TEXAS, AS SAME WAS ADOPTED AS AN APPENDIX TO THE CODE OF
ORDINANCES OF THE CITY OF DENTON, TEXAS, BY ORDINANCE NO 69-1,
AND AS SAID MAP APPLIES TO APPROXIMATELY 8 956 ACRES OF LAND
OUT OF THE ALEXANDER HILL SURVEY, ABSTRACT NO 623, DENTON
COUNTY, TEXAS, AND MORE PARTICULARLY DESCRIBED HEREIN, AND
DECLARING AN EFFECTIVE DATE
THE COUNCIL OF THE CITY OF DENTON, TEXAS, HEREBY ORDAINS
SECTION I
The Zoning classification and Use designation of the
following described property, to-wit
All that certain 9 101 acre tract, or parcel of land sltuated
· n the Alexander H~ll Survey, Abstract No 623, City and County
of Denton, Texas, said tract being the remainder of tract
called 11 3/4 acres ~n deed from T p Burge to H F Hancock
as recorded ~n volume 170, Page 351 of the Deed Records of
Denton County, Texas, sa~d tract being further described hereln
by metes and bounds as follows
BEGINNING for the northwest corner of th~s, at the northwest
corner of said 11 3/4 acre Hancock Tract on the west l~ne of
the aforementioned H~ll Survey, a steel rod set in Bernard
Street,
THENCE south 89°39' east at 19 9 feet a crosst~e corner post,
overall 600 0 feet w~th fence to steel rod set at the northeast
corner of said Hancock Tract,
THENCE south 696 65 feet w~th the general course of old fence
line to a steel rod set 30 feet northerly of the occupied
center lxne of L~ndsey Street,
THENCE south 87°35' west 600 52 feet w~th the north line of
L~ndsey Street to ~ts ~ntersect~on w~th the west l~ne of the
aforementloned 11 3/4 acre Hancock Tract,
THENCE north 408 7 feet with the west line of sa~d Hancock
Tract to the point of intersection w~th the south l~ne of tract
described ~n deed from H F Hancock, et ux to Herbert Hancock,
Jr , et ux as recorded in volume 352, Page 446 of the Deed
Records of Denton County, Texas,
THENCE north 88~19' east at 12 feet the start of retaining wall
and fence, overall 162 18 feet to three ~nch p~pe post for the
southeast corner of sa~d Herbert Hancock, Jr Tract,
THENCE north 0~47' west at 74 25 feet fence corner, overall,
75 0 feet to the northeast corner of sa~d Herbert Hancock, Jr
Tract,
THENCE south 88°19' west 161 15 feet parallel to fence on south
sade of sa~d Herbert Hancock Tract to the west l~ne of
aforementioned 11 3/4 acre tract,
THENCE north 211 7 feet (call 210 0 feet) to the place of
beginning there being 0 145 acres ,n Bernard Street as It ~s
presently occupied leaving a net acreage of 8 956 acres of land

ls hereby changed from Single Family "SF-7" District Classifi-
cation Use to Planned Development "PD" D~strlct Classification
and Use under the Comprehensive Zoning Ordlnance of the C~ty of
Denton, Texas w~th the following condition
1 Apartments as specified and according to the layout
of the site plan dated January 3, 1983 as drawn by
Robert E Horn & Associates w~th the addition of a
slx (6') foot wooden fence erected along the
northern and eastern per~meters of the property
prior to issuance of a cert~flcate of occupancy
The Zoning Map of the Cxty of Denton, Texas, adopted the 14th
day of January, 1969, as an Appendix to the Code of Ordlnances
of the City of Denton, Texas, under Ordinance No 69-1, be, and
the same Is hereby amended to show such change ~n D~str~ct
Classification and Use
SECTION II
That the C~ty Council of the City of Denton, Texas, hereby
f~nds that such change ~s ~n accordance w~th a comprehensive
plan for the purpose of promoting the general welfare of the
C~ty of Denton, Texas, and with reasonable consideration, among
other th~ngs for the character of the d~strlct and for its
peculiar suitability or particular uses, and with a view to
conserving the value of the buildings, protecting human l~ves,
and encouraging the most appropriate uses of land for the
maximum benefit to the C~ty of Denton, Texas, and ~ts c~tlzens
SECTION III
That this ordinance shall be ~n full force and effect
immediately after ~ts passage and approval, the required public
hearings having heretofore been held by the Planning and Zoning
Commlsslon and the City Council of the C~ty of Denton, Texas,
after giving due not~ce thereof
