1983-007AN ORDINANCE AMENDING ARTICLE III OF CHAPTER 11 OF THE CODE OF
ORDINANCES OF THE CITY OF DENTON, TEXAS, BY PROVIDING FOR THE
ISSUANCE OF WRITTEN CITATIONS TO PERSONS IN VIOLATION OF HEALTH
LAWS, MAKING IT UNLAWFUL TO GIVE THE ISSUING OFFICER A FALSE
NAME OR TO FAIL TO APPEAR IN ACCORDANCE WITH THE TERMS OF THE
CITATION, PROVIDING FOR A MAXIMUM FINE OF TWO HUNDRED DOLLARS
FOR VIOLATIONS HEREOF, PROVIDING FOR A SEVERABILITY CLAUSE AND
DECLARING AN EFFECTIVE DATE
THE COUNCIL OF THE CITY OF DENTON, TEXAS, HEREBY ORDAINS
SECTION I
That Article III of Chapter 11 of the code of Ordinances of
the City of Denton, Texas, be amended to provide for a new
Section 11-42 which shall hereafter read as follows
"Section 11-42 ENFORCEMENT
(1) The Director of the City-County Health Department
or any of his designated employees, hereinafter
each referred to as a "health officer", shall
have the responsibility and power to enforce the
provisions of this Chapter within the confines of
the C~ty of Denton, Texas
(2) Whenever a health officer determines that there
has been a violation by any person of this
Chapter or of a state law for which said officer
has the responsibility or authority to enforce,
said health officer may prepare a written not~ce
for said person to appear in court such notice
shall contain the name of the person, the
violations committed by such person and the t~me
and place when and where such person shall appear
in court Such notice shall have a place for
such person to give his written signature
promising to appear in accordance with its terms
3 It shall be unlawful for any person glvlng hls
written promise to appear in court, by signing
the written notice prepared by the health
officer, to fall to appear in accordance w~th
terms
4 It shall be unlawful for any person to knowingly
give the health officer a false name when such
officer requests the name of said person for
purposes of enforcing the provisions of the
Chapter "

or falls to comply therewith or with any of the requirements
