1983-003OF THE EXTRANCE TO SELWYN SCHOOL, REDUCING THE MAXIMUM PRIMA FACIE SPEED LIMIT FROM FIFTY (50) MILES PER HOUR TO THIRTY-FIVE (35) MILES PER HOUR, PROVIDING A PENALTY OF A FINE NOT TO EXCEED TWO HUNDRED DOLLARS ($200 00), PROVIDING A SEVERABILITY CLAUSE, AND DECLARING AN EFFECTIVE DATE THE COUNCIL OF THE CITY OF DENTON HEREBY ORDAINS SECTION I Based upon an engineering and traffic ~nvest~gatlon, the C~ty Council hereby designates and establishes a school zone on U S H~ghway 380 beginning at a point approximately 250 feet east and west of the entrance to Selwyn School and hereby determines that the reasonable and safe maximum prima facle speed l~m~t on said port~on of U S Hlghway 380 be reduced from flfty (50) to thlrty-flve (35) miles per hour when school ls in session between the hours of 8 00-9 00 A M and 3 00-4 00 P M SECTION II An individual adjudged gullty of exceeding thls speed llmlt, when signs are erected glvlng not~ce thereof, shall be gullty of a misdemeanor, and punished by a fine not to exceed Two Hundred Dollars ($200 00) SECTION III That ~f any section, subsection, paragraph, sentence, clause, phrase or word ~n th~s ordinance, or appllcatlon thereof to any person or c~rcumstance is held invalid by any court of competent ]urlsdlct~on, such holdlng shall not affect the validity of the remaining portions of th~s ordinance, and the City Councll of the C~ty of Denton, Texas, hereby declares would have enacted such remaining portions despite any such invalidity thereof, shall be guilty of a misdemeanor punishable by a fine not less than Ten Dollars ($10 00) nor more than Two Hundred Dollars ($200 00) Each such person shall be deemed guilty of a separate offense for each and every day or portion thereof during which any violation of this ordinance is committed, or continued, and upon conviction of any such violations such person shall be punished within the limits above SECTION IV That if any section, subsection, paragraph, sentence, clause, phrase or word in this ordinance, or application thereof to any person or circumstance is held invalid by any court of competent jurisdiction, such holding shall not affect the validity of the remaining portions of this ordinance, and the C~ty Council of the City of Denton, Texas, hereby declares ~t would have enacted such remaining portions despite any such invalidity SECTION V That this ordlnance shall become effective fourteen (14) days from the date of its passage, and the City Secretary is hereby directed to cause the caption of this ordinance to be published twice ~n the Denton Record-Chronicle, the official newspaper of the City of Denton, Texas, w~thln ten (10) days of the date of its passage ~~~ 1983 PASSED AND APPROVED this the ay of CH~RLOT~ ALLEN, CITY sECRETARx CITY OF DENTON, TEXAS APPROVED AS TO LEGAL FO~ C J TAYLOR, JR , CITY ATTORNEY CITY OF DENTON, TEXAS 300L PAGE 2 SECTION IV That this ordinance shall become effective fourteen (14) days from the date of its passage, and the City Secretary is hereby directed to cause the caption of this ordinance to be publlshed twice in the Denton Record-Chronicle, the official newspaper of the City of Denton, Texas, within ten (10) days of the date of its passage /~7~da PASSED AND APPROVED this the y of January, 1983 ATTEST CHARL-OTTE-ALLEN, -CITY SECRETARY CITY OF DENTON, TEXAS APPROVED AS TO LEGAL FORM C J TAYLOR, JR , CITY ATTORNEY CITY OF DENTON, TEXAS
