building sign as indicated on site plan ~n rock bed with railroad ties shall not exceed six (6') feet in height (measured at grade level) Z-1556/PAUL E SCHUELER-PAGE ONE 5 The m~nlmum d~stance from the southern edge of s~gn to the property line shall be no less than ten (10') feet 6 A slx (6') foot living screen or a slx (6') foot wooden fence shall be erected along the western property l~ne The Zoning Map of the City of Denton, Texas, adopted the 14th day of January, 1969, as an Appendix to the Code of Ordinances of the City of Denton, Texas, under Ordinance No 69-1, be, and the same is hereby amended to show such change ~n Dlstr~ct Classification and Use SECTION II That the Clty Council of the City of Denton, Texas, hereby f~nds that such change ~s ~n accordance with a comprehensive plan for the purpose of promoting the general welfare of the City of Denton, Texas, and with reasonable consideration, among other things for the character of the district and for its peculiar suitability or particular uses, and w~th a vlew to conserving the value of the buildings, protecting human lives, and encouraging the most appropriate uses of land for the maximum benefit to the C~ty of Denton, Texas, and its c~tlzens SECTION III That this ordinance shall be in full force and effect immediately after ~ts passage and approval, the required public hearings having heretofore been held by the Planning and Zoning Commiss~on and the C~ty Council of the C~ty of Denton, Texas, after giving due notice thereof /~ PASSED AND APPROVED this the ay of March, 1983 ATT~.ST CITY OF DENTON, TEXAS APPROVED AS TO LEGAL FORM C J TAYLOR, JR , CITY ATTORNEY CITY OF DENTON, TEXAS Z-1556/PAUL E SCHUELER-PAGE TWO
